Multiannual financial framework 2021-27

Ministers discussed the multiannual financial framework (MFF) for 2021-27, ahead of the June European Council. The presidency had streamlined the options on the negotiating table ahead of the June European Council. Ministers agreed that the negotiations should conclude by the end of the year. However, issues that remained unresolved included: the prioritisation of funding between cohesion, common agricultural policy (CAP) and current spending; the framing of the debate on rebates; Horizon Europe; and restating of positions on own resources. The Commission underlined that the new European Parliament (EP) would be ready to restart discussions between the European Commission and the Council of the European Union in July.

Preparation of the European Council on 20-21 June 2019: Conclusions and European Council follow-up

The Council finalised preparations for the European Council on 20-21 June and Ministers broadly accepted the latest draft of conclusions. The agenda comprised: the next institutional cycle; MFF; climate change; the European semester; disinformation and hybrid threats; and external relations.

Member states discussed the projected timeline for the MFF and many requested a special November summit to facilitate further progress on negotiations. On climate, some member states pushed for a commitment to climate neutrality by 2050, as well as upholding the Paris agreement. Other member states continued to resist these proposals and insisted that an EU strategy should not pre-empt their own work in this area.

I intervened in support of the ambitious climate targets and highlighted the UK’s recent commitment to climate neutrality by 2050. I stressed the importance of EU leadership in tackling climate change. I also supported improving the EU’s security culture and enhancing its resilience against external hybrid security threats. I highlighted that countering disinformation remained a key priority for the UK and welcomed the language welcoming the adoption of the restrictive measures regime for cyber threats. On external relations, I underlined the need to continue to tackle Russian aggression and to support the full implementation of the Minsk agreement. I welcomed the inclusion of the relationship with Africa and reference to the five-year anniversary of the downing of flight MH17.

Enlargement and stabilisation and association process

Ministers agreed conclusions on the western Balkans and Turkey, in response to the Commission’s 2019 enlargement package. The conclusions take note of the Commission’s recommendation to open accession negotiations with the Republic of North Macedonia and Albania, based on its evaluation of the positive progress made. They also welcome the Prespa agreement between Greece and North Macedonia. The Council will revert to the issue with the intention of reaching a clear and substantive decision no later than October 2019.

European semester—Horizontal report on country-specific recommendations

Ministers discussed the Commission’s horizontal report on the macro-economic situation of the EU, which draws on country-specific recommendations (CSR), and decided to pass the report to the European Council.

The provisional agenda includes:

Multiannual financial framework 2021-2027

Ministers and the Commission will discuss progress on the multiannual financial framework (MFF) negotiations. The intention is for member states to reach an agreement on the negotiations in autumn 2019.

Preparation of the European Council on 20-21 June 2019: Conclusions and European Council follow-up

The Council will discuss preparations for the June European Council. The agenda includes: adoption of the 2019-2024 strategic agenda for the European Union; MFF; climate change; the European semester; and the disinformation and elections report prepared by the Romanian presidency in co-operation with the European Commission and the High Representative of the Union for Foreign Affairs and Security Policy. Ministers will also discuss progress in implementing previous European Council conclusions.

Enlargement and stabilisation and association process

Enlargement is the process whereby European countries are able to join the European Union. Ministers will discuss and adopt conclusions on the 2019 enlargement package which was presented by the Commission to the European Parliament, the Council of the European Union and other EU institutions on 29 May.

European semester—Horizontal report on country specific recommendations

The European semester provides a framework for the co-ordination of economic policies across the EU. Ministers will discuss the Commission’s horizontal report on the macro-economic position of the EU, which draws on country specific recommendations. The report will be passed to European Council ahead of its meeting on 20 and 21 June.

Today, I can confirm that the Government have reached a bilateral agreement with Luxembourg that will secure the rights of UK nationals living in Luxembourg, and Luxembourgish citizens living in the UK, to stand and vote in local elections in both a deal and no-deal scenario. This agreement builds on our close ties and reinforces our commitment to the future relationship between our two nations.

Citizens have always been our priority in the negotiations for our departure from the EU, as has protecting the interests of British expats. The UK pushed hard in negotiations to protect the right to stand and vote in local elections for UK nationals living in the EU, and EU citizens in the UK, but these rights were not included in the withdrawal agreement. Instead, we have been pursuing bilateral arrangements with individual member states to secure these rights. Throughout this process we have been clear that allowing EU citizens to vote in local elections in the UK should be considered alongside the rights and interests of UK nationals and it has been our priority to secure these reciprocally.

We have now reached agreements with Spain, Portugal and Luxembourg and we are continuing our discussions with other member states.

UK nationals will be able to continue to vote, and in some cases stand, in elections in member states where their domestic legislation allows this and they meet the requirements set out, for example on length of residency. This includes: Belgium, Denmark, Estonia, Finland, Ireland, Lithuania, Netherlands, Slovakia, Slovenia and Sweden.

I will be depositing a copy of the latest agreement in the Libraries of both Houses.

May I be the first to congratulate my hon. Friend the Member for North Dorset (Simon Hoare) on his election to that important Select Committee, at an important time for it?

I want to begin by picking up on a few of the points that the right hon. and learned Member for Holborn and St Pancras (Keir Starmer) made in his opening remarks. The first passage of his speech covered what the motion does not do. He set out that it does not cover the legislation that it would unlock—it does not cover the substance, and it does not cover the form. So often in our exchanges at the Dispatch Box, he tells me how much he does not like a blind Brexit, and yet what we have before the House is, in essence, a blind motion. He devoted his opening remarks to the extent to which this is a blind motion, for it does not contain the detail on the basis of which the House will decide.

Interestingly, in the context of the Conservative leadership election, the right hon. and learned Gentleman went on to point out that a new Prime Minister would be limited—they would be unable to go to Brussels to secure a change of substance to the backstop—and yet his position is that a Labour Prime Minister would be able to go to Brussels to secure that. Within his remarks, one can see the contradictions inherent in the motion.

Let me deal with the substance of the motion. Section 1(b) gives precedence to any motion from any individual MP over Government business, and section 1(c) states that it is for you, Mr Speaker, to decide whether that motion is brought before the House over other motions. In essence, sections 1(b) and 1(c) say that an individual MP and the Speaker—two Members of the House—can override Government business. That is the effect of the motion. It puts in the hands of just two Members of Parliament the decision on which business takes precedence. That is what the text of 1(b) and 1(c) says.

The current Prime Minister has got stuck in a triangle composed of the Brexit that the Conservative party wants, the constitutional make-up of the United Kingdom, and the successor to the Good Friday/Belfast agreement and all it contains. She has not been able to sort out that triangle. What will be most important to the new Prime Minister when he goes to Brussels: the Brexit he is promising the Tory party, the constitutional make-up of the United Kingdom, or the legacy of the Good Friday/Belfast agreement?

First, the hon. Lady says “he”, but there are a number of female candidates in the leadership election and one should not pre-empt the outcome. Secondly, we do not know who the Prime Minister will be. Thirdly, first let me deal with the text. [Hon. Members: “Answer the question.”] I will happily come on to it, but I thought we were here, as per the direction of Mr Speaker and as the hon. Member for Stoke-on-Trent Central (Gareth Snell) said in an intervention, to debate the motion. [Interruption.] The hon. Member for Heywood and Middleton (Liz McInnes) may chunter, but I am not surprised that she does not want to debate the motion, because it is a flawed motion, for reasons I will come on to. Labour Members do not want to debate the text that is before the House.

I do not think that what I would call motion exegesis is a matter for the Chair. I think it is for the Secretary of State to explain the terms of his comments on the motion. I am saddened if the hon. Gentleman is befuddled. I would not want him to remain in a state of nescience for any length of time, so I hope the Secretary of State will elaborate, and then clarity will descend on the hon. Gentleman and all the people of Huddersfield.

Let me return to the text of the Opposition day motion, whose scope is virtually unlimited for business in relation to the UK’s withdrawal from the EU. Almost all aspects of our national life fall within that scope. Potentially, an individual Member could table a motion and it would be Mr Speaker alone who would determine precedence.

If recent election results have shown anything, it is the complete frustration of the British people with a failure to solve Brexit, and with Members of this House constantly saying what they do not support and do not believe in. Did my right hon. Friend hear anything in the 30-minute speech by the right hon. and learned Member for Holborn and St Pancras (Keir Starmer), or can he see anything in the motion, that remotely gives a positive or constructive solution or way forward to the Brexit impasse, rather than just more of what Members do not want?

