My hon. Friend will be aware that the Prime Minister has responsibility for the ministerial code. Indeed, when ministerial collective responsibility is explicitly set aside, it is the Prime Minister who makes that decision. He is clearly doing it, as the House will understand, in the context of coalition government. As we know, that can give rise to occasions where there is not a collective view, and where by extension it is therefore not possible for a collective view to be the subject of collective ministerial responsibility. Let me turn to the substance of the issues.

No; I will give way in a moment. Let me turn to the substance of the issues.

Parliament agreed less than two years ago to a boundary review, and it did so for good reasons. There are major disparities in the size of constituencies. In England, East Ham has 92,000 voters; Wirral West has just 55,000. The differences are even greater in respect of other nations: Arfon in Wales has an electorate of just 41,000. This means that some votes count much more than others, and the principle of greater equality in the value of each vote is at the heart of this new boundary review. Votes should carry much more equal weight across the country in electing Members to this House and in deciding a future Government. If the current review were not to happen, in England the next general election would be based on the register of February 2000, with all the consequent disparities and inequalities which have been exacerbated since then. It would be 15 years out of date.

I thank my right hon. Friend for giving way. I hope it may be helpful to him and the House to know that his colleague the Deputy Prime Minister gave evidence to the Select Committee on Political and Constitutional Reform on 19 April and 13 December last year, and I asked him the exact questions that Members have been asking in the last few minutes. He made it clear to the Committee that he still agreed with what he said at the Dispatch Box on Second Reading: that we have to put right what he called

“the broken scales of our democracy”—[Official Report, 6 December 2010; Vol. 515, c. 36.]

However, he also made it clear that although he considers the current system to be unfair, he is absolutely certain that that unfairness should continue until after the next general election. That is his position.

I am sure the House is grateful to my hon. Friend for informing it about the discussions in the Political and Constitutional Reform Committee. From my point of view, I know the Deputy Prime Minister’s commitment to constitutional reform. I think the boundaries review and the introduction of greater equality and fairness in constituencies and between voters is an important constitutional reform, and I hope he would want to see it put through before the next election.

I agree with the hon. Lady, as do the Electoral Reform Society and the Electoral Commission. She should join me in ensuring that those invisible citizens who should be on the register are put on the register. Let us not rush ahead with partisan boundary changes.

I have been very generous, as the hon. Lady knows. I will make some progress, and if I have time after that, I will give way.

Labour legislated for individual electoral registration in 2009. The timetable and safeguards that we proposed at the time received cross-party support, but there was a general recognition that risks would be involved in the transition, which is why it was spread over a number of years. However, the Bill in its unamended form has watered down some of the safeguards that we introduced, thus failing to take account of risks that could mean the loss of millions of eligible voters from the register.

The complexities of the move are enormous. It involves the carry-over of existing registered voters for periods of the transition, the simultaneous piloting of data-matching schemes, a drive to show the public how to register, and changes in the way in which local authorities seek to register voters and how they should deal with a refusal to co-operate. As the Government themselves admit,

“Individual Electoral Registration (IER) is the biggest change to our system of electoral registration for almost a century and it is essential we get it right”.

The proposed boundary review changes should not go ahead while 6.5 million people are missing from the register. Moreover, the next boundary review is due to take place on 1 December 2013, after individual electoral registration, so we could end up with millions more missing after that. We will end up with a reputation as a banana republic if 6.5 million, 10.5 million or 16 million people are missing from the register. This is no way to run a democracy.

The hon. Gentleman and I have had various arguments on this issue across the Floor of the House for as many as nine years. Even if what he is saying is correct, he is completely missing the point about the amendment and the importance of the Bill. How can he say that it is fair that Arfon has 41,000 constituents while Somerton and Frome has double the number—82,000? How can he possibly say that that is fair?

I thank the hon. Lady for her intervention. She should think about the figure that I have mentioned: 6.5 million people are missing from the register. The vast majority of them will be in Labour constituencies. The vast majority of the case load for Labour Members and those Members who serve poorer constituencies around the country comes from the unregistered, the people who should legally be on the register but are not. If those people were factored in, the inequality would not be as great.

I shall address amendments 7, 10 and 11 first, and then amendments 6, 8, 9, 21 and 22.

The Opposition have consistently supported the introduction of individual electoral registration. We agree with it in principle; indeed, we legislated for it when we were in government. We also support the twin principles of achieving maximum accuracy in the electoral registers and maximum completeness. I am pleased the Government have now accepted the arguments that we and others have put forward in this House on a number of occasions. I remember the hon. Member for Somerton and Frome (Mr Heath) being totally dismissive of them, but we welcome the fact that the approach taken by the other place is more rational and that the Government admit—although belatedly—that their initial arguments were wrong, and that they now agree with us. The Government have seen the light, on this issue at least.

I am also pleased that the Scottish Government have taken action and that the views of the Electoral Commission have been taken on board. I remind the House that, in the aftermath of the May 2010 general election, the Electoral Commission produced a report that identified four key factors in what had gone wrong. There was evidence of poor planning assumptions in some areas, and of poor conduct of the election on polling day. The use of unsuitable buildings and inadequate staffing arrangements at some polling stations were also an issue. It was said, too, that the contingency arrangements were not properly triggered or were unable to cope with demand at the close of poll—that was very evident. Finally, the Electoral Commission found that there was restrictive legislation which meant those in queues at polling stations at the close of poll were not able to be issued with a ballot paper. The Government were initially trenchantly opposed to that objective view. They now agree that it is necessary to accept it and to introduce corrective legislation. I welcome that; this House supports the Government’s conversion.

The second substantive issue is to do with the so-called carry-forward—or carry-over—and the commencement of full individual electoral registration in December 2015 or December 2016. We support the Government’s amendments in that regard and recognise that there has been a move, albeit a more modest one than on the other big issue, to try to accommodate the legitimate concerns expressed in the other place. However, the Electoral Commission has reservations about these amendments and, indeed, they are a rather convoluted set.

The Minister set out a convoluted process. I have to be honest and say that, on occasion, it sounded as though she was speaking double Dutch. The Bill is to contain a delay in the implementation of full IER from December 2015 to December 2016. We might think that that is fair enough, as it will allow greater parliamentary scrutiny, greater parliamentary involvement and a greater opportunity to get more people on to the electoral register under IER than would have been the case. But, unfortunately, the Government will not go the whole hog, and they are introducing a byzantine system whereby having a cake and eating it is the order of the day. They are saying, “Yes, that change will be in the Bill, but we reserve the right to contradict what is in the Bill by saying that our implementation plan stays in place. We will still want to do what we always intended to do, despite the amendment we put into the Bill.” If any hon. Member is confused, I do not blame them, because, as I said, the Government are speaking double Dutch.

To make matters worse, the Government have introduced a procedure—the negative assent procedure—involving both Houses, and that will make the situation even more complicated. Let me try to be helpful to the Minister, as always, by suggesting what the Government might do to resolve their internal contradiction. She began by sensibly saying that the implementation date will move from December 2015 to December 2016, but there remains a right for the Secretary of State or Lord President of the Council to make an order to remove those carried-forward entries in December 2015. Given the mood of the House and what has been said generally this afternoon, I suggest that the Government give a firm commitment not to implement that, so that everybody will be clear that the implementation date will be 2016. We will support these amendments, but it would be enormously helpful if the Minister responded positively, recognising the mood of both Houses, by saying, without any equivocation, that there will be a delay in the implementation of IER until December 2016.

I was totally taken by surprise to discover that the Minister is urging the House to accept Lords amendment 7 on voters waiting at polling stations at the close of poll. On 27 June 2012, I introduced this very amendment—it was almost word for word—which was known then as new clause 4. I will not repeat the speech I made then. We had a long debate and I was supported in my arguments by the hon. Member for Penistone and Stocksbridge (Angela Smith)—that is all on the record in Hansard, at column 359 and onwards. That is lucky, because we do not have time to debate that all again this afternoon, and I am delighted that we do not have to do so.

In that debate, the hon. Member for Somerton and Frome (Mr Heath) stood there and told me how everything I said was wrong and that I was silly to waste the House’s time by introducing my new clause, which he said was total rubbish and totally unnecessary. He said that returning officers could deal with all the problems and that this was merely a matter of management.

I am glad that the hon. Lady agrees with my recollection of what happened on 27 June. I believe she also agrees with my arguments that these matters should not be left up to individual registration officers, especially given that their ability, resources, experience and enthusiasm vary considerably from one part of the country to another.

I thank my right hon. Friend for that point and am coming to it.

I am very glad that the Minister recognises what I and other Members said on 27 June 2012 was right, but, as I am sure my right hon. Friend will agree, this is also a very good example of why we need a revising Second Chamber rather than another House at the other end of this Palace of Westminster that challenges everything we do and makes things difficult for the process of government. We need a House that looks again at what has been said and done in this Chamber and makes sensible suggestions. In this case, the suggestion made by their lordships is almost exactly the same as the suggestion I made on 27 June; I am delighted that their lordships agree and I am extremely delighted that the Minister is urging the House to accept the amendment.

