Insurers make commercial decisions about the terms on which they will offer cover following an assessment of the relevant risks. However, the Government is determined that insurers treat customers fairly and insurers must comply with the relevant legislative and regulatory rules.

The Financial Conduct Authority’s rules require insurers to treat their customers fairly and the FCA has robust powers to act against firms that do not comply. The UK Government is also committed to tackling discrimination and the Equality Act 2010 providers legal protections from discrimination due to protected characteristics. This means insurers cannot use ethnicity as a risk factor when determining the price of insurance.

Customers who feel they have not been treated fairly by their insurer are able to complain to the Financial Ombudsman Service, the independent body established to provide arbitration in such cases.

End-to-End Rape Review

To ask the Secretary of State for Justice, whether he has made an assessment of the potential merits of expanding the Rape Review Action Plan to include all cases of sexual violence.

The 2021 Rape Review Action Plan set public ambitions to return the volumes of adult rape cases being referred by the police, charged by the CPS, and going to court back to at least 2016 levels. We have exceeded each of these ambitions ahead of schedule.

The Rape Review intentionally focussed its efforts on the system’s response to adult rape, acknowledging its unique and complex nature to investigate and prosecute, as well as for the harm it causes to victims. That being said, improvements delivered through the Action Plan will also have wider benefit for the justice system’s response to other sexual offences.

For example, we have recruited 20,000 extra police officers and are providing specialist rape and serious sexual assault training to 2,000 officers, making sure the police have the skills to investigate these crimes. We have rolled out pre-recorded cross examination for victims of sexual and modern slavery offences nationally, sparing victims from the glare of court and helping them give their best evidence. We are also quadrupling victims funding by 2024/25, up from £41 million in 2009/10, enabling us to increase the number of Independent Sexual Violence and Domestic Abuse Advisors to around 1,000 by 2024/25.

More widely, the Government’s 2021 Tackling Violence against Women and Girls strategy set out our plan for improving the system wide response to VAWG. We have delivered on the vast majority of the actions set out in the original Strategy and continue to make important strides, including the first successful prosecution for cyber flashing resulting in a custodial sentence (March 2024); bringing into force the provisions in the Online Safety Act (January 2024) including new intimate image abuse offences; and putting a new duty on employers to protect their employees from sexual harassment via the Worker Protection amendment of the Equality Act 2010.

Colombia: War Crimes

To ask His Majesty's Government what plans they have, if any, to support the Colombian Ministry of Equality and Equity, particularly pertaining to its work on reparations for victims of sexual and gender-based violence during conflict.

Colombia is a Preventing Sexual Violence in Conflict Initiative (PSVI) and Women, Peace and Security National Action Plan focus country. Colombia is current chair of the UK-founded International Alliance on PSVI, a key forum for coordinating global action on conflict-related sexual violence. The UK contributed to the opening of a landmark case to address sexual and gender-based violence (SGBV) from the armed conflict in the Special Jurisdiction for Peace (SJP), the authoritative transitional justice body providing reparations to SGBV victims. We continue to support this work, as well as assistance to victims and survivors seeking access to justice.

The Government has no plans to introduce a statutory right for disability support leave for disabled employees.

All employers already have a duty to make ‘reasonable adjustments’ in the workplace where a disabled person would otherwise be put at a substantial disadvantage compared with their colleagues. The Equality and Human Rights Commission (EHRC) is responsible for enforcing the Equality Act and providing guidance on reasonable adjustments.

For disabled people who require adjustments which are beyond reasonable adjustments, Access to Work (AtW) can provide a grant for the disability related extra costs of working a disabled employee may face. To support employers an AtW case manager will contact the customer’s employer ahead of making an AtW award to offer advice on reasonable adjustments an employer can provide and the support available under the AtW scheme.

The Home Office is committed to the continuous review of the NRPF policy and officials are working with a wide range of stakeholders, including other government departments, the devolved administrations, and third sector organisations to develop a greater understanding of how children are directly and indirectly affected by parents / carers being subject to an NRPF condition.

The Government published an overarching Equality Impact Assessment on the Compliant Environment measures, of which the No Recourse to Public Funds (NRPF) is part. The Higher Education Statistics Agency (HESA – now part of Jisc), is responsible for collecting and publishing data on the UK’s higher education (HE) sector. The latest published statistics refer to the 2021/22 academic year.

The department holds individual-level HESA data for all HE students in each academic year from 1995/96 to 2021/22. From 1998/99, the students are able to be identified by name.

The HESA data includes information on student’s disability status, religion or belief, gender identity and sexual orientation, although, gender identity, sexual orientation and religion or belief (for English, Scottish and Welsh HE providers) were not collected prior to 2012/13. Note that gender identity differs to biological sex which has been collected across all academic years since 1995/96.