My hon. Friend is absolutely right. What we hear repeatedly from Opposition Members is what they are opposed to, not what they are for. That is reflected in the fact that the European Union—[Interruption.] The shadow International Trade Secretary chunters. The European Union has been consistent in stating its view that the withdrawal agreement is the only offer on the table, but Labour Members voted against the withdrawal agreement, just as they voted against the deal each time. Their manifesto said that they would respect the result, yet many Labour Members want a second referendum, which is clearly at odds with their manifesto.

I entirely understand and appreciate my right hon. Friend’s tactics in trying to address procedural and textual points in the motion, rather than addressing the main point, which is rather difficult for the Government. I do not think those procedural and textual points would be raised if, by any sad chance, we were sitting on the Opposition Benches and telling a Government we opposed that the House as a whole wanted a debate and legislation on a particular issue.

Will my right hon. Friend move to the main point? Is he actually prepared to defend a situation where a new Prime Minister wishes to pursue a policy for which he or she knows there is no majority in the House of Commons? Does he believe it should be possible for that Prime Minister to prorogue and send away Parliament until he or she has exercised dictatorial powers to put the policy in place? That, I think, is plainly totally contrary to our constitution, and I do not see how any parliamentarian could possibly defend such a possibility.

I and, I think, the majority of Members absolutely share the belief of the Father of the House that anything that brings Her Majesty into the politics of the House is to be avoided. I have consistently stated that position. However, may I pick up on the specifics? I always listen very closely to the Father of the House, and he said to concentrate not on the procedural and textual points but on the substance, yet the shadow Brexit Secretary said the exact opposite. He said that he did not want to get on to the substance because that is not in the text. Members who support the motion are saying, on the one hand, that we should look at the specifics put forward by the Opposition—[Interruption.] I do not support bringing Her Majesty into it; I have answered that question. But it is incoherent for Members who support the motion to say, on the one hand, “Don’t look at the substance,” and, on the other hand, that the House should consider the substance.

My right hon. Friend is absolutely right to focus on the procedural nature of the motion. There are 10 leadership candidates and they have not yet been whittled down, yet this is an attempt to preserve a slot, through potentially one Member, just in case there is no appetite for whoever may lead the Conservative party. This is a premature business of the House motion. There is no need to secure 25 June when we have absolutely no idea who will be our next leader. Therefore, this should be made to wait until that decision is made.

My hon. Friend is absolutely correct. A number of senior Members are on the cross-party Procedure Committee, whose job is to advise the House on changes to procedure, but this proposal has not been supplied to it even for cursory consultation. What is the purpose of having a Select Committee to look at the procedures of this House if it is not consulted on such a fundamental change?

Can the Secretary of State be very clear? Is he saying, on behalf of Her Majesty’s Government, that they accept and agree that a new Prime Minister could prorogue Parliament, in the face of this place persistently voting against leaving without a deal, deliberately and specifically in order to impose that very no deal without this Parliament having any say—yes or no?

I speak as a Minister on behalf of this Government, and this Prime Minister has made it clear where she and the Cabinet stand on Prorogation. I have also set out the risk of any deviation from that position, because there is consensus across the House on the need to avoid any suggestion of bringing Her Majesty into a royal prerogative issue. Incidentally, the Opposition day motion does not mention the word “Prorogation”. They propose a fundamental change but do not want to deal with the issue on which the House is voting, which is the motion’s proposal to take over the Order Paper. That would be a fundamental change—Opposition Members who seek to be in government in future need to reflect on this—to the way in which this House operates, and it would happen without any consultation with the Procedure Committee. If people want to support that, what is the purpose of the Procedure Committee?

I am grateful to the Secretary of State, who has never been a member of the Procedure Committee, for giving way. It is not the Procedure Committee’s role to pre-vet Opposition or Government motions that are put before the House. Will he come back to the central point? How would he feel if somebody proposed to prorogue the House to avoid the House having a voice on something about which he was in the majority? On this matter, he is in the minority.

First, I am speaking on behalf of this Government. I do not know who the next Prime Minister will be or what decisions they will take. I have set out the risks of any deviation, and Mr Speaker has made it very clear, in terms of the way in which he would represent the will of the House, that there are a number of avenues. I would not want to interpret a judgment from the Chair, but the hon. Lady knows full well that in her exchange about Standing Order No. 24, the response from the Chair is germane to the issue. Any attempt at Prorogation would open the potential for SO 24 decisions.

The hon. Lady obviously did not want to deal with the text before the House, but let me consider what constitutional experts have said. Philip Cowley, professor at Queen Mary University’s School of Politics, said that taking the Order Paper outside the Government’s control would be

“one of the most fundamental shifts in the relationship between the government and parliament.”

[Interruption.] Opposition Members chunter, “We have already done this.” Yes, but let us look at how effective that was. When it was done by the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper), it was justified on the basis of her concern about the imminent risk of no deal. The constitutional advice from people such as Philip Cowley and Vernon Bogdanor, professor at King’s College, London, who warned about the actions at the time, saying that they were “unconstitutional”, was overridden because, we were told, the risk of no deal merited that emergency legislation.

Let me finish this point and I will then take further interventions. We were told that that constitutional change—passed in haste in a day—was required, without the involvement of the Procedure Committee, without due diligence and without proper consultation, to prevent no deal. However, what then happened in the House of Lords?

On a point of order, Mr Speaker. I and many others are concerned about the time. This matter has been listed for an hour of debate. So far, the Front-Bench contributions have taken up 40 of the allotted 60 minutes. Some of us wish to speak, but in any event, we all agree that this is an important motion, properly tabled by Her Majesty’s Opposition and worthy of debate. Can you assist us all, Mr Speaker, about the likely length of this important debate?

I do not want to state an expected length now. I will say that the observation about an hour is something that may have got abroad, but it is mere surmise. This debate could run until 8.33 pm, which I am sure will be more than adequate time for the right hon. Lady to make her contribution. I do not suggest that the debate will run for anything like that time, but the right hon. Lady should not be overly preoccupied with the idea that it will run for only an hour and that therefore the House would be deprived of the opportunity of hearing both the intellectual rigour of her prospective contribution and her mellifluous tones. There is every prospect that several people will be heard.

Of course, if I was not taking so many interventions, I would conclude my remarks with more alacrity. However, I accept the right hon. Lady’s request.

We were told last time that the European Union (Withdrawal) Act 2019 had to be passed in a day in an unprecedented manner to stop no deal. Yet, Lord Pannick, when debating the measure, said that

“the restrictions on the Prime Minister’s powers...may cause a no-deal exit”—[Official Report, House of Lords, 8 April 2019; Vol. 797, c. 405.]

That was the premise of the amendments tabled by Lord Pannick and others. The ultimate irony is that, first, we had a situation whereby emergency legislation passed in haste had the opposite effect to what was intended, and secondly, we were told that, to stop something unconstitutional, we needed to embrace parliamentary procedure that the constitutional experts said was unconstitutional.

In support of my right hon. Friend’s case, may I return him to the question I posed to the shadow spokesman, to which we did not get an answer? Indeed, the only answer was that if the Government cannot control their business, they should step down. I ask one or two of our Conservative colleagues who are thinking of supporting the motion to reflect on that answer. I will try to get out of my right hon. Friend an answer that we could not get from the Opposition: if we go down this road, does not that set a dangerous precedent? The Government control the business of the House so that they can honour election manifesto promises. If we cannot do that, they turn to dust.

My hon. Friend is absolutely right. I pray in aid the remarks of my right hon. Friend the Member for West Dorset (Sir Oliver Letwin). I always listen intently to him because he is a very experienced senior Member of the House. When the previous emergency legislation was passed, he said:

“We have been driven to this only in an extreme emergency”.—[Official Report, 27 March 2019; Vol. 657, c. 342.]

That related to timing. Yet is difficult to say that there is “an extreme emergency” if the next Prime Minister is the candidate that my right hon. Friend supports.

Does the Secretary of State accept that part of the public’s anger and frustration with Parliament, notwithstanding the back and forth and even individual contributions, is caused by our failure to resolve this matter? The feeling is, “a plague on all your houses”. What message does it send if a power grab means that parliamentarians, who are sent here to make decisions, are instead sent home and excluded?