I, too, congratulate my hon. Friend the Member for Epping Forest (Mrs Laing) on her foresight and vision. It is great that the Government are taking on her suggestion, because there is no doubt that if a queue of people is waiting at the polling station to vote, it is not beyond the wit of man or woman to put a polling clerk or somebody else in the line to act as a marker between those who arrived before 10 o’clock and those who arrived afterwards. I cannot see any great argument for saying that that would delay the whole process, because at the count many boxes come in from all over the constituency and some will arrive first, meaning that their contents can start to be counted, whereas others will arrive later. We got ourselves into a bureaucratic nightmare that could be fixed quite simply. I am delighted that the Government have accepted the Lords amendment, and I congratulate my hon. Friend again on her foresight.

If the hon. Gentleman wants to persuade his hon. Friends to have a debate on the economy next week, we will be happy to have that. We could explain how inflation has fallen, how unemployment is rising, how we have cut the deficit by a quarter, how we have spending under control and how we have low interest rates as a consequence of the confidence that people across the world have in the Government’s fiscal consolidation. I know that he and the right hon. Member for East Ham (Stephen Timms) are interested in the level of the minimum wage and living wage. That and other issues, including equal marriage, will be debated by the Youth Parliament in the Chamber tomorrow. They might like to watch.

Friend ensure that when the House considers the order under section 30 of the Scotland Act 1998—a significant piece of constitutional legislation, giving the Scottish Parliament the power to conduct a referendum that has the ability to affect the entire constitutional position of the United Kingdom—it will do so on the Floor of the House and for a whole day?

The hon. Lady asks why the Government do not want to go ahead with a referendum. I wonder whether the answer might be that if a question were put to the British people the affirmative answer to which was, “You will have 450 extra elected, salaried, full-time politicians,” the British people might say no.

I am not sure that the answer to the question is “823—and counting—appointed politicians who legislate” either, so I am sorry to have to disagree slightly with the hon. Lady. The important principle is that when changes of this importance are being decided, the British people should have a say.

My hon. Friend makes a valid point, and one that is worthy of more consideration.

The Joint Committee sought to serve both Houses in our report, and we were a very mixed group, including independents, Conservatives and Lib Dems. I note that its Lib Dem members voted the whole way throughout the Committee’s considerations, which leads me to think that there might just be another agenda, and some of us have drawn attention to that this afternoon. A number of us signed the alternative report, including six Privy Counsellors and the Bishop of Leicester, the Convenor of the Lords Spiritual. He said that it was not enough simply to talk about bishops because we ought to be dealing with inter-faith matters. This is a diverse society. The House of Commons has not as yet reflected that, but if we get the opportunity to do so in the House of Lords, we ought to take it.

I complained yesterday in an intervention on the Deputy Prime Minister, to which he responded inadequately, that the Joint Committee did not even have the opportunity to consider costs. Even today the Government have been very reticent in the information they have given the House. They refer to the Bill, but it leaves most of the decisions to the Independent Parliamentary Standards Authority. There are varying levels of respect for IPSA in this House, but whether that is the right way to go in these matters is worthy of more thought.

Does the right hon. Gentleman agree that it is simply wrong that the Joint Committee’s report and the alternative report have never been debated in this House and that the debate we are having right now is about the narrow confines of the Bill, rather than the whole issue of parliamentary reform, and does he agree that we need a constitutional convention?

I beg to move, That the clause be read a Second time.

I am pleased to have the opportunity to bring new clause 4 before the Committee. As is explained on the amendment paper, the clause would allow for ballot papers to be issued to any registered voter who is in the polling station or in a queue immediately outside the polling station at 10 pm or whatever time the poll closes, in order that they may then cast their vote. The Committee will recall what happened at the last general election, when more than 1,000 voters in 16 constituencies were denied the right to vote.

As the law stands, voters who are in a queue at a polling station at 10 pm but who have not yet been issued with their ballot paper are unable to cast their vote. Both the Electoral Commission and the House of Lords Constitution Committee have called on the Government to change the law to ensure that voters are not disfranchised as some were at the last election. There is precedence for such a provision because the Scottish Government recently changed the law for local elections in Scotland to allow for voters in queues at polling stations at 10 pm on the close of poll to cast their ballots.

I take the findings of the Electoral Commission very seriously in this respect, and the main factors that the commission identified as having contributed to the problems in 2010 were that there was evidence of poor planning assumptions in some areas; that there was use of unsuitable buildings and inadequate staffing arrangements at some polling stations; that contingency arrangements were sometimes not properly triggered or were unable to cope with demand at the close of poll; and also that current restrictive legislation, and therefore the presiding officer having no ability to apply discretion, meant that those who were present in queues at polling stations at the close of poll, were not able to be issued with a ballot paper.

The main conclusions of the Electoral Commission published in May 2010 recommended that the law must be changed to allow people queuing at polling stations at 10 pm to be able to vote. The commission also noted that local authorities and acting returning officers must take steps to improve their planning—we all agree with that—and must review their schemes for polling districts and polling stations to make sure that they allocate the right numbers of staff and electors to each polling station. All of these practical measures should be taken, and I hope now will be taken as a result of the fact that we saw 1,000 people at the last general election being deprived of their votes. In addition, the structure for delivering elections must be reformed to ensure better co-ordination and consistency, and, as we have debated during the last few days in other parts of this important Bill, returning officers should be more accountable for the way they manage elections. Nevertheless, I want to give the House the opportunity to consider whether we here in Parliament ought to add this clause to the Bill in order to give not just the clear direction but the power to a presiding officer to act in the way I describe in new clause 4, which will ensure that everybody who is present at the right time at close of poll should be allowed to cast their vote.

We do not want to discourage people from voting. We are in the business of getting as many people to vote as possible. We should not have artificial restrictions that stop people voting when they turn up to do so. At the same time, if an unforeseen incident occurs, which means that some people are at the polling station but do not have their ballot paper in their hand, the presiding officer should have a certain amount of discretion, within very strict parameters that I am setting out here, to allow people to cast their votes. It cannot be right that we in Parliament should take action that stops people voting when they have a legitimate right to do so. It goes against everything that we are trying to do in expanding democracy and encouraging people to vote and have a say in the government of our country.

What happens under the current arrangements if there is suddenly a medical incident, such as a car accident, outside a polling station at a quarter to 10 and the police have to secure the area while the ambulance men deal with anyone who is hurt? Would the polling station close at 10 regardless, because that seems a bit silly?

My hon. Friend makes an extremely good point. That is exactly the sort of contingency that I am asking the House to consider in new clause 4. At present, if an incident occurs that prevents a potential voter entering a polling station or slows down their progress there from the car park, the tube or train station, the bus stop or the zebra crossing, nothing can be done about it.

I agree. If the presiding officer is standing at the door of the polling station and sees that there are people just about to come in at 10 minutes to 10 but they are being prevented from doing so by some very good and unforeseen reason, and if he knows that when they come in it might be two minutes to 10 and there is no way 10 or 15 ballot papers can be issued in two minutes, under the current arrangements he can do nothing about it. He has to say, “Too bad. That happened and you lose your vote.” That seems entirely undemocratic and simply wrong.

This matter has been considered by the courts, which have held that

“where a ballot paper has been duly issued to an elector that elector should be allowed to complete it and put it in the ballot box provided this is done without undue delay. However”—

and this is the crux of the matter—

“no ballot papers should be issued after the time of close of poll.”

So if a person is standing in a queue of five or six people—it does not have to be a crowd—at five minutes to 10, and in front of them someone is having difficulty identifying their name, or is perhaps suffering from a disability that makes it difficult for them to give their name quickly to the polling clerk—

Yes. My hon. Friend once again comes up with an interesting contingency. Supposing someone at the front of the queue collapses or becomes ill and attention is thus diverted, the five or six people who are legitimately standing there at 10 or five minutes to 10, expecting without any problem to be given their ballot paper, cannot be given one if the clock strikes 10. That just cannot be right.

The courts—this is a statement of the law at present—have ruled:

“We are of the opinion that the true dividing line is the delivery of the ballot paper to the voter. If he has had a ballot paper delivered to him before”—

10 pm—

“he”—

I say “he”, because I think that the judgment was delivered before the female of the species was entitled to vote. Let us therefore bring this judgment of the courts up to date: when I say “he”, I mean “he” or “she”.

The judgment continues, finding that

“he is entitled in our judgment to mark that ballot paper and deposit it in the ballot box before the ballot box is closed and sealed. This interpretation of the enactment…appears to us to give a simple, definite, and just rule of procedure… As the polling commences at”—

7 am—

by the officials, and the machinery being ready then to supply ballot papers to voters who apply for them, so in our view the poll must be no longer ‘kept open’ beyond”—

10 pm—

“the officials then ceasing to supply ballot papers to applicants.”

That position, as stated in court, was confirmed most recently by an election court in Northern Ireland, which in 2001 stated:

“It was the duty of the presiding officer to close the poll at 10pm by ceasing to issue any more voting papers. So long as voting papers were issued by 10pm, however, if electors marked them and deposited them in the boxes without delay the votes were valid.”

The Electoral Commission, in guidance published for the Scottish elections in May this year, issued strict directions to presiding officers on what exactly should happen. Some people have argued that it would not be possible to determine where a queue ends and where exactly the cut-off point should be for people who are entitled to vote, but that criticism has to be nonsense. The presiding officer—surely, in a position of responsibility—will be able either to close the door or to usher people inside the polling station, and to say exactly where the cut-off point should be.

The guidance states:

“If there is a queue shortly before 10 pm”—

the presiding officer should—

“find out if anyone waiting is delivering a postal vote so that they can hand in the postal vote before the 10pm deadline; Make sure that nobody joins the queue after 10pm; If there is a queue at 10pm and if the polling station can accommodate all the electors in the queue, ask electors to move inside the polling station and close the doors behind the last elector in the queue”.

That is so simple. The guidance continues:

“If the polling station is too small to accommodate all the electors in the queue, a member of the polling station team should mark the end of the queue by positioning themselves behind the last elector in the queue”—

again, terribly simple and straightforward. The presiding officer, the guidance notes state, should also:

“Explain to anyone who arrives after 10 pm and tries to join the queue that the poll has closed and that, by law, they cannot now join the queue to be issued with a ballot paper.”

All that is terribly simple and straightforward.

Does the hon. Lady agree that under the Bill a police officer, or a local community support officer acting with the same powers as the police, could be in attendance so that if there were any dispute they could ensure that people knew exactly where the end of the queue was?

The hon. Gentleman is absolutely correct. However, as I am sure the Committee will appreciate, this is not about an outbreak of violence, a riot, a demonstration, or unruly electors behaving in a somehow inappropriate fashion; it is about decent, law-abiding potential voters who turn up at a polling station before 10 o’clock, or whenever the close of poll might be, and find that because of some unforeseen contingency they do not get as far as having their ballot paper issued by that time.

Let me explain the difference that new clause 4 would make. At the moment, most people think that if they are in the polling station at 10 o’clock, they will get their ballot paper and be able to vote. That is a reasonable position, and the new clause would make it law. It is an unreasonable position to say that someone who has arrived at a polling station ahead of 10 o’clock, and for some unforeseen reason does not have a ballot paper issued, cannot still have one issued for a few minutes after that time. Nothing in the new clause would mean that the poll stayed open beyond 10 past or quarter past 10. We are talking about a very small amount of time for the sake of fairness. In the 2010 general election, 1,000 people were denied the opportunity to cast their vote when they had every right to do so. I am simply asking the Committee to bring the law up to date in order to give everybody who has the right to vote the chance to cast that vote.

I wonder whether you have had notice that a Treasury Minister intends to come to the House to make an urgent statement on the news concerning the alleged market manipulation of the LIBOR interest rate, for which Barclays has today been fined a record sum by the Financial Services Authority. The mortgage interest rates of hundreds of thousands of our constituents up and down the country depend on LIBOR. We need to know how widespread this market manipulation is across the financial services and banking sectors, and whether a Minister will come urgently to the House to talk about how the Government intend better to regulate the LIBOR-setting process.

I ask my hon. Friend to imagine this scenario. A person gets home late, arrives at the polling station, parks in the school car park and dashes through the doors of the school at 9.59 pm, but of course the polling station is in a hall further on. The person then gets lost because the signage is not good enough, or, worse still, is misdirected and goes to the wrong polling station, because there is often more than one in the same building. Whose fault is that? It is the person’s fault, because he or she is the voter.

Such questions are difficult, but what is clear is that the law should say that if the voter has arrived in the polling station, or in the queue at the polling station, his or her vote should be recorded. What should not happen is that a person arrives at the place where the ballot papers are issued, only to be told “I am sorry, but it is one minute past 10 and we have closed the polling station, so you are not allowed to vote”—although the person has been in the polling station and validly queuing for 15 or 20 minutes, or perhaps even half an hour. That is what needs to be clarified. There should be the minimum discretion in that respect, but the maximum discretion for the voter.

I listened carefully to my hon. Friend’s description of the incident that might occur. I should make it clear to the Committee that new clause 4 is not intended to help someone who runs into a polling station at one minute to 10. Each individual has a responsibility to leave enough time in which to find the polling station. The new clause is intended to help people who arrive at the polling station at 10 minutes to 10 thinking that they have plenty of time, but, as a result of some incident that then occurs—there may, for instance, be too many people or bad organisation—the ballot paper is not issued at 10 minutes to 10. I think my hon. Friend would agree that that is quite an important distinction.

I agree. The most important thing is that people who have arrived at the polling station well before the time deadline and have formed a queue and are waiting for their ballot papers to be issued should be allowed to register their vote.

We are not only talking about general elections. In 2014, for example, there will be European and local elections, probably on the same day. There are often multiple elections, and further problems can arise in such circumstances. In a general election, turnout tends to be high, of course, but these problems can occur even in local elections, when turnout is lower. We, as democrats, must seek to ensure that people are given the optimal opportunity to register their votes.

It is often not appreciated that we have huge numbers of differentials in elections, in that different people are entitled to vote in different elections. In the 2010 elections, in my constituency 10% of the voting population were from eastern Europe and were not eligible to vote in the general election but were eligible to vote in the local elections. That caused substantial confusion at certain polling stations, particularly later in the day. People were arguing about whether they should have a ballot paper. That can add to delays in issuing ballot papers to others, so people who have left sufficient time to cast their votes can find that they are not issued with ballot papers. That is fundamentally wrong. I want us to give a strong steer in law to returning officers about what they should do in such circumstances, and there should be the minimum of discretion for interpretation.

No, I really do not have time if I am going to do justice to responding to the debate.

The hon. Member for Epping Forest did an excellent job with her Select Committee on the pre-legislative scrutiny of this Bill. I know that she chaired many of the sessions in the absence, unavoidably, of the Chair and that she took great care to make sure that my hon. Friend the Minister was quizzed by the Committee, when it took evidence and brought forward its responses. That is why I was a little surprised when she said that her Committee backs these changes to the legislation because that suggests that I have completely misread paragraph 98 of her Committee’s report, which was produced under her chairmanship, which states:

“On the issue of close of poll the Minister set out the Government’s position that the issues around close of poll in the 2010 election were ‘largely around poor planning, poor resource management’ and that an attempt to legislate in this area could create more problems than it solved. We agree with the Minister that in this area careful planning and allocation of resources are likely to be more effective in ensuring all those who are eligible can access their vote without resorting to legislation.”

That was the view of the Committee at the time.

The Minister is right to read out that part of the Committee’s report, but since then the Electoral Commission has looked at this matter in greater detail, has taken further evidence and has recommended very strongly that new clause 4 should become part of the Bill. I have listened to the Electoral Commission and that is why I have brought this new clause before the House.

I do not think the Electoral Commission has changed its position. [Interruption.] I do not think it has. It took evidence but it took no further evidence after the hon. Lady’s Committee took its evidence and came to a conclusion. I am grateful to her Committee for supporting the view that the Minister took.

Any changes that we introduce create more potential for problems. For example, this is not what the hon. Lady has proposed but if we were to introduce discretion on the part of returning officers they would be open to challenge because of the way in which they applied that discretion. I am glad that she has not gone down that road. [Interruption.] She says, “No one suggested it,” but that was suggested by one of her colleagues. That is why I am responding to that point in the context of this debate.

There is a suggestion that the problem could be addressed by reference to the limits of the curtilage of the polling station, but that would be extremely difficult because it varies enormously among polling stations. The hon. Lady’s proposal is probably the least bad option, but the queue itself presents problems with definition and management, which is why it is extremely difficult to accede to such a measure. The situation did not happen widely before 2010 and has not happened widely since, but we must ensure that it is not allowed to arise, and the key to that is proper management.

We and the Deputy Prime Minister are clear that questions need to be answered. It would have been better had the matter been addressed by the independent adviser, but that is not the system we currently have, which is the system that we would like to change. I want to make it clear, however, that this is not, as some have suggested, an issue of collective responsibility. There was not a collective decision on this. It is not part of the coalition agreement but was a decision taken solely by the Prime Minister, and in no way will our vote, or absence of votes tonight, preclude us from continuing to work with our coalition partners on the issues agreed in the coalition agreement and in sorting out the economic mess in which the previous Government have left us.

The hon. Lady makes a factually correct point: if the Business Secretary had not had the responsibility removed from him, it would not have gone to my right hon. Friend the Culture Secretary.

I also want to make it absolutely clear why the Liberal Democrats are not prepared to go into the Lobby with the Labour party today. The House is well aware that this is not a decision for the House; it is a decision for the Prime Minister, and he has made his decision. This is, therefore, a political ruse by the Labour party, whose behaviour on these issues is frankly appalling. For example, paragraph 9.3 of the ministerial code states:

“Every effort should be made to avoid leaving significant announcements to the last day before a recess.”

On Tuesday 22 July 2008—the day before the recess—no fewer than 30 ministerial announcements were made, 10 of which were from the then Prime Minister. One year later, following the appalling behaviour of Mr Damian McBride, no action was taken over the Prime Minister’s responsibility for his special adviser, who was forced to resign for his behaviour. Furthermore, the Labour party misled not only the House but the country over the war in Iraq, and has spent years trying to cosy up to the Murdochs. There is no way we will join Labour Members in the Lobby today.

When we implemented the e-privacy directive we made sure that we worked closely with business. There is a balance to be struck between implementing the law and ensuring that business still has the freedom to innovate. The e-privacy directive is about transparency. So long as consumers know what is happening to data, they should be comfortable with what is being done with them.