I have voted for the withdrawal agreement three times; the hon. Gentleman has not. That is why there is frustration. However, that is not the primary issue before the House today. The hon. Member for Stoke-on-Trent Central captured the matter last time we debated the subject. I hope that he does not mind my quoting him. He said:

“If we as a House are going to be asked to hand over day after day, we should know what we will be asked to vote on during those days.”—[Official Report, 1 April 2019; Vol. 657, c. 809.]

It is the nature of what the House is being asked to support today that is the issue: the concentration of control in a motion from an individual and the Speaker together; the fact that the scope is potentially so widespread; the fact that it is at odds with the manifestos on which both main parties stood. In essence, the problem is that the motion is an attempt to circumvent some of the internal tension in the Labour party that is best played out in its next conference rather than through a decision of this House. I agree with my hon. Friend the Member for Basildon and Billericay (Mr Baron). We heard from the right hon. and learned Member for Holborn and St Pancras what this is really about: it is to say that the Government cannot control the Order Paper. It is, therefore, a way to get rid of the Government. I ask my colleagues to be mindful of that when they cast their votes.

Einstein is widely credited with saying that the definition of insanity is doing the same thing multiple times but expecting different results. If the Government intend to bring their withdrawal agreement back to Parliament in the form of a Bill, is it not the case that it is only likely to receive any sort of majority in this House on condition of an amendment in support of a public vote? Does the Secretary of State accept, in the words of his own Chancellor, that that is a “perfectly credible proposition”?

As the hon. Gentleman should know, part of the reason we have been having discussions with his Front-Bench colleagues is to look at how the legislation might evolve to take on board the earlier votes by the House. One could make a similar accusation against the Labour party. If we look at its policy on a second referendum, we see people such as Len McCluskey saying that it

“risks tearing our society further apart, as the ignored majority believe their views have been scorned”,

while other Labour members say it is the way forward. There is no consistency among Labour Members, and that is part of their problem.

When I met the Prime Minister in March, I put it to her that a public vote is the only way to get us out of the current deadlock. Does the Secretary of State agree?

It is not only that I do not agree; the hon. Lady’s own Front-Bench colleagues do not agree. She says that a public vote is the only way, but that is not the current policy of her party. Her party’s policy is to say that if its deal were accepted, it would not put it to a public vote. [Interruption.] The hon. Lady asks what I think, but I answered that at the start of my response. I do not agree that a public vote is the way forward; the vote is for Members of this House, who cannot make a decision. The point is that I am not the only one who thinks that a public vote is not the way forward; the hon. Lady’s Front-Bench colleagues think so too, because it is not their current policy.

What about a vote on the Prime Minister’s deal? In a few weeks’ time, the Prime Minister will have asked MPs no fewer than four times whether we agree with her deal. Does the Secretary of State not think it would be fair to ask the public once whether they agree with the deal?

Again, the hon. Gentleman will need to look at the Bill when it comes forward. What we voted for on previous occasions was a meaningful vote. We have been in discussions with Opposition parties and, as referenced in an earlier question, Members across the House, to take on board some of the concerns raised in those debates, and those will be reflected in the legislation brought to the House.

The Secretary of State could point out that the Opposition’s wish will be granted when the European elections take place next Thursday. That will be a genuine vote on what people think in this country. We will need to look at the policies of the party that finishes up with the most votes. I do not think that any Member of this House thinks that my right hon. Friend is anything other than virtuous in all that he does. In our commitment to bring forward the withdrawal agreement Bill, we have listened to the concerns of Members across the House and have reflected that in the draft legislation that is being prepared. It will be for Members to reach a decision on that or one of the two other alternatives—either we risk not leaving at all, which I think would be a huge betrayal of the 17.4 million people who voted to leave, or we leave with no deal, which would create issues for the Union and the economic disruption that would flow.

Many of my constituents tell me that they would not vote in a second referendum because they are angry and frustrated that Parliament has not delivered on the first one. Does the Secretary of State agree that a second referendum would continue the divisiveness and uncertainty, and would almost certainly not settle the issue, because the turnout would be smaller?

I very much agree with my hon. Friend on that. I would urge his constituents to vote, and to vote Conservative, in that election, but he is right to say that any such second referendum would be both divisive and not necessarily decisive. They have perhaps taken their lead from many Members of the House, who seem unwilling to confront the real choice that lies before them and vote, which is why they are seeking to have a second referendum.

The Government’s position is that it is democratic to come back to the House of Commons for the fourth time to try to persuade us to change our minds. They are entitled to try, although it may be unwise. Can the Secretary of State explain to the House, therefore, why it is undemocratic to ask the British people, given what we now know, whether they wish to change their minds or not?

Because we had a decision; we gave the British public that and we have not delivered on it. I would have much more time for the right hon. Gentleman’s position if behind the language of a confirmatory vote he wanted to explore the different ways of leaving: if he was saying, “The public gave a clear instruction to leave, but we want to have a vote between leaving with the Prime Minister’s deal or leaving with no deal.” But his position is to revoke. He does not want to say that he supports revoking, so he wants to hide behind this veneer, façade and impression whereby this can be can done through a second referendum. I urge him to have some candour and say he wants to revoke. Come out and say it. That seems to be the right hon. Gentleman’s position and that is what is he should say.

I want to revoke article 50 and so do the vast majority of my constituents. Does the Secretary of State not see the glaring failure of logic in giving this House four votes but not being prepared to give the population a second vote? That is why people who do want to remain in the EU will be voting for the Scottish National party in the forthcoming European elections in Scotland.

Well now, what is always glaring from SNP Members is their desire to overturn democratic decisions. They did this on the referendum in 2014 and they want to do it on the referendum in 2016. They then want to say to this House that a further referendum is one they will abide by, but we know that if they get the wrong result, it will be three strikes and yet again they will say that they are still not out.

I know my hon. Friend’s constituency very well, as it is where I was born and grew up. He is absolutely right to highlight the importance of this issue in the farming sector. I am happy to give him the commitment that my right hon. Friend the Secretary of State for Environment, Food and Rural Affairs is looking at this issue. My hon. Friend will be aware that this is part of a wider approach, where we can take a much more bespoke approach to our farming needs once we are out of the EU, rather than the catch-all, one-size-fits-all approach in which the common agricultural policy applies.

The Minister will know that food processing is very much related to farming, and it is our biggest manufacturing sector. Has he talked to that sector? First, may I join the Prime Minister in recognising the hon. Gentleman’s service? He said at Prime Minister’s questions yesterday that he was a Eurosceptic when he came into the House; there is still time for him to return to his true beliefs.

As the hon. Gentleman is well aware, I represent one of the key farming constituencies in the country, in the fens. He will also be aware that the majority of farmers voted to leave because they see the opportunities—for example, in respect of things like the three-crop rule, which is restrictive for many in the farming community. Through the Agriculture Bill, we can have a much more bespoke approach. The key issue is to speak to those who actually farm. The overriding message from the National Farmers Union is to back the deal, and farmers themselves want the liberty of being outside the straitjacket of the EU. That is what this Government will deliver.

The hon. Gentleman is right to highlight an under-discussed area of policy. Some Members want only to talk down the opportunities of Brexit, rather than to talk about what we can do with the freedoms that Brexit unlocks. One of those freedoms is in respect of food labelling, which is an area in which the United Kingdom can apply a more bespoke approach and in which there will be opportunities. Indeed, last week I was in Scotland with manufacturers and we discussed just such issues.

There is nothing elusive about the text of the political declaration, which makes it clear that the Government can negotiate the benefits of a customs arrangement alongside an independent trade policy. I have been clear throughout that we have an approach that I think is the best way forward. There are conflicting views in all the parties including, as the hon. Gentleman well knows, on his own Front Bench. We are discussing these issues with the Labour party to seek a way forward on behalf of the House that will allow us to deliver on the referendum result. If he is asking about my personal position, I have always been clear that we made a clear manifesto commitment with regards to the single market and customs union, and we are trying to look at how to deliver on the referendum result. As the shadow Secretary of State would say, those discussions are ongoing.

I guess that might have come close to a suggestion that the Secretary of State does agree with those who are opposing the Prime Minister’s position. But this is, after all, a Secretary of State who voted with those two predecessors against his own Government’s proposal on extending article 50, even after he had recommended it to the House, so I think we deserve some clarity on these issues. The authors of Monday’s letter also said of any agreement that is reached:

“No leader can bind his or her successor…so the deal would likely be…at best temporary…at worse illusory.”