In March VisitEngland will launch a new £4 million domestic marketing campaign to promote UK tourism throughout 2012. We are encouraging the tourism industry to sign up to a scheme that offers 20.12% off all sorts of different accommodation and attractions. The promotion will be supported by a high-profile TV campaign.

I am sure that the House will be delighted to hear the Minister’s enthusiasm, and to hear of the worldwide advertising campaign to encourage people to come to London. Will he also publicise the fact that many Olympic venues are outside London, such as the excellent white water centre in Waltham Abbey in my constituency? Will he encourage people to enjoy the wonders of the Lee valley park, the ancient town of Waltham Abbey, its beautiful church and, of course, the wonders of the beautiful Epping forest?

I would be delighted to do that. In fact, that is one of the central aims of the campaign. We will use the torch relay, which I believe will go to my hon. Friend’s constituency on 7 July, as a way of promoting the different parts of the country that it will visit and all the things that can be done there, including, in her case, the Lee valley white water centre, as well as the Waltham Abbey church and its links with King Harold.

As the owner of a very small bicycle, I look at these fast and expensive cars with some envy. My hon. Friend makes a valid point—conspicuous consumption generates jobs in constituencies such as his. I think it was Lord Mandelson, was it not, who said that nothing inconvenienced him about millionaires? I hope that the Labour party will, perhaps, change its view about Aston Martins and Rolls-Royces, many of which are manufactured in constituencies represented by Labour Members of Parliament.

My hon. Friend will know that the Prime Minister has made it clear that he finds the present law unsatisfactory. It discriminates against women and against people who marry Roman Catholics. He has made it clear that he has written to the Heads of the Commonwealth to try to get agreement. I can only suggest to my hon. Friend that she awaits the outcome of the Commonwealth Heads of Government meeting in Australia and sees what my right hon. Friend the Prime Minister has to say on this matter at its conclusion.

I have listened carefully to the right hon. Gentleman. I totally agree with him, and nobody is a fiercer Unionist than I am, but the way to preserve our United Kingdom is to show equal respect to all parts of it, meaning every little corner of every country in the UK. How can he argue that one Member of Parliament should come to the House with a greater weight of votes behind them than Members from other parts of the UK? That is not fair and it is not equal.

My hon. Friend is absolutely right. I am grateful to all five of my parliamentary colleagues in Cornwall. With me, that makes six standing shoulder to shoulder together on this issue. We are not asking for a favour, only for the distinctiveness of Cornwall to be recognised. In a sense, we will be more unfavourably treated. As the statistics pan out for the electoral register for Cornwall as a whole, the best guesstimate is that, if we go for a rounding down of the constituencies, we will end up with an electorate nearly 10% higher than the quota.

Surely the hon. Gentleman is not suggesting that the proud duchy of Cornwall and its proud Cornishmen would feel any less Cornish or any less proud of their ancient historical traditions just because one of their constituencies happened to have in it a small part of another county. Surely Cornwall is worth more than that.

It is very nice of the hon. Lady to take an interest in Cornwall and I appreciate that. If she wants to identify the voices of Cornwall, however, she might do well to look at the three Conservative Members who represent three Cornwall constituencies. They are very clear on this issue, and they disagree with her on that particular point. The fact is that it is the thin end of the wedge and a slippery slope. We are moving in the opposite direction from the one many want to see—giving Cornwall a stronger say and enabling it to build the identity of which it is enormously proud.

Boundary Commission proposals: publicity and consultation

I beg to move amendment 205, page 12, line 21, at end insert—

‘(A1) In relation to a report under section 3(1) that a Boundary Commission is required by section 3(2) to submit before 1 October 2013—

(a) a Boundary Commission shall make information available via their website, and if they see fit by other means, on their proposed general approach to the application of Schedule 2;

(b) representations with respect to this proposed general approach may be made to the Commission during a specified period of eight weeks; and

(c) the Commission shall take into consideration any such representations duly made prior to the provisional determination of any recommendations affecting any constituency.

(A2) A Boundary Commission’s “proposed general approach” shall include, but need not be limited to—

(a) the processes by which they intend to seek to ensure the application of rule 2, and in the case of the Boundary Commission for Northern Ireland of rule 7, including the circumstances in which they will consider recommending that wards, electoral areas and divisions should be divided between two or more constituencies, and the information on which they intend to rely in determining how to carry out such a division, and

(b) the extent to which they intend to take into account each of the factors described in rule 5(1), and in the case of the Boundary Commission for England of rule 5(2).’.

‘(1) Where a Boundary Commission has provisionally determined to make recommendations affecting any constituency—

(a) they shall take such steps as they see fit to inform people in the constituency of the effect of the proposed recommendations and that a copy of the recommendations is open to inspection at a specified place within the constituency,

(b) they shall make available via their website, and if they see fit by other means, copies of their proposed recommendations and information on their effect, together with such information as they have on the number of the electorate in every sub-division of every ward, electoral division and electoral area in England, Scotland, Wales or Northern Ireland, and

(c) representations with respect to the proposed recommendations may be made to the Commission by people whether in or outside any given constituency during a specified period of 12 weeks, and the Commission shall take into consideration any such representations duly made.’.

‘(1A) A Boundary Commission may cause a local inquiry to be held for the purposes of a report under this Act where, on publication of a recommendation of a Boundary Commission for the alteration of any constituency, the Commission receives any representation objecting to the proposed recommendation from an interested authority or from a body of electors numbering one hundred or more.

(1B) Where a local inquiry was held in respect of the constituencies before the publication of the notice mentioned in subsection (1) above, that subsection shall not apply if the Commission, after considering the matters discussed at the local inquiry, the nature of the representations received on the publication of the notice and any other relevant circumstances, is of an opinion that a further local inquiry would not be justified.

(1C) In subsection (1A) above, “interested authority” and “elector” respectively mean, in relation to any recommendation, a local authority whose area is wholly or partly comprised in the constituencies affected by the recommendation, and a parliamentary elector for any of those constituencies.’.

I am glad that we are going to be able to debate all these amendments in this one debate. It is unfortunate that the hon. Member for Nottingham North (Mr Allen), the Chairman of the Political and Constitutional Reform Committee, cannot be present, as he would have relished the opportunity to speak to these amendments on behalf of our Committee. I am pleased to see that other members of the Committee are in the Chamber, however, and they may wish to echo those sentiments. In the absence of the Chairman, I shall speak to amendments 205 and 206, which arise from the Committee’s report on the Bill—the nearest that we got to pre-legislative scrutiny.

The purpose of amendments 205 and 206 is to ensure that consultation by the boundary commissions is as meaningful as possible. Amendment 205 would require them to hold a one-off, short consultation on how they intended to approach the division of England, Scotland, Wales and Northern Ireland into constituencies before the first review—the 2011 to 2013 review—took place. It would allow people to give their views on the extent to which, for example, county boundaries should be crossed and which ward sub-division might be desirable and, where wards are sub-divided, on the kinds of sub-division to be used. The Committee has asked the House simply to consider whether amendment 205 would—we hope that it would—increase the perceived legitimacy of the boundary commissions’ decisions, and reduce the likelihood of local frustration and the possibility of legal challenge to their recommendations.

Amendment 206 is intended to improve the quality of the consultations that the boundary commissions conduct under each proposed future review. As the Committee said in its report:

“The legitimacy of the next boundary review in the eyes of the public is likely to be strongly influenced by their ability to participate effectively.”

The amendment would allow people to make representations to the commissions on constituencies other than the one in which they live, and it would require information on the number of electors within sub-ward divisions of constituencies to be made available nationwide. I appreciate that the Government are working to a very tight timetable and we do not have very much time for debate this evening. Members wish to raise important matters, so I shall be as brief as I can.

The purpose of the amendments is to ensure that people have, first, the information about their locality that they need to make to the boundary commission a proposal that keeps within the rules, and, secondly, the right to make recommendations about constituencies other than the one in which they live so that that they are not prevented from making suggestions about their locality that would otherwise take their constituency outside the range of the 5% flexibility permitted. I appreciate that I have truncated the case, for the reasons that I have set out, but I am sure that hon. Members who are interested in the matter and, certainly, Ministers will already have read the Select Committee’s report and fully appreciate the importance of the points that I have put to the House.

The Government may not wish to accept the amendments, but they are intended entirely to be helpful and constructive. The Committee took a cross-party position, and the amendments are not political. Given the timetable to which the Government are working, however, they may not wish to consider these matters. If the Minister is not prepared to accept the Committee’s amendments, how will the boundary commissions ensure that consultation with local people is meaningful, and that the mass of the new rules is not so constructed that local feeling on constituency boundaries cannot be taken into account?

I cannot speak about Epping Forest or Brentwood and Ongar, but, when the boundaries changed in Scotland in 2005, the proposal for my constituency was to take out two large wards from the town of Dumfries itself. People were so angry that they mounted their own campaign, which they took to a public inquiry, and they won the case that they should not be separated. It is wrong for the hon. Lady to say that only political parties undertake such activity. The strength and voice of communities should be heard, but the Bill will not give those communities the voice that they deserve in a democratic society.

I understand what the hon. Gentleman says, and I understand how strongly the people of Dumfries feel, but that is not the point of democracy. In a modern democracy what counts is not valleys, mountains, rivers and perceived ancient boundaries, as we heard argued in the previous debate; what counts is that every person in the United Kingdom has a voice of equal value and votes.

I am much gratified by that.

I would not have had any exceptions in the Bill; I think that the exceptions are wrong. The matter at issue is that every vote in the United Kingdom should be of one value and of one weight—that every Member of Parliament who comes to this House should have, within a reasonable tolerance, the same number of potential voters, voting for them or otherwise.

Does the hon. Lady support—I fully presume that she does—the building of the big society, as outlined by her right hon. and hon. Friends on the Front Bench? Is not the Select Committee’s suggestion that the boundary commissions should have this arrangement for people to make representations an acknowledgement that the elimination of public inquiries is creating a vacuum and depriving citizens of the opportunity to make such representations, and therefore totally contradicts the big society in preventing expressions of disappointment or concern about the proposals from being heard?

The hon. Gentleman is, as ever, very clever in the way that he puts his point, but this has nothing to do with the big society. I take his point that the boundary commissions must be seen to be operating fairly, but I argue strongly that there is no need for them to take year after year, spending more and more taxpayers’ money, listening to political parties making points that are cleverly disguised as being about ancient boundaries, communities and so on, when in fact they are about the perceived electoral advantage or disadvantage of each particular political party. Anyone involved in politics knows perfectly well that that happens. At a time when we should be spending money on the real big society issues of which the hon. Gentleman is only too well aware, we should not be spending enormous amounts of taxpayers’ money on keeping the boundary commissions doing that year after year.

I agree with the hon. Lady’s Aristotelian logic. There is no need for wide public inquiries or forced submissions if we are going to have a purely arithmetical decision on where the boundaries lie; in fact, there is no need for any submissions whatsoever. May I therefore urge her to table an amendment that would scrap any discussion or debate in this House and just move on to drawing the jigsaw that will be the United Kingdom’s parliamentary boundaries? If one takes her logic to the extreme, there is no need for any discussion or debate whatsoever.

The hon. Gentleman makes an excellent point with which I cannot disagree. It is the arithmetic that rules. Labour Members try to find arguments against that, but the fact is that if one believes in a modern democracy where every vote is of equal value and every Member of Parliament comes here with an equal weight of potential votes behind them, one cannot argue otherwise. I would go further and say that there should have been no exceptions in the Bill.

This evening and on other occasions, Members of this House have put great emphasis on equal votes having equal value. If the coalition Government succeed in doing what they are attempting to do, the vote of every person who goes to the polling station will be equal when they enter, but a 48% turnout will give a different value to that vote than it would if the turnout were 70%. Equality is about more than just the number of bodies in a constituency—it is also about votes being cast, and that can cause a disproportionate level of representation.

I am sure that the hon. Gentleman is speaking from sincere and heartfelt beliefs, but that is totally illogical. If there are, say, 76,000 potential voters in a constituency and 40,000 of them decide not to vote, that is their democratic choice, just as it is the democratic choice of the other 37,000—I think I got the arithmetic wrong there—to cast their vote. People who decide not to vote are exercising their democratic judgment in the same way as people who decide to vote. There has been a lot of discussion about where the heart is, communities, boundaries, and so on—matters that appear to be anything other than purely arithmetical.

Completing the circle of logic in the hon. Lady’s argument, presumably she will want to table, or to have someone else table, an amendment that would prohibit people from registering in more than one place, because those voters, be they students or second property owners, have the opportunity to choose where they would cast their vote. Therefore their vote is not as equal as anybody else’s. Given her logic, she is presumably in favour of such an amendment and will be urging Government Front Benchers to bring it forward immediately.

I see the hon. Gentleman’s point. However, the logic and arithmetic of that is that it does of course happen, but it pretty well cancels itself out from one constituency to the next. People often, for various reasons and quite legitimately, register in more than one place, but the fact that it happens all over the country cancels it out.

I rise to speak to amendment 15, on which we will wish to divide the House.

It is always a pleasure to follow the hon. Member for Epping Forest (Mrs Laing). As charming as her speech was, I am reassured that we were in different Lobbies in the last Division, and I suspect that we will be again come 10 o’clock. She has sat through all five days of the Committee stage and all of today, and no doubt she will sit through tomorrow’s debates on remaining stages.

The hon. Lady should understand that many colleagues are frustrated that they have not had a chance to make certain substantive points, and they will be frustrated by the Bill when it leaves the House. That is a metaphor for what will happen when it abolishes the public inquiry. She and many colleagues are frustrated, and some Members shouted “Disgraceful” when the last Division result was announced. Citizens around the country will be shouting “Disgraceful” when the boundaries are changed without their having a chance to argue their case before the boundary commission. Their only option will be recourse to judicial review, which will make lawyers rich and citizens poorer.

I thank my hon. Friend. [Interruption.] I hear the chuntering from those on the coalition Government’s Front Benches—it is funny how soon some people become arrogant. The Government should test my hon. Friend’s proposition. It would be easy: they could have a public inquiry to test whether my hon. Friend is on a frolic of his own or whether his constituents share his concerns about what the changes will bring. Why are the Government running away from local public inquiries?

I am very concerned about the points made by the hon. Members for Blaenau Gwent (Nick Smith) and for Ogmore (Huw Irranca-Davies). Does the shadow Minister agree that they cannot possibly be arguing that they are so inefficient and ineffective as Members of Parliament that they cannot cope with more than one local authority? I am sure they are not. For goodness’ sake, we all have to cope with different layers of local government. The hon. Member for Ogmore is wrong to say that he is any way accountable to local authority chief executives—that is simply nonsense. Such arguments have nothing whatever to do with this debate and do not hold water.

With respect, may I tell the hon. Lady why she is wrong? My hon. Friends’ constituents will have their lives changed because they will have to deal with different people as a result of the boundary changes. Those changes will be made not to make things more efficient, or to save money, but because the system has, for partisan reasons, been based just on numbers. An MP’s ability to do his or her constituency a service will be affected. More importantly, however, a constituent’s ability to contact the person he or she needs to contact to improve things will also be affected.

I rise to speak to amendments 194 and 195. Before I address them specifically, however, I shall comment on one of the amendments tabled by members of the Select Committee, with which I have a fair degree of sympathy. I must express my slight reservation, however, about the wording of proposed new subsection A2(a) in amendment 205. I am worried that, by asking a boundary commission to publish the criteria it would use in the splitting of wards, we could end up inviting the commission to split wards more than we want. The Bill proposes that wards should not be split, and I think that most Members agree that local government boundaries should not be split. I am worried that that proposal could result in more wards being split than people would want. I would still support that amendment on a vote, however.

Amendment 195 deals with the Government resisting all attempts to keep local inquiries as a general option. Under my proposal, at least Northern Ireland would be allowed the option of holding a general regional inquiry in relation to all the seats in Northern Ireland. This proposal is a fall-back measure.

I want to make it clear that I absolutely support the amendments that would preserve the opportunity of holding local inquiries throughout the United Kingdom. The right hon. Member for Tooting (Sadiq Khan) made a powerful speech in support of preserving inquiries and their important role. I know that other colleagues will propose other amendments to preserve inquiries.

I thought that the hon. Member for Epping Forest (Mrs Laing) was quite disparaging about the role of inquiries, submissions and contributions to inquiries. First, where political parties make shallow, self-serving submissions about boundaries and where specious and spurious claims of local identity and local interests are made, there is no better way of exposing them than local inquiries. By their very nature, local inquiries expose, counter and introduce other realities.

The hon. Lady’s speech was about the rule of arithmetic, and I agree that this is what the Bill is about—the tyranny of arithmetic for boundaries in the future. She says that it does not matter. For her, traditions do not matter; local conditions do not matter; identity does not matter; community does not matter—it is all going to be driven by a numerical imperative that says “one size fits all” and nothing else can be considered. An official of the European Commission would be proud of that mindset. It is exactly the mindset that the hon. Lady usually criticises in the European Commission. As well as backing the “IPSA-fication” of boundaries in the future, she is now backing a European Commission standard that says, “No, we just deal in numerical arithmetic; we see only one size fitting all; we make no concession to local realities or local conditions.”

I rise to defend myself, because that is not at all what I said. On the contrary, communities and local traditions are very important. It is important to have a parish council representing a village and to have Cornishmen feeling Cornish and caring about Cornwall—nobody is changing Cornwall. It is very important to respect local history and the feelings of local communities. That is not reflected in the boundaries of parliamentary constituencies. There are many other ways in which those traditions and communities are respected, observed and upheld. It is not in the boundaries of parliamentary constituencies—

The hon. Lady said that nobody ever listens to a word she says. I have to say that that is not entirely the case, because I remember in Committee of the whole House she very eloquently put forward the views of the Select Committee that the Government should not be able unilaterally to change the views expressed by the boundary commissions before presenting them to Parliament. We listened to what she said on behalf of the Select Committee, and we have tabled amendments to put that into effect; they will be debated in due course.

I am grateful to the hon. Lady. The Select Committee has done a very good job in raising some important issues.

Amendment 205 would add a stage to the consultation process that the boundary commissions are required to carry out for the purposes of the review. Prior to making recommendations, the commissions would be required to publish online their proposed approach to the application of the rules and factors. A consultation period of eight weeks would follow, and the commissions would be required to take the results into account. We have set a deadline of October 2013 for the commissions to report to allow parties, administrators and electors to adjust to the new boundaries prior to the general election in 2015.