It is not a revelation to this House that I supported leaving in the referendum, that I still support leaving, that I have voted consistently on every occasion to leave, that I have voted against extending article 50 and that I have stood by the manifesto on which I was elected. The question for Labour Members is why they repeatedly—at every opportunity—refuse to stand by their manifesto commitment. Why will they not honour their promises to the electorate? Yes, I do support leaving. I support leaving with a deal, and I have made it clear that if we do not leave with a deal, of the two alternative options I would leave with no deal. My position has been consistent. Why hasn’t theirs?

Nearly 500 people working for Lewisham and Greenwich NHS Trust are from the EU. The Royal College of Nursing tells us that 7,000 EU nurses have left the register since the referendum. If the hon. Member for Huddersfield (Mr Sheerman) gives me a moment, I will answer with some specific numbers on recruitment. As a former Health Minister whose portfolio covered the workforce, I have always taken an interest in this area, so if he gives me a moment to get past the first two words, I will try my best to respond. It is not a widely known fact that, since the referendum, there are 700 more doctors from the EU27 countries working in the NHS and over 5,200 more EU27 nationals working in NHS trusts and clinical commissioning groups.

The hon. Lady is right that we need to do more on nurse recruitment. The Department is doing a huge number of things, including on the apprenticeship levy, looking at the skills mix and professional qualifications and investing up to £20.5 billion extra a year in the NHS, a lot of which is targeted at improvements to the workforce. She is right that we need to look at how to strengthen nurse recruitment, but it is misleading to keep presenting to the House the fiction that, since the referendum, there has been a fall in the number of EU staff working in the NHS, when 700 more doctors are working in it since then.

Some 64% of medical professionals think that the NHS will get worse after Brexit. They have not been fooled by a slogan on the side of a bus. Can the Secretary of State explain why the Government are struggling to convince those who work for the NHS that there will be a Brexit dividend?

I suspect that this constant drumbeat of negativity around it does not help. The fact is that we have committed to a 10-year plan. The hon. Lady should listen to people like Simon Stevens, the former Labour adviser and the chief executive of NHS England. She should look at the 10-year NHS funding commitment that this Government have made, with up to an additional £20.5 billion a year. She should look at the areas of improvement to care and stop talking down our NHS. In terms of Brexit, there are things, if one looks at the October 2017 paper, to protect the NHS, but it is time to stop talking down the NHS and look at the funding commitment this Government have made.

I should declare an interest: I have several family members working in the NHS. As we have heard, there is huge concern about the lack of nurses—particularly specialist nurses—coming from the EU. The NHS used to have a recruitment programme in Portugal, where the training is excellent, particularly in intensive and post-operative care, and there is good care but not enough jobs. The NHS can no longer do that. In addition, medical research teams are in despair because they cannot exchange specialist researchers to further medical science. Can the Secretary of State reassure the medical profession that this is keeping him awake and that he has a response to it?

It is quite remarkable that the hon. Lady makes no mention of the five new medical schools that this Government have committed to, of the record expansion in doctor training that this Government have committed to or of the lifting of tier 2 visas for not only doctors but nurses, so that we can recruit around the globe. The Opposition seem to think that recruitment into the NHS stops at Europe, but we recruit talent for the NHS from around the globe, and we have lifted tier 2 visas to facilitate that. This constant drumbeat of negativity from the hon. Lady does not reflect the reality of this Government’s commitment to our NHS.

My hon. Friend is right to say that we need a strong economy to have a strong NHS. The option set out in the economic analysis that was published by the Treasury in November makes it clear that the Prime Minister’s plan is the one that will deliver the strongest economy and enable us to make that record, 10-year commitment of up to £20.5 billion more a year to our NHS. That is a sign of the Conservative party’s commitment to the NHS, and for the majority of years that the NHS has existed, it has been run by a Conservative Government.

I suggest that the hon. Gentleman take that up with the right hon. Member for Surrey Heath (Michael Gove). How can we trust this Government to protect our public health or our NHS in any trade deal with the United States when they cannot agree within Cabinet? The Environment Secretary says that chlorinated chicken will be banned, but the Secretary of State for International Trade says it will not be. Who speaks for the Government on that issue?

The hon. Lady is right that it is her job to challenge the Government, and unfortunately for Government Members she usually does that more effectively than we would like her to. On this issue, however, I disagree with her. Labour policy is that it wants a say on EU trade policy, even though EU treaties do not allow that. For many years, Conservative Members have been told by the Labour party that we cannot go into things such as the Transatlantic Trade and Investment Partnership because that will be a threat to our NHS—that is what Labour Members have said repeatedly. Now they say that they want to pass control of our independent trade policy to the EU, but that that will not be a threat to the NHS. Once again, Labour Members say one thing when it suits them, and another thing today. There is no consistency in their trade policy.

My right hon. Friend will know that the Bundesnachrichtendienst has already made it absolutely clear that the United Kingdom is one of the biggest intelligence services in the world and a member of Five Eyes and that Europe is dependent on the United Kingdom for intelligence. We also wish to co-operate with them. Does that not make complete nonsense of what some Opposition Members say—that if we left the EU, without a deal or otherwise, the EU would not continue to co-operate with us for its own benefit?

My hon. Friend is absolutely right that there is a shared interest between the UK and the European Union in close collaboration on security. He is right that the UK is the only European member of the Five Eyes intelligence network and that we are the only EU country that contributes both the NATO 2% and the overseas aid 0.7% commitments. It is in both sides’ interests to work closely on our shared challenges, because many of those challenges lie beyond Europe.

Since our last questions session, over the past six weeks the Government and the Opposition have held constructive meetings. The Prime Minister met the Leader of the Opposition earlier this week, and discussions continue with the aim of reaching a compromise that could command a majority in the House. The Prime Minister has also said that the Government will introduce the withdrawal agreement Bill in the first week after the recess, which will allow more time for the talks to continue, but with a view to ratifying the withdrawal agreement before the summer recess.

I wonder if the excellent Secretary of State has had an opportunity to watch “Brexit: Behind Closed Doors”. The BBC has hidden it away on BBC Four, but it is quite a revealing programme. In it, the lead negotiator for our exit from the European Union, Olly Robbins—who I think is in Brussels this week—says that because he has done such a rotten deal he cannot come back to the United Kingdom and is applying for Belgian citizenship. Is that appropriate, Secretary of State?

In February, the Secretary of State told the House:

“the withdrawal agreement Bill is a significant piece of legislation and we will need to get it through the House, but the key issue is getting the deal through, because once we have done that, we will have the basis for the necessary consensus in the House to approach that legislation.”—[Official Report, 28 February 2019; Vol. 655, c. 505.]

That makes sense—deal first, implement second—so will the Secretary of State tell us whether the Government are going to hold a fourth meaningful vote before the withdrawal agreement Bill is introduced, or whether the House will be asked to do the opposite of what he advocated in February and implement a deal that has not been approved?

I do not want to stray into territory that is rightly much more a matter for the Chair, but I think I am correct in saying, Mr Speaker, that you have been very clear in your directions regarding meaningful votes and whether they would be considered. As for the deal, we have talked about whether an agreement could be reached with the Opposition. As the right hon. and learned Gentleman knows, those talks are ongoing, including the discussion between the Prime Minister and the Leader of the Opposition this week. We have made it clear, and the Prime Minister has made it clear, that we will bring the withdrawal agreement legislation to the House in the week after the recess, and the House will have an opportunity to vote at that point.

I should have thought it was patently obvious that if the Prime Minister’s deal is put to the House for the fourth time—if that is allowed—it will fail, just as it has failed three times already.

Let me make it clear that Labour opposes the idea of passing the withdrawal agreement Bill without an agreed deal. That would put the cart before the horse, and Labour will therefore vote against the Bill’s Second Reading. How on earth does the Secretary of State think that a Bill to implement a deal that is not before the House can be passed in two weeks’ time—or is this about keeping the Prime Minister in office for another week and giving her a lifeline for today’s meeting of the 1922 Committee?

The talks with the Opposition Front Bench team have been going on for over six weeks, and the House has now looked at the meaningful vote on three occasions and made its view clear. The question therefore arises, as came through in amendments from a number of Members of this House—such as the Snell-Nandy amendment—whether there are changes to the withdrawal agreement Bill that would enable it to command wider support. It is on that basis that not only have we had those discussions but indeed the right hon. and learned Gentleman has welcomed them. When the House sees that legislation, it will be for it to decide whether it commands a majority of the House. The right hon. and learned Gentleman’s personal position might be that what is in that text is irrelevant, because he personally wants to have a second referendum, but that is not the basis on which the discussions have been held; that may be his personal position, but it is not, as I understand it, the official position of the Leader of the Opposition. It will be for the House to make a decision, and the Prime Minister has made it clear that there will be an opportunity for it to do that in the week after the recess.

The Secretary of State looks physically fit and is in good shape and I expect he goes to the gym a lot. If he decided to leave his gym and the gym said to him, “You’ve got to give us two years’ notice; when you leave, you have to pay four years’ worth of membership fees up front; and after you’ve left, we’re still going to control your fitness programme,” would he regard that as a good deal or a bad deal?

The point is that we as a House know that we need to confront not just the issue of the legislation in the withdrawal agreement but the consequences that would flow from it. When I gave evidence to the Lords Select Committee yesterday, in the usual joyful comments to which my social media feeds are accustomed, people seemed surprised that if we do not leave the EU with a deal, the House will need to face a choice as to whether it then leaves without a deal or whether Members of this House, as they have done with no deal before, seek to prevent that and seek to revoke such an outcome. I do not think that that is a revelation, although it seemed to be greeted as one; I think it is simply a statement of fact and logic, and Members of the House need to confront that when they consider the withdrawal agreement Bill that comes before the House after the recess.

The Secretary of State said earlier that a no-deal scenario would be harmful to the economy and threaten the integrity of the United Kingdom, but he then also said that he would support a no-deal scenario rather than remaining in the European Union. So is he saying that threatening the integrity of the Union of the United Kingdom is actually a price worth paying for a hard Tory Brexit?

What I am saying is that there will be consequences to both options. Revoke would involve a betrayal of democracy, going back on the commitments that this House has given and having a divisive, but not decisive, second referendum that could end up with the same result as before. Businesses are experiencing uncertainty, including in Dundee, where I was on Thursday. It has the fastest growing chamber of commerce in the United Kingdom, and people there want to see a deal and to see this country move forward. That is the way forward, but if we do not support a deal, a no-deal would have consequences. However, the much more severe consequences would be those for our democracy and for our international reputation as a country if we were to undermine such a major democratic decision.

I can absolutely confirm to my hon. Friend that planning is continuing for no deal and that funding is allocated. It is important for the Government to use the time that we have between now and 31 October to ensure that we are prepared, should that eventuality arise, but it is in our interests to secure a deal so that that becomes unnecessary.

I am sure that the whole Government Front Bench team will be aware of the bad news today from Thomas Cook, whose travel business looks unsustainable as a result of the Brexit process. There is no such thing as a good Brexit, and we can only imagine the economic disaster of a madcap no-deal Brexit. Before the European elections next week, will the Secretary of State confirm that he will respect the views of this House and take a no-deal Brexit off the table completely?

Any news regarding an individual company is always concerning, in particular because our minds turn to the staff and their families who are dealing with the situation. This is an area in which the parties traditionally come together and work together to try to resolve the issue. However, we should not take these things out of context. Only this week, we had the lowest unemployment since 1974, and that is an indication of our economic strength. When bad news is always blamed on Brexit, as some Opposition Members seem to want to do, it is always worth remembering that we have not yet left.

Will the Secretary of State assure me that he has read the major piece of research led by King’s College London and Sheffield University, alongside universities across Europe, into the impact on communities of leaving the EU on any basis? Is he as dreadfully worried as I am that many of the hardest hit will be those towns and cities that voted to leave? On the basis of these figures, many people are predicting a 20% cut in GDP, which would turn those areas into investment and employment wastelands.

The hon. Gentleman seems to be saying that the people in those communities that voted to leave should not be trusted with their vote, but that is not what he says at a general election when those same communities return Labour MPs. He does not say, when those people look at the economic policy of the Leader of the Opposition, that they are too stupid to be trusted with a vote, yet when it comes to the biggest vote in our country’s history, he seems to be saying that their vote should not be respected.

Earlier this month, the House unanimously declared a climate change emergency. Does the Minister agree that when it comes to tackling the catastrophe that is climate change—or, for that matter, challenging the overweening arrogance of the tech giants or protecting our citizens—we are stronger and have more influence as a consequence of international agreements, and that those agreements therefore enhance rather than diminish our sovereignty?

The Minister knows that the Government’s myopic obsession with ending freedom of movement is causing a recruitment crisis in the health and social care sector—indeed, the King’s Fund said recently that it was becoming a national emergency. Why are his Government determined to drag that sector into that national emergency?

The only myopic obsession is the Scottish National party’s obsession with an independence referendum. The hon. Gentleman says it is the Government’s obsession, but it is the Migration Advisory Council that said this is a UK-wide issue, which needs to be approached on a UK-wide basis. I remind the House of the answer I gave earlier: there are now 700 more doctors from EU27 countries working in the NHS than there were at the time of the referendum. The numbers are going up, yet the hon. Gentleman constantly talks our country down.

So no real plans then. Participation in the EU elections will be the death knell for the British public’s waning faith in our democracy. The fact that this week councils were advised by the Chancellor of the Duchy of Lancaster and Minister for the Cabinet Office, the right hon. Member for Aylesbury (Mr Lidington) to prepare for EU elections is yet another example of the dire consequences of the Prime Minister and the Government’s failure to secure a deal that commands the majority of the House. Is that not true?

With respect to the hon. Lady, that is a rather confused question, given that she—as I understand it—voted against the withdrawal agreement, which gave us a legal right to leave on 22 May. It is odd to vote against the means of departure and then criticise the absence of a departure.

The Conservative party national convention—the meeting of all local party chairmen—made it clear in February that were Brexit to be delayed so that we took part in the European elections, it would be a betrayal of the referendum result and inflict untold damage on the reputation of the Conservative party. Is that not right and does the Secretary of State agree?

I agree with my hon. Friend that to have European parliamentary elections three years after the country voted to leave would be damaging for our politics as a whole, but he will also have seen the vote in the House last night, which sought to take the option of leaving without a deal off the table. He will also be aware that the House has today refused to back any of the options for a deal that have been put to it.

Whether we participate or not depends on the progress of the talks currently taking place between the Prime Minister and my right hon. Friend the Leader of the Opposition. If those talks do not succeed, the Government have committed to giving the House the opportunity to hold a series of indicative votes. Can the Secretary of State clarify whether the propositions before the House will be drafted and presented solely by the Government, or will Members on that occasion have an opportunity to submit their own motions for discussion and vote?

The right hon. Gentleman, as Chair of the Select Committee, is usually an expert on these matters, but I must, with respect, take issue with the statement within his question. It is not subject to the discussions with the Leader of the Opposition. The vote last Friday in which the right hon. Gentleman and his colleagues opposed the withdrawal agreement means that it is no longer the sovereign right of this Parliament whether we leave: it will be a matter to be agreed at the European Council, because the right is affixed to the withdrawal agreement, not to whatever the House decides in votes in the coming days.

Is it not simply the case that for as long as we are members of the European Union we have rights and responsibilities that go with that, and participating in democratic institutions such as the European Parliament is crucial? Can the Secretary of State confirm exactly what process is needed to trigger the elections? Will there be a debate on a statutory instrument, in the House or in Committee, or is it simply a stroke of the pen by the Chancellor of the Duchy of Lancaster?

The hon. Gentleman is right in terms of the legal position. If we are a member of the European Union, under treaty law we will be required to have European parliamentary elections. Again, there has been some confusion in the House previously, with ideas such as rolling over the existing Members of the European Parliament or having them on a ratio similar to the composition of the House. If we were to still be a member of the European Union, which is not the Government’s intention, we would need to have European parliamentary elections.

As if the fact that the NHS is down by 8,000 nurses since December 2016 was not bad enough, 47% of them in a recent survey cited Brexit as the reason. Reports from Ealing show a similar exodus from the social care sector—distinctly unglamorous but important given the demographic time bomb coming down the track and the Government’s obsession with high-skilled migration. What is the Secretary of State doing to head off a crisis in that Cinderella sector?

I think the hon. Lady mischaracterises the position. The number of staff recorded as EU27 nationals working in the NHS trusts and clinical commissioning groups in England increased by more than 5,200 between June 2016 and December 2018—there has actually been an increase in EU nationals. She also omits to mention the record investment—£20.5 billion a year extra—that this Government are making in the NHS, the NHS apprenticeships we are bringing through, and the change in tier 2 visas for talent around the world in order to attract more doctors and nurses to the NHS.