An increase in consultation time of eight weeks could delay the reports, making it harder to prepare for the next general election. In effect, the time added to the process by the amendment would be much greater, as the commissions would have to publicise their proposed approach and assess the representations received before taking the many and complex individual decisions required to put together their recommendations. The Government believe that the right place to debate the approach that the boundary commissions must take is in Parliament. The importance of that is highlighted by the fact that the Bill had its Committee stage on the Floor of the House. The boundary commissions will carry out the review according to Parliament’s wishes, as has always been the case.

In any event, I do not consider that the commissions’ general approach, divorced from the resulting recommendation for particular constituencies, is a subject on which wide consultation is appropriate. It is the effect of the recommendations on a person’s local constituency or local area on which it is important for them to have a say, and the Bill increases the period for them to do so. Consultation on a general approach is likely to lead to many responses that are based not on genuine concern about the approach but on guesswork as to what the effect of that approach might be in a local area. But until the commission has taken all the many individual decisions necessary to formulate its recommendations, it will be impossible to predict the effect on a particular area.

I hope that it will reassure hon. Members that during the previous review the Boundary Commission for England produced a booklet prior to the publication of recommendations which gave information about the review. There was also extensive use of the commissions’ websites to inform interested parties about all aspects of the review.

Amendment 206 proposes a new set of publicity and consultation rules under clause 10. I hope to reassure hon. Members who tabled the amendment that it is not necessary as it reflects the practice that the boundary commissions are likely to follow in any event. The boundary commissions made extensive use of the internet in publicising the last general review and, although it is for them to decide, I am confident they will do likewise this time. The information that they published at the time of their recommendations included the electorate figures mentioned in the amendment.

I believe that it is important to allow the boundary commissions discretion to present their recommendations and relevant accompanying information as they think best, taking into account the particular circumstances with which they are dealing and the changing way in which people obtain information and communicate. On that basis, while I do not disagree with the principle underlying the amendment, I do not agree that it is desirable for the Bill to particularise the commissions’ practice in legislation to the extent that the amendment proposes.

The amendment would also expressly allow representations to be made by people within or outside the affected constituency. That is presently the case, and the Bill does not change that. New section 5(1)(b) of the Parliamentary Constituencies Act 1986 follows the existing section 5(2) in that respect. The boundary commissions are likely to publish recommendations for a number of constituencies together as a scheme, and the proposals for one constituency will undoubtedly affect those for others. It is important that interested parties both from within a proposed constituency and from neighbouring constituencies may make representations to the commissions for alternative schemes that work within the rules, and the Bill does not prevent that from happening. While I understand the concerns of the hon. Member for Epping Forest, it is not necessary for the wording that appears in the amendment to be in the Bill. On that basis, I hope that she will feel able to withdraw the amendment.

I now turn to more general points about local inquiries. It was interesting to listen to the right hon. Member for Tooting (Sadiq Khan) outline the Opposition’s case. I am glad that in this evening’s debate, we have not heard local inquiries described as appeals, because of course they are not. They are part of the process of information gathering, listening to the views of local people and weighing them up as part of the due process.

The process suggested in the Bill maintains that principle. Indeed, it actually extends it. It is vital that the boundary commissions fully consult all interested parties on proposals for changes to constituency boundaries. We all accept that. Local people in particular must be able to have their say. However, the Government believe that it would be a mistake to imagine that local inquiries achieve that objective, and there is independent support for that view. The Bill abolishes them for three major reasons. First, we simply must speed up reviews.

I beg to move amendment 234, page 7, line 17, at end insert—

‘(5AA) The draft of an Order in Council laid under subsection (5A) above may only give effect to the recommendations contained in all four reports under subsection (1) above with modifications, where those modifications have been made with the agreement of the Boundary Commissions.’.

This amendment has been tabled in the names of members of the Select Committee on Political and Constitutional Reform. The Chairman of the Select Committee, the hon. Member for Nottingham North (Mr Allen), is sadly unable to be in here this afternoon and so I have undertaken to move the amendment on behalf of his Committee.

The Select Committee, as the Committee well knows, carried out a necessarily brief and swift but in-depth consideration of the Bill. In order to try to be helpful to the House and the Minister, we tabled several amendments that we believed ought to be considered and that we hope will improve the Bill. The purpose of amendment 234 is to reflect paragraph 139 of the Select Committee’s recently published report, which states that

“the power of the Executive to depart from the recommendations of an independent statutory body should have clear statutory limits to prevent abuse for partisan advantage.”

I am sure the Committee will agree that that is a matter that ought to be drawn to the attention of the Minister and of hon. Members.

I ask the Minister where the justification lies for the Government’s retaining such a wide-ranging power to depart from the Boundary Commissions’ recommendations. Although I would assert that I have every confidence—as does the Select Committee—that the current Government would always act in this matter in an honourable, straightforward and democratic way, may I nevertheless ask the Minister on behalf of the Select Committee what safeguards exist against any future Government’s misusing such a power to their partisan advantage. It would be helpful if the Minister would consider those questions, and I am sure that the Committee will be eager to know the answers.

First, let me briefly comment on the fact that before you took the Chair, Mr Hoyle, we had a former miner in the Chair and two Tellers who were also former miners, so, as the MP for the Rhondda I felt quite at home. But that has absolutely nothing to do with the amendment, I am afraid.

The amendment has been charmingly moved by the hon. Member for Epping Forest (Mrs Laing), who is absolutely right. This is an issue that I have tried to raise on several occasions—

The hon. Lady has been in government so she knows the constraints within which we work.

I am very sympathetic to the views expressed in the amendment, and we will have to look at it further. That is not an attempt to fob off the hon. Member for Epping Forest or the Select Committee. It raises an important issue. I do not want there to be any circumstances in which a Government can apply a partisan consideration to a modification for a boundary commission response. I give a clear undertaking that the Government will consider the matter in detail and come back with a response in due course. I ask the hon. Lady to withdraw the amendment on the basis that we will look at the matter further and that we are grateful to the Committee for having brought it to our attention.

I thank the Minister for the serious way in which he has considered the amendment.

I appreciate the position taken by the hon. Member for Edinburgh East (Sheila Gilmore), but the Select Committee has not suggested that the proposals in the Bill avoid due process. I would argue personally, not necessarily on behalf of the Committee, that the proposals in the Bill do involve due process, but that that is not a matter which hon. Members should worry about. That is not the problem before us right now—the problem is simply whether the Government could, at some point in the future, take action without the agreement of the boundary commissions. I am pleased that the Minister has accepted that that is an issue. Every member of the Select Committee will be very pleased that its work has, at least in this respect, been seen to be worth while and contributing to improving the Bill, which was our purpose in submitting the amendment. Having heard the general arguments put this afternoon, including by the shadow Minister, I believe that it may have to be tightened up somewhat in its wording and technicalities.

I am delighted that the Minister has indicated that the Government will look in more detail at the matter and undertaken to come back to the House with it. Given that assurance, I beg to ask leave to withdraw the amendment.

Just one moment.

I know that the constituency of the hon. Member for Corby (Ms Bagshawe) contains many people with Scottish ancestry, but I do not think that she is entirely versed in the dangers of nationalism that exist in Scotland and Wales. I merely say to her, in a gentle way, that if she really wants to maintain the strength of the Union, we ought to proceed differently.

This is what I meant by the double- whammy element. Wales is caught both by the equalisation of the number of seats—we are not debating that now, but we will when we deal with the next set of amendments—and by the reduction in the number of seats. The net effect for Wales is that the number of seats will be cut by a quarter.

That presents some specific problems for Wales. It has already proved impossible for the present Government to ensure that the Secretary of State for Wales represents a Welsh seat—although I admit that she is Welsh—and it will become increasingly difficult to do so in the future. Because Wales, unlike Scotland, has never had a separate legal system, the Welsh Affairs Committee has to do a large amount of work, and that will continue. I think that it will be difficult to meet those needs with only 30 seats.

I am not arguing for the status quo in the number of Welsh seats. I am merely trying to present an argument, and I am sorry that it does not appeal to the hon. Gentleman. I hope that further elements of my speech will appeal to him more.

No one is a more ardent Unionist than I am, and I fully understand what the hon. Gentleman is saying about Wales, but he must look at the arithmetic, which is inescapable. There will be a larger reduction in the number of seats in Wales than, proportionately, in the rest of the United Kingdom because, at present, the people of Wales are over-represented in the House, as well as having a devolved Assembly, or Parliament, of their own. The hon. Gentleman cannot argue that it is right for the people of Wales to have smaller constituencies and more Members of Parliament in the House of Commons than the people of most of England and Scotland. That simply does not make sense.

As the hon. Lady knows, there are differences between Wales and Scotland: Scotland has a Parliament which also has powers over crime and justice, which Wales does not have; Scotland has a completely different legal system, which Wales does not have; and it raises taxes, which Wales cannot do. It is a very different system, therefore.

Let me reiterate yet again that I am not saying that we want to hold to the status quo, but I think there will be a danger for the Unionist argument in Wales if we move forward in one fell swoop from having 40 seats to there being only 29 or 30. That would create problems for the future. Let me also say that I hope that Welsh Members work sufficiently hard that they provide value for the House, even though the hon. Lady thinks there are too many of us.