In my former job, before I came to this place, I was an emergency planner for the NHS locally in Bristol. The NHS has had to put in contingency plans and major incident plans to cope with a no-deal scenario and the future. What compensation will the Government give local NHS bodies for the time and money they have spent and wasted on incident planning that probably will not come into effect because of the Government’s incompetence?

I know from my time as a Health Minister that the hon. Lady always asks very pertinent questions in respect of health matters. She will be well aware of the statement issued by the Royal College of Paediatrics and Child Health, which said how well prepared the NHS was. It has been our priority to ensure that we maintain the supply of medicines and to ensure that the NHS is a priority in our contingency planning. That is the responsible thing for a Government to do.

The United Kingdom has a tradition of exceeding EU standards. We do not need to follow EU rules to continue to lead the way. An example of that is that UK maternity entitlements are nearly three times greater than the minimum EU standard.

As the right hon. and learned Member for Holborn and St Pancras (Keir Starmer) knows, we had discussions yesterday and there will be further discussions today. I am sure that workers’ rights will be among a range of issues that we will discuss. The hon. Gentleman will know that the Prime Minister has already said that she will bring forward a package of measures to strengthen enforcement of workers’ rights, and that is in part following discussions that we have had with a number of Opposition Members.

The Secretary of State talks about the Government being committed to exceeding EU standards, but practice does not seem to match his words. His Conservative colleagues in the European Parliament voted against the amendment to the posting of workers directive, which strengthens workers’ rights and addresses many of the concerns expressed about freedom of movement during the referendum. He will know that our obligation to transpose it into domestic law continues as long we are EU members and during the transitional period. When are the Government going to do that?

There is a real inconsistency here. Night after night we are told that we should trust the votes of the House of Commons. The Prime Minister has made a commitment not to lower standards below the current levels for workers’ rights and the environment, and our proposals on immigration go further than the commitments found in standard free trade agreements. It is odd that Opposition Members have so little faith in this House to protect the rights that workers need.

The Prime Minister agreed the terms of a short extension at the March European Council. Were the House to have approved the withdrawal agreement by 29 March, we would have had an extension until 22 May. Given that the hon. Gentleman and his colleagues voted against that, he will be aware that we do not have that right, and the current right will be terminated on 12 April.

We are moving inevitably towards a situation in which we need an extension in order to have a confirmatory referendum. If a trade union negotiated an exit from a deal, it would go back to its members and ask them to confirm that that was still what they wanted, and to confirm the terms. Is that not a logical, sensible and inevitable outcome of this process?

I would have thought it was logical for the hon. Gentleman to follow his manifesto, which said that he would respect the referendum result. Going back to square one and asking the question again is not consistent with the manifesto on which the hon. Gentleman stood at the last election.

21. Let us see if I can get an answer from the Secretary of State. A recent poll highlighted that six out of 10 people favour a people’s vote, and an extension is required for one to take place. I do not know how many times the Prime Minister has said there will not be a people’s vote, but should the Government not face reality and accept that there will be one and that they might as well start planning for it now?

I do not know which selective poll the right hon. Gentleman is quoting from, but in our democracy we address these issues through the ballot box. In 2016 we had in essence the ultimate poll and 17.4 million people cast their vote to leave. The key message we get in our constituencies and very clearly from the business community—I do not need a poll for this—is that people do not want this process to drag on further. They want it to come to a resolution, and they want the House, instead of being against everything, to come to a decision. It is time we moved on and got this delivered.

Last night, the House voted to prevent a disastrous no-deal Brexit and to exert greater control over the process of extending article 50. The Secretary of State’s views on an extension are well known, but will he confirm that when the European Union (Withdrawal) (No. 5) Bill returns from the other place, he and the Government will comply with the spirit of it and dutifully seek a further extension of article 50 beyond 12 April?

I am very happy to confirm that, as set out in the “Ministerial Code”, Ministers will abide by the law. If the law of the land dictates a certain course of action, Ministers will, under the code, follow the law. The hon. Gentleman gets slightly ahead of himself, because the Bill passed Third Reading with a majority of only one last night, and it was passed in such haste that many of my colleagues had as little as two minutes to speak on Second Reading. I pointed out to the House flaws in the Bill, which I am sure their lordships will wish to explore. We will need to see what consideration takes place in the other House before any further deliberations are necessary in this place.

The House will have noted—I think with disappointment—the Secretary of State’s attempts to undermine the clear will expressed last night. The Opposition have no doubt that the Lords will discharge their duties quickly and efficiently in the circumstances. Given the clear will of the House as expressed in the Bill’s passage last night, I ask him to set out his view at this stage about what the Government believe the role of this place will be in the event that the European Council proposes a date different from that set out in a motion approved by the House, or if the Council agreed to the proposed date but attached conditions.

That is an odd response, if I may say so. The hon. Gentleman started by saying he was disappointed by my answer, in which I said I will follow the law and the ministerial code—I thought the Opposition would have expected that. He then said that he had “no doubt” that the Lords will pass the Bill, which was carried in the Commons by just one vote. That is pretty condescending to the other place. By having no doubt that their lordships will simply approve the Bill, he takes for granted the scrutiny process in the other place. Given the many constitutional experts there are in the other place, I would have thought that their lordships would want to scrutinise this Bill, which was passed in haste with its constitutional flaws.

Is the Secretary of State aware of the latest Reuters Brexit city tracker index, which revealed that no less than 7.6 million square feet of new leases were signed in the City of London last year, which is a record? The market is currently within 5% of its record high. Fewer than 2,000, or 0.5%, of City jobs have either relocated or been substituted elsewhere on the continent. When is this Armageddon because of Brexit going to happen?

As a former City Minister, I take a close interest in these issues. My hon. Friend is absolutely right to draw the House’s attention to some of the developments we have seen in recent months in the City. The City has opportunities in growth areas of finance. Green finance is a key opportunity, for example, and FinTech is another. There are very good opportunities for the City in a post-Brexit world.

There seems to be some confusion about customs unions. Can my right hon. Friend the Secretary of State confirm that a customs union would not cover how we regulate our financial services, how we fish, how we farm or freedom of movement? It should be perfectly possible to discuss a customs union without using any F-words.

My hon. Friend is absolutely right. There is one tweak around fishing and fish, but other than that I absolutely agree with her. I remind the House that financial services alone contribute, from memory, around £71 billion in tax to the UK economy. With an economy that is 80% services, there is an opportunity post Brexit for us to take a more bespoke approach that will enable us to maximise the opportunities on offer.

Since I last updated the House, my hon. Friend the Member for Daventry (Chris Heaton-Harris) has left the Government. I take this opportunity to pay tribute to his outstanding service as a Minister. He will be greatly missed in the Department and by his colleagues, but I know he will continue to serve his constituents in Daventry in an exemplary way.

Since our last departmental questions, we have not only had a large number of debates with the right hon. and learned Member for Holborn and St Pancras (Keir Starmer), but votes, and the House has not yet been able to find something that it is for, as opposed to lots of things that it is against. That is why my right hon. Friend the Prime Minister set out on Tuesday that this division—this lack of conclusion—cannot continue and drag on. We have reached out to the Leader of the Opposition to see whether we can agree on a plan to leave the European Union with a deal. Those discussions will continue later today.

The public know that the withdrawal agreement is a long way from the Brexit that was promised. Does the Secretary of State agree that the public have been badly let down and that whatever agreement is drawn up by this Parliament should now be subject to a confirmatory public vote—on a real rather than a fantasy Brexit deal?

The hon. Gentleman seems to confuse the winding-down arrangements—the withdrawal agreement—with a future deal. The EU has been clear: first, that any deal reached will need to include the withdrawal agreement; and secondly, that that withdrawal agreement is not open to renegotiation. Therefore, any deal to move forward in an orderly fashion needs to come with a withdrawal agreement. That is why it is so remarkable that the hon. Gentleman voted against the withdrawal agreement—whatever the deal to leave the EU, it will require a withdrawal agreement. The only conclusion is that perhaps he does not want to honour his own manifesto and perhaps he does not want to leave at all.

What the Prime Minister was referring to, which was played out in the debate in the House yesterday, was that when the House of Commons passes a law—subject to the other place, that is the position of the vote last night—then in law, bound by the ministerial code, Ministers will need to abide by it. At the same time, the Prime Minister has always been clear that the decision by this House not to approve the withdrawal agreement means that any extension will need to be agreed by the EU Council 28, which includes the United Kingdom, but it can be opposed by any member of the European Union. It is not solely within the control of this House whether we leave with or without a deal; it is also now subject to the decision of the EU 27.

When we do get a question and answer, it gets interesting. That is a rowing back on what the Prime Minister said. When she said that unless this House agreed to it no deal would not happen, that was not in the context of the Bill last night—that Bill had not even been drafted. She said it as a general proposition in the debate last week. I hope that the Secretary of State is not rowing back, and I would like him to confirm that he is not rowing back. Otherwise, we have elicited something here of some importance.

May I also go on to ask the Secretary of State whether he now regrets voting against an extension of article 50 in this House on 14 March—that was an extension beyond 29 March? Does he now regret voting against the Cooper-Letwin Bill last night? Had the House followed his vote, does he appreciate that it is highly likely that we would be in a no-deal situation right now?

First, we have the oddity of the right hon. and learned Gentleman accusing the ministerial team of not answering the question, then pointing out that indeed we have answered it in an interesting way. Putting that to one side and going to the substance of his question, as I pointed out to the House, one of the defects of the legislation passed last night is the potential for it to increase the risk of an accidental no deal, where the EU Council decides to offer a different extension from the one agreed by this House. Under the terms of that legislation that would have to come back to this House for approval the following day, by which time the EU Council would have concluded. I do not think that was the intention of the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper), but it is a possible outcome. It is subject to their lordships deciding whether they want to correct what I regard as a defect, although the right hon. and learned Gentleman’s shadow ministerial colleague says that, no doubt, their lordships will just nod it all through without scrutiny and without addressing that defect.

Regarding the right hon. and learned Gentleman’s second point, I was alluding to a statement of the law. I do not differ at all from the Prime Minister, who has always been clear that Ministers abide by the ministerial code, and I am sure that he would expect no less.

Thirdly, on the extension, we have addressed this issue in previous debates because the three amendments had all been defeated by the time we got on to the fourth vote. A further commitment had been given to an amendable motion for the following week, which was addressed. But the bottom line is that I want to respect the referendum result. I think asking people to vote for Members of the European Parliament three years after they voted to leave the EU is damaging to trust in our democracy. The question for Opposition Members is: why do they keep voting against everything when their own manifesto said they wanted to respect the result?

T2. The Prime Minister has confirmed that the future declaration is not legally binding, so what assurances can the Government give us on trade tariffs, rights at work, food standards and environmental protections that will be binding on whoever ends up negotiating our permanent deal with the EU?

As the hon. Lady knows, there will be ample opportunity for the House to legislate during the passage of the withdrawal agreement Bill. As she also knows, there is legal wiring—for example, through article 174, which deals with best endeavours and good faith obligations under the withdrawal agreement, and how they connect. If it is one of the matters the House looks at in the future, it will be able to choose to put into legislation negotiating objectives. The point is that the hon. Lady has opposed the withdrawal agreement that the EU says is necessary for any deal, and we cannot get on to the future relationship without a withdrawal agreement.

My right hon. Friend, as always, is short and to the point. He correctly identifies the risk of rule taking. We talked earlier about financial services and the tax take from that sector alone. The UK taxpayer, who underwrites the liabilities of a sector such as financial services, will have concerns if the rules are being set in countries in Europe, rather than in this Parliament.

T5. When in 2017 the former Brexit Minister, the hon. Member for Wycombe (Mr Baker), claimed that so many DExEU staff were on loan from elsewhere in the civil service because the nature of the Department was temporary, I bet he did not foresee his own departure, along with five other Ministers, the latest one being the no-deal Minister, the hon. Member for Daventry (Chris Heaton-Harris), who says his work is done now. When do the Government envisage the job of exiting the European Union being complete, enabling this young Ministry, which has experienced so much churn, to be wound up?

As the Prime Minister has already informed the House, the Department for Exiting the European Union will lead during the next phase of the negations. As the hon. Lady is well aware, we need to get on to those negotiations in order that the Department can undertake them. That is what businesses up and down the country want. They want this uncertainty to be brought to a close and they want us to get on into the implementation period for the certainty that that will bring. It is also what EU citizens living in this country and UK citizens in Europe want to see.

My hon. Friend is right that my Department will lead on the future trade agreement—the future economic partnership with the EU—but she will also be aware that my right hon. Friend the Secretary of State for International Trade will lead on our trade deals with the rest of the world, and he and I speak regularly. In respect of the lessons from phase 1, as in the corporate world, as in Government: there are always lessons. There are things that have gone well in phase 1 and things on which we can improve. It was a major new endeavour for the Government to undertake and we have had a number of discussions in the Department to ensure we take those lessons on board.

North-east manufacturers have achieved great success as part of integrated, just-in-time pan-European supply chains, which mean that, as one manufacturer puts it, their stock room is somebody else’s delivery van. These manufacturers are now having to stockpile as a consequence of this Brexit chaos, and that has implications for their cash flow and finances. What help is the Minister looking to provide for them and what hope of future economic integration can he offer them in the case of there being a deal without a customs union?

I have already addressed this point. Three years after the country voted by record numbers to leave, there is a strong desire to ensure that we get on with it and do so. The Prime Minister has compromised and reached out. We are endeavouring to deliver on the will of the British people as expressed in that referendum vote, and on the manifesto commitments of both main parties.

I think what has gone well in this first phase is that we have an agreement with the EU that gives certainty to EU citizens, that respects our legal obligations and that will ensure that there is no hard border on the border of Northern Ireland. In part, one of the achievements of both parties, but particularly of the Labour party, was the Good Friday agreement. It is why those Members in Northern Ireland get so agitated with Members on the hon. Lady’s Benches over their failure on the withdrawal process. We have a deal; it is on the table; and it is the only deal that the EU is willing to offer.

The clear and solemn commitment in the Conservative party manifesto, on which the Secretary of State and I were elected, was:

“As we leave the European Union, we will no longer be members of the single market or customs union.”

Will he ensure that the Prime Minister does not renege on that commitment at the European Council next week?

My hon. Friend correctly identifies that commitment in our manifesto. He will also be aware that the manifesto gives a commitment to have a deep and special partnership with the EU. It is that balance that we are trying to seek. That is why the Prime Minister brought forward a deal that delivered on the referendum result—on things such as control of our borders, a skilled immigration system, control of our fisheries, control of our agriculture, and putting an end to sending vast sums of money to the EU—but also respected the fact that 48% of the population did not vote for leave. It is that compromise that has not been pure enough for some Members on the Government Benches to support it.

We will oppose this Bill. It is being passed in haste, and the fact that we have a time limit of two minutes for a number of speeches this evening is an indication of the fact that the Bill is being passed in haste. It is constitutionally irregular and, frankly, it fails to understand the decision-making process by which any discussion of an extension or agreement of an extension at the European Council will be reached. I will come to that in the limited time I have in which to speak.

It is not just me who has concerns about the Bill on behalf of the Government. Objections to the Bill have been raised by the Chair of the European Scrutiny Committee, my hon. Friend the Member for Stone (Sir William Cash); the Chair of the Procedure Committee, my hon. Friend the Member for Broxbourne (Mr Walker); and the Chair of the Select Committee on Public Administration and Constitutional Affairs, my hon. Friend the Member for Harwich and North Essex (Sir Bernard Jenkin). All have raised concerns about the Bill—particularly the fact that it is being rushed through in such short order—and indeed about the precedent it sets for this and successive Governments.

The Bill also calls into question the royal prerogative. It has been a long-standing practice that Heads of Government can enter into international agreements without preconditions set by the House that would constrain their ability to negotiate in the national interest. Let me give an example of how such constraints could have adverse effects and, in particular, given that the House has voted against no deal, how the Bill could increase the risk of an accidental no-deal exit. On Wednesday 10 April the European Council could propose an extension of an alternative length, yet under the Bill the Prime Minister would then have to return on Thursday 11 April to put that proposal to the House. However, by 11 April the European Council will have concluded and the leaders will have returned to their member states. We would then need to confirm the UK’s agreement to the European Council’s decision and get its approval for that by 11 pm on 12 April.

At the heart of this is the fact that last Friday the House voted against the withdrawal agreement, which was the only legal right the House had to an extension to 22 May, which, as I understand it, Mr Speaker, was at the heart of your decision to grant that vote, because, as the Attorney General set out, that was an additional right bestowed on the House as a result of the previous European Council. We have no automatic right to a legal extension. That right was forgone as a result of the House’s decision last Friday. Yet the Bill would put the House in the position of having to agree after the European Council has concluded and the leaders have returned to their member states.