The bigger the size of the constituency and the electorate, the harder it is to represent them adequately. It may be that evening up constituencies leads to areas being more adequately represented, because those areas will have smaller constituencies, but in my case it will mean a bigger constituency, and many of us are struggling to do the job now.

For example, the amount of mail is increasing all the time. Not so long ago, I read the biography of Hugh Gaitskell by Philip Williams, which was about Gaitskell in the 1950s. It said that Gaitskell’s papers showed that in 1958, when he was the MP for Leeds South East, he got 50 letters a month from his constituents. I get 50 letters every couple of days, and that is in addition to all the e-mails, surgery visits and stoppings in the street in Grimsby, with people asking whether I will ask this or do that, and so on, all of which I have to scribble down. That must mean that in a larger constituency it is more difficult to serve everyone in it. That is an obvious fact. Indeed, it is getting difficult to do the job adequately with 650 Members. We need more and more staff. Fortunately, we have been given more staff, but it is not enough, although it depends on the seriousness with which one does the job.

I thank the hon. Gentleman for giving way. Nobody could do the job more seriously than he, but right at this moment he is representing his constituents in that other way. He is once again confusing his job—the job of us all—as a social worker, providing pastoral care and advice, with the job of representing our constituents as part of the democratic process. He cannot possibly argue that a man of his calibre, or the calibre of anyone sitting in the Chamber right now, cannot cope with a few thousand more constituents to represent.

The hon. Lady asks an excellent question and I shall give her a precise answer: Parliament should do so on the same basis on which it has been done before. The principle previously and now, unless this rotten Bill, particularly this part of it, is made into law, is that the House sets an ideal target, but that the Boundary Commission independently determines the boundaries within which each Member will sit using a set of criteria that relate to the history of the country, the four nations, the history of England, locality and the nature of our democracy. But that principle will be thrown out by the Bill. With the Great Reform Act, there were riots in Nottingham and years of deliberation before the Act was passed and changed the principle to one of participatory democracy and the wider franchise. Are we to break that principle after a couple of days of truncated debate in the House? Are we to have a principle, which could stand in perpetuity, of having a fixed number of MPs? The idea that we would do that is a disgrace to the House and to the traditions of our democracy.

This principle is important and the consequences are great, so let me illustrate them. I have none of the fears that the hon. Member for Christchurch (Mr Chope) discussed about the precise boundaries in my area. The boundaries were changed in the last election and my majority went up against all the predictions, so I have no fears about any such change or about who will come in and who will go out.

Of course, my constituents would strongly resist the notion that, having built a relationship with one Member of Parliament, good or bad, they should not have the opportunity to re-elect or dismiss that Member of Parliament. That principle is enshrined in our democracy, but it is endangered and partly thrown away by the arbitrary nature of setting a mathematical equation to determine the numbers. My constituency boundaries are a good example of how that would destroy the traditions of England and English democracy.

Ministers laugh at the fact that the county of Nottinghamshire, the seat of Bassetlaw and the electoral representation in Bassetlaw and Nottinghamshire have been set over the centuries, not in a few minutes or a few hours’ debate, but by the very nature and history of this country. Do hon. Members know why the seat of Bassetlaw was created? Because it was a road through the forest and a route through the country. That is why Robin Hood was robbing in such places. The history and geography of this country, going back hundreds and thousands of years, have produced the shire counties.

Should my constituency’s boundaries be changed arbitrarily? My situation is not unique, but it emphasises the nature of an arbitrary mathematical solution. My current boundaries and electorate are about the mean—it is not a small constituency—but a change to the south, which is precisely what has happened before, would be a change within Nottinghamshire. One bit goes in; one bit goes out. That is how the Boundary Commission has done its work over the decades. That is reasonable. It makes its decisions. I disagreed with the last one, but that is democracy: an independent body, not politicians, heard representations and made its decisions on the basis of trying to maximise equality between the seats in Nottinghamshire. That is why that change took place. Any change to the north would take us across a regional boundary—Ministers will not be bothered about regions—and a county boundary as well, into Yorkshire. I have nothing against the people of Yorkshire. That is where I come from. I am sure that I would be as popular there as I am in Nottinghamshire, so that is not the fear.

I deal with Nottinghamshire county council, Nottinghamshire police and Bassetlaw council in Nottinghamshire. The fear of the elected Member is that if we had to move over to an arbitrary base of different councils and authorities, however they are formulated by whichever Government are in power, we would be looking in different directions at once and the role of MPs in advocating for and representing their constituents would be significantly diminished.

It is not just the boundaries with Yorkshire that could be changed; there could be a change to the east, in which case we would go into Lincolnshire, perhaps into North Lincolnshire or West Lindsey council—again, entirely different local government, police and health set-ups. Of course, if the boundary was changed to the west, we would go into Derbyshire, yet another county and yet another set of police and fire authorities.

All that illustrates the point that if we do not attempt, in any system, to try to maintain as much as we can the integrity of the English counties and a direct relationship with local government, however it is structured, the role of the MP and the credibility of Parliament are diminished. That is the weakness in arbitrary mathematical equations, and it is why we all know that the Boundary Commission is in reality horrified by the notion that it would need to use some kind of mathematical equation, because the criteria that it has used over the decades have been proven. They are transparent and challengeable in the courts if anyone wants to challenge them—people have occasionally tried to do so. They are tested in the courts and they are good and rational. Each party might occasionally object to the conclusions and MPs might feel that we have been badly done by, given the nature of the change, but the process is democratic. That fundamental principle is being changed.

I thank the hon. Gentleman for that point. It is extraordinary to have begun this process without thinking about the interrelationship between this place and the other place. One does not have to be a Newtonian to think that for every force there is an equal and opposite counter-force. [Interruption.] I am hearing more and more sedentary comments from the Deputy Leader of the House; I do not know if that is the usual form from him.

One would have thought that all these things would be pulled together in an overarching Bill that had some degree of intellectual credibility in terms of the British constitution and the role of this place and the other place. Instead, we have an arbitrary figure of 600, and meanwhile many more people are being placed in the House of Lords. The international comparisons steadily fall away when we think about the federal structure of many other European nations, local rates of representation in many other European nations, the interrelationship between the two parts of bicameral Parliaments, both nationally and internationally, and the role of Members of Parliament today in terms of the volume of work that they do.

The move from 650 to 600 will be an extraordinarily speedy process. I have had the great pleasure of sitting with some other Members present in the Chamber on the Political and Constitutional Reform Committee, and we have heard time and again from independent witnesses, scholars and constitutionalists that the speed of this process is unacceptable and will lead to mistakes. Lewis Baston, from Democratic Audit, said to the Welsh Affairs Committee:

“I am concerned about the speed with which this is being brought through. It seems to be an absolute priority to get the new boundaries in place for 2015, rather than to get them right and to consider some of the principles involved. I would much rather we did this properly.”

Many Members share that view.

Above all, the problem with the arbitrary collapse from 650 seats to 600, as my hon. Friend the Member for Bassetlaw (John Mann) so eloquently and brilliantly enunciated, is the total absence of sentiment or feel for the nature of either the United Kingdom or the British constitution. The UK is not something to be placed under a slide rule and arbitrarily cut up on the basis of a figure of 76,000. There are interrelationships of complex formations between Wales, Scotland, England, the Isle of Wight, the Isles of Scilly and the historic Duchy of Scotland—[Interruption.] Or Cornwall, even.

It surprises me all the more that the move from 650 to 600 is being driven by the Conservative party, which I had always thought was interested in tradition, identity, locality and community rather than in utilitarian butchery of the historic constitution of this country. We have been here before; one would have thought that the Conservative party might have learned the lessons of Edward Heath, but it seems to be intent on repeating them. The grotesque local authority rationalisations of the mid-1970s were done on exactly the same principle of utilitarian Benthamite thinking, with no feel for locality or historic identity. People did not like them and rebelled against them. The Bill has blown apart the “big society”, because there is no sense of locality, identity or tradition in it. Instead, it is rampant Cromwellian statism.

I believe that the reason for the arbitrary figure of 600 is simply that it is a big round number, and the Government thought it made sense. I suggest that this place deserves slightly more thought to be given to that matter. The arbitrary move to 600 was not in the manifesto of either of the governing parties, and it has no popular mandate. As a result, I am more and more convinced that the other place has no obligation to adhere to the Salisbury convention and pass the Bill. There is no popular mandate for the change, so we might lose temporarily in this House, but I hope the other place will help us win the war—even as the Government, shamefully and against the constitutional principles of this country, continue to pack it.

It is a great pleasure to follow the hon. Member for Stoke-on-Trent Central (Tristram Hunt), who is my colleague on the Political and Constitutional Reform Committee. I disagreed with almost everything he said, but he almost had me persuaded when he talked of Benthamites and Cromwellian statism. I am not a Benthamite, and I am not a statist, but—[Hon. Members: “Come over here!”] No, there is more coming. His argument was the most powerful and coherent that we have heard this evening. However, one point was missing, which was the integrity that equalising seat sizes and constituencies will give this place.

Only two issues really matter in relation to this group of amendments, although we have heard much special pleading, not from the hon. Gentleman but from other Members who are clearly concerned about their own constituencies and positions and how their political future might develop if these changes are made to the constitution. That is not what we should be discussing. We should be discussing principle, as the hon. Member for Stoke-on-Trent Central just did.