It is not usually my practice to quote from The Guardian, but I suspect that it is the right hon. Gentleman’s newspaper of choice. We all remember its front-page headline, “No. No. No. No. No. No. No. No”—it was quoted by many EU leaders—because this House failed to agree on the various options.

The Prime Minister has sought to compromise. Indeed, part of the challenge she has had with her deal is the fact that people on both wings of the debate feel that it is too much of a compromise. She has sought to compromise in the national interest, reflecting the fact, as Members have said, that 48% of the public did not vote to leave. That is why she reached out to the Leader of the Opposition, but for several weeks he refused to meet her. Indeed, he even refused to meet just because the hon. Member for Streatham (Chuka Umunna) happened to be in the room, which was apparently beyond the pale. I am pleased that today I was able to join the Prime Minister at a meeting with the Leader of the Opposition.

The fact that the House has consistently voted for what it is against, rather than what it is for, and indeed its decision on Friday not to approve the withdrawal agreement, is the very essence of running down the clock, because it waived our right to an extension to 22 May and therefore allowed an extension only to 12 April. It is very odd for the right hon. Member for Carshalton and Wallington (Tom Brake), having voted for that reduction in time, now to complain about it.

We are passing the Bill in haste and do not have adequate time to debate it in the manner that I would like us to—there is only one minute left on the clock. There are problems with the speed of its passage, the constitutional principle of it and the way it will interact with any decision reached by the Council that differs from the earlier decision taken by the House. I hope that the constitutional experts in the other place will address some of the Bill’s flaws. It is because of those defects that the Government will oppose the Bill, and I urge Members to oppose this defective Bill.

On a point of order, Mr Speaker. This is now the second time the House has considered a wide variety of options for a way forward. It has once again failed to find a clear majority for any of the options, yet the result of the House’s decision on Friday not to endorse the withdrawal agreement means that the default legal position is that the UK will leave the EU in just 11 days’ time. To secure any further extension, the Government will have to put forward a credible proposition to the EU as to what we will do with that extra time. This House has continuously rejected leaving without a deal, just as it has rejected not leaving at all. Therefore, the only option is to find a way through that allows the UK to leave with a deal. The Government continue to believe that the best course of action is to do so as soon as possible. If the House were to agree a deal this week, it may still be possible to avoid holding European parliamentary elections. Cabinet will meet in the morning to consider the results of tonight’s vote and how we should proceed.

I will obviously take note of your direction, Mr Speaker: the right hon. and learned Member for Holborn and St Pancras (Keir Starmer) and I are not particularly short of opportunities to debate these issues at the Dispatch Box. I commend the hon. Member for Huddersfield (Mr Sheerman) on his honesty. He set out clearly that he wishes to stay in the European Union. It is the case, however, that the Government are committed to ensuring that we deliver on the referendum result.

The right hon. Member for North Norfolk (Norman Lamb) is no longer in his place but he spoke about respecting all views, which has very much been the tenor of the debate today. I take issue with one point that he made: when he criticised the Prime Minister for not compromising. Part of the criticism she has received from both wings of the debate is that her deal is seen as too much of a compromise, both for those who want purity on one aspect—a purity of Brexit beyond what 17.4 million people voted for—and those who do not want to leave at all. That is the pincer movement that has bedevilled the agreement she has reached.

Does the right hon. Gentleman accept that there is a difference between those who wanted a pure Brexit and those who did not want us to leave in any event? I suggest to him that that is not any compromise that the Prime Minister has made. She has not compromised. The point is that she has not reached out to those of us who had accepted the result of the referendum and did want to form a way of delivering on it with the least amount of damage.

I am sorry to intervene on the Secretary of State. I was going to raise this point in my speech with the hope that he would respond to it, but he is now speaking before me. Will he illuminate the House on the letter that has gone to the Prime Minister from 170 of our colleagues? Did he sign it? What is in it? Is it true, as the papers are being briefed, that it keeps no deal on the table, despite the resolution of this House?

No. I am conscious that I have only five minutes, and I wish to press on.

It is worth reminding the House that it was only last Friday that Members—[Interruption.] I do not know why the right hon. Member for Broxtowe (Anna Soubry) is chuntering. I have been given a steer from the Chair to give time for other Members and she wants to come in a second time. I have taken her intervention.

On Friday, the House voted against the withdrawal agreement. It is worth pointing out that a number of the motions before the House require the withdrawal agreement as part of the package, including motions (C) and (D). Likewise, the motions on a public vote are proposals that include the same withdrawal agreement that the Members who signed them opposed. The fourth motion before the House includes a vast number of signatories who stood on manifestos contrary to what they have signed. So, again, that points to the contradictions inherent in the approach that many have taken throughout this debate. People are taking positions one week and then signing motions that are contrary to them the following week.

I have used four minutes of my five, so I will press on very quickly. Many of these points were raised in the debate last Wednesday, including on the permanent customs union. The concern relates to giving control of our trade policy, in particular our trade defences, to EU countries over which we would have no say. It is questionable why we would want to give MEPs in other countries control over our trade defences, whether in ceramics or steel, or on many of the issues debated in this House. My right hon. Friend the Member for Chelsea and Fulham (Greg Hands) has quite often drawn the attention of the House—I am pleased to see him in his place—to some of the issues I do not have time to expand on today. Likewise, the right hon. Member for East Antrim (Sammy Wilson) reminded the House, when he intervened on the Father of the House, that regulatory alignments often drive friction at the border—much more so than the tariffs on which the debate tends to centre.

Motion (D) was debated last Wednesday, so we do not need to rehearse the arguments about financial contributions, the acceptance of freedom of movement or alignment with EU rules—all the issues that cause concern. Indeed, the Governor of the Bank of England, no ardent Brexiteer he, talked about the damage and how highly undesirable this option is, because of the rule-taking element strangulating a part of our economy that paid £72 billion of tax in 2016-17. We should be cautious about the rule-taking implications. In his remarks, my hon. Friend the Member for Grantham and Stamford (Nick Boles) talked about an extension to 22 May. I simply remind my very good friend that—I am sure he is aware of this point—the conclusions from the Council do not give an automatic right to an extension to 22 May, given that we have passed the 29 March deadline.

We debated motion (E) last week. It was defeated by 27 votes, so the arguments were rehearsed. Likewise, we debated motion (D), which was defeated by 109 votes. What we have is a rehashing of a number of arguments that did not curry favour last week. Again, many of the issues remain. Motion (G) does not specify how long the public inquiry should be. On average, they last for three years. Are we going to subject our businesses to a further three years of uncertainty, followed by a further vote?

What we need to do is give certainty to our business community and to safeguard the rights of EU citizens. That is what the House rejected by rejecting the deal. What we see today is a number of motions signed by people who, just last Friday, rejected the withdrawal agreement. They stood on manifestos that contradict the motion before the House and, in essence, are asking colleagues across the House to vote for a package that includes a part that they themselves rejected just a matter of days ago.

The House has today considered a wide variety of options as a way forward, and it demonstrates that there are no easy options; there is no simple way forward. The deal that the Government have negotiated is a compromise, both with the EU and with Members across the House. That is the nature of complex negotiations. The results of the process this House has gone through today strengthen our view that the deal the Government have negotiated is the best option. [Interruption.] Furthermore—[Interruption.]

Furthermore, although this was not a significant feature of today’s debate, any deal must include a withdrawal agreement. It is the Government’s firm wish to get the withdrawal agreement approved by this House, and I urge all Members to agree, no matter their view on what the future relationship should be, that if they believe in delivering on the referendum result by leaving the EU with a deal, it is necessary to back the withdrawal agreement. If we do not do that, there are no guarantees about where this process will end. It is for that reason that I call on all Members from across the House in the national interest to back the Prime Minister’s deal.

On a point of order, Mr Speaker. This is a very serious moment for all of us. We have to reflect that this House of Commons has tried to find a way through the Brexit crisis over the last few months, and we have failed. We need to reflect on the fact, when the Government talk about bringing their deal back, that they got 202 and then 242 votes. That deal should be dead. The people’s vote got 268 votes tonight. I know we did not win, but we got more votes for a people’s vote than the Government did for their proposition. It is becoming increasingly clear that the House cannot find a way forward. The Government and the Prime Minister have failed to provide leadership. The only thing we should now be doing is going back to the people of the United Kingdom in a general election to end this impasse.