I cannot resist the hon. Gentleman’s sedentary comment. I believe that there is something about 666, though I am not an adherent to that principle either—for me, it goes with Benthamism. I am therefore glad that we are not discussing 666, but why not 600? It is a reasonable, round number. We have to choose a number for Members of Parliament. [Hon. Members: “No, we don’t.”] I am arguing that we have to choose a number; that it is correct for Parliament to do so. We have talked much about the Great Reform Act of 1832, but the subject of how many Members there should be has not been properly discussed for a long time.

The hon. Lady speaks about principles. Should it not be a principle of the measure, since it proposes a change in our constitutional arrangements that is unprecedented in modern times, that at least some public consultation and cross-party discussions take place before anything comes before the House?

This is a cross-party discussion. We are all here in the Chamber having an open, cross-party discussion. There has not been very much time to consider the Bill, but there have been several months. The Select Committee on Political and Constitutional Reform has examined it, and we have all received e-mails, letters, papers and so on from people around the country who are concerned one way or the other. There has been consultation—that is why we are here. The debate that we are holding at this very moment is consultation. It is right that we have that discussion, and that the House makes a decision about numbers.

I put it to the Committee simply that 600 is a perfectly reasonable number. It is hard to argue against it unless one is doing special pleading on behalf of one’s constituency or county. The hon. Member for Stoke-on-Trent Central spoke eloquently about our country’s development, traditions and communities. Communities and traditions develop once boundaries are drawn. My constituency has a part in the north and a part in the south that have little in common with one another, although they are not far apart. However, they join together as a constituency and a district. If another part comes in or goes out, that becomes the community. Communities evolve, and nothing in the Bill will destroy the traditional counties of England.

I thank the hon. Lady for being as gracious as ever in taking interventions. Obviously, she and her new-found Liberal Democrat friends are passionate believers in localism. How does not holding public inquiries and arbitrarily forming constituencies sit comfortably with her idea of localism?

I share the hon. Lady’s concern about democracy. I am the only Labour Member of Parliament in Berkshire and I have substantially more constituents than any other Berkshire Member, so I cannot be accused of special pleading. However, if the ambition is to get equal-sized constituencies—I share the hon. Lady’s belief in that principle—would not it be better to do it in a way that respects local communities, and to do it slowly, over time, thereby producing the number? I suppose the Conservative party would normally describe that as “evolving.” Would not that be preferable to—to borrow a phrase from my hon. Friend the Member for Stoke-on-Trent Central (Tristram Hunt)—the Cromwellian hatchet that cutting 50 seats constitutes?

I agree in principle with everything the hon. Lady says, but I would argue that three years is quite sufficient time for the Boundary Commission to undertake the task before it. The decision on the principle of the work going ahead can be taken in the Chamber over these few weeks of discussions on the Bill, and three years is quite long enough for the commission to do its work. The hon. Lady agrees with me on the principle of equalisation. Once a principle is established, it ought to be put into practice as soon as possible. Three years is plenty of time.

The hon. Lady says that 600 is a reasonable figure in the same way that the Independent Parliamentary Standards Authority asserts that the figures it comes up with are reasonable. The problem is the rigid application of that reasonable figure, which will give rise to all sorts of problems and contradictions for which this House will be blamed.

I have been insulted many times in this Chamber, but I have never, ever been compared with IPSA before. I entirely disagree with the hon. Gentleman. There is proper consultation. Opposition Members speak as if the Boundary Commission is not involved in the process, but it is, and it has three years to do its job. It is perfectly capable of doing that job. The resources are in place and there is no problem.

I am fascinated by the hon. Lady’s new-found passion for quangos, which is perhaps a good description of the Boundary Commission, because it is unelected. However, does she accept that crucially, the Government are removing the public inquiry and the right of local people to give their input when the Boundary Commission has produced a report? That is not liberal or democratic, and it is not in the finest traditions of the Conservative party.

I understand the hon. Gentleman’s argument, but with respect, he is wrong. Very few local people made representations to boundary commissions in the last review and the previous one; most representations were made by political parties.

In that case, will the hon. Lady explain why somebody might have said this at the Oxfordshire boundary inquiry in 2003:

“Somebody might take the view that…there are already too many Members of Parliament at Westminster. They may take the view, depending on what happens in the European constitution, that Westminster has less to do, with less MPs – I certainly hope that is not the case”?

That was the right hon. Member for Witney (Mr Cameron).

I am sure that my right hon. Friend meant what he said. I do not disagree with him—what he said is fine. The hon. Gentleman is forgetting that we are talking about an evolving political situation and an evolving world. As other hon. Members have said, the whole situation is evolving, which is why it is time for the House to look at itself, count its numbers and consider what is right.

The hon. Member for Great Grimsby (Austin Mitchell) and I had an exchange yesterday on alphabetical preferences on ballot papers, which is relevant to the proposal for 600 MPs. I am no longer concerned about alphabetical preferences. Since yesterday, when he said that he could call himself A1 Austin and I could call myself Mrs Aardvark, I am pleased to tell him that I have received, by e-mail, a proposal of marriage from a Mr Aaron Aardvark. I had to decline that kind proposal because I could not possibly involve the poor gentleman in the expense of marrying me in order to improve my electoral prospects. That would be gerrymandering and manipulation of the system beyond the call of duty. However, it was a helpful discussion.

The real principle before us this evening is one vote, one value. That is what democracy is all about. Every Member who is elected to this House should be elected by an equal number of voters, at least potentially—[Interruption.] Of course we have a tolerance level of 5%.

I should not respond to sedentary interventions, but we are not talking about turnout, as hon. Members know. We are rather more sophisticated than to go down to that level. Potentially, every Member should be elected by an equal number of voters.

Nobody really disagrees with the point about equal-sized constituencies. What we are looking forward to hearing from the hon. Lady is an argument about why we need to reduce the number of seats from 650 to 600, other than that she likes the number 600. That is the only reason that she has given us. I like the number 650, and I will make an argument for why it should stay at that. I need an argument from the hon. Lady as to why it should be reduced to 600.

Why should it be 650? Why should it not be 700 or 542? Pick a number out of the hat, or do the lottery. Six hundred is a perfectly reasonable number and as good as any other number—[Interruption.] It is a workable number, and it is also reasonable to reduce the size of the House in the interest of a more efficient democracy.

We have to be within a 95% to 105% range, and that may be reasonable, but some exceptions apply, including my constituency, the western isles and Orkney and Shetland. Can my hon. Friend explain what it is that makes the latter two right and mine wrong?

I am glad to say to my hon. Friend that it is not for me to answer that question, but I will give him my opinion, which counts as nothing more than that. We should achieve real equality and I do not think that we should have exceptions for Orkney and Shetland and the western isles. If we are having a simple arithmetical equality, we should stick to it.

No, I have spoken for long enough. It is important to stick to equality. Once that principle is accepted, it should be adhered to. Of course, we need to have a 5% tolerance for the sake of practicality and because the Boundary Commission must be able to apply the rules reasonably, but we should stick to equality. This House is about looking at the politics and the principle, not about special pleading for particular constituencies and particular Members and their convenience. I urge the Committee to accept that 600 is a perfectly reasonable number and that equalisation—one vote, one value—is the important democratic principle.

Listening to this debate, one would think that something major and radical was happening to our parliamentary system. In fact, what is being proposed is an extremely modest change, which I welcome, because more radical change would be unwelcome to most Members of the House. We have heard a number of Members talk about boundary commissions and history, but the Boundary Commission is only a post-war invention. It is something that our country can be proud of, because it tries to draw boundaries in a neutral way, while taking into account local interest.

If we were to do what the right hon. Lady has just proposed and were to end this Session in May next year, we would have to guillotine all the Bills in the programme, and I suspect she would be the first to object if we were to rush the programme through on that timetable. Secondly, I laid a written ministerial statement before the House; I did not make this announcement on the “Today” programme, which is something that we grew used to in the last Parliament. I think the right hon. Lady should welcome the extra time that is now being given to this year’s legislative programme, which contains some serious Bills and which will now get enough time to be debated.

May I also just remind the right hon. Lady and other Front-Bench Members of what they did when they came into office in 1997? Without any consultation or discussion, they told the House they were changing the frequency of Prime Minister’s questions from twice a week to once a week. We should contrast that with the 18-months’ notice I have given of this proposal, which is also subject to the passage of a Bill.

Is the Leader of the House encouraged by the synthetic anger of Opposition Members, who have had 13 years of losing control of Government business, guillotining Bills and not giving anything like enough time to consider important business? Will the Leader of the House confirm that when we come to the Committee stage of the Fixed-term Parliaments Bill, which we are about to discuss on Second Reading, the House will be able to examine the proposals he has just made in greater detail, thereby ensuring that the right balance between the Government and the House is maintained?

I am grateful to my hon. Friend for her support, and she is right to point out that there will be more time to debate important constitutional reform under this Government than there was under the last one. Her point about raising this matter during the passage of that Bill is also a good one, and it was heard by both the Ministers who will be responsible for the Bill’s passage and the Members who will be speaking on its Second Reading. I know that they will want to address the concerns she has just mentioned.