The estimated figures below are derived by counting every student that started a HE course in the UK since 1999/2000, as well as the total number of enrolments (entrants and continuing students) in the academic year 1998/99. The figures exclude students with a missing first and last name, but includes students who are not part of the standard registration population. Therefore, these figures will differ from HESA’s publications. Additionally, students that disclose sensitive characteristics for the first time in any year after their first year of study are not counted under the estimated number of students with known sensitive characteristics, and students that have started more than one course since 1998/99 are counted once for each enrolment.

The department is estimated to hold the names of 28,927,337 students that started a HE course in the UK between 1998/99 and 2021/22. For 27,424,867 of these names, the department holds information on at least one of the following sensitive characteristics - disability status, religion or belief, gender identity or sexual orientation.

Of the estimated 28,927,337 names held by the department, 27,373,886 (95%) of them have a known disability status, 7,403,109 (26%) have a known religion or belief, 6,164,770 (21%) have a known gender identity and 6,388,972 (22%) have a known sexual orientation.

While individual identifiers are retained by the department for matching purposes, at all times the department will minimise the processing of, and access to, instant or meaningful identifiers. Access to named data within the department is restricted to a small number of data professionals with responsibility for matching this data with other sources and creating pseudonymised, or aggregated, versions of the data which are subsequently used for research and statistics.

To ask His Majesty's Government what progress they have made in implementing the three year delivery plan for maternity and neonatal services, published on 30 March 2023.

NHS England is making good progress in delivering its Three year delivery plan for maternity and neonatal services, a copy of which is attached. The plan is backed by £186 million of funding per year from April 2024, which sets out how maternity and neonatal care will be made safer, more personalised, and more equitable for women, babies, and families.

For example, many local maternity and neonatal systems have published Equity and Equality Action Plans to tackle disparities in outcomes and experiences of maternity care at a local level. NHS England has published new guidance for general practitioners on the 6-8 week postnatal check, all parts of England have begun rollout of perinatal pelvic health services and 39 maternal mental health services have been established.

All trusts are implementing the third version of the Saving Babies Lives Care Bundle which provides maternity units with detailed guidance to reduce stillbirths and neonatal deaths.

NHS England’s Digital Maternity Fund has awarded 128 funding bids to support the digitisation of maternity services across England and NHS England have established a new data taskforce to better detect and act sooner on safety issues.

Finally, to increase neonatal cot capacity, £45 million of capital was allocated across several providers to deliver an overall increase of more than 50 cots.

As of 25 April 2024, 39 out of 42 integrated care boards (ICBs) have published Equity and Equality Action Plans. NHS England’s regional teams are supporting the remaining ICBs to publish their plans.

NHS England has provided more than £20 million in funding to local maternity and neonatal systems (LMNS) each year to lead improvement of maternity and neonatal care around objectives set out in the Three year delivery plan for maternity and neonatal services, a copy of which is attached. This includes implementing LMNS Equity and Equality Action Plans. NHS England has also invested an annual recurrent £10 million to target action at the 10% most deprived areas of England, who we know are more likely to experience adverse outcomes during pregnancy and birth.

Question

To ask the Scottish Government whether it has conducted an equality impact assessment regarding the number of any missed health appointments as a result of the reported ongoing disruption to the railway line from Stranraer to Ayr, in particular for women.

Lead responsibility for Ayr Station Hotel rests with South Ayrshire Council while Network Rail has lead responsibility for the railway station itself.

All parties are aware of the disruption to travel caused by the dreadful vandalism which set fire to the Station Hotel. Rather than conduct post-event impact assessments, the focus of all partners involved is on working collectively to restore services to normal as soon as it is safely possible to do so.

Until rail services can be restored, a replacement bus service is in place to enable passengers on the affected route to access work, leisure, education and any other personal matters, including medical appointments.

Question

To ask the Scottish Government how it engaged with the UK Government in the drafting of the 2023 UK state report to the UN Committee on the Elimination of Racial Discrimination.

The UK Government is the State Party to the CERD with a legal obligation to report on implementation. It submitted its state report to the Committee in March 2023.

Prior to this report’s submission, the Scottish Government shared updates on devolved policy areas including health, housing and employment with the UK Government. These updates were included in the UK Government’s report to the Committee.

Scotland is determined to play our part in eradicating racism, inequality and injustice – and in building a better, fairer world. Specifically, the Race Equality Framework demonstrates our commitment to eliminating racism – our Vision for a fairer Scotland is that by 2030 Scotland is a place where people are healthier, happier and treated with respect, and where opportunities, wealth and power are spread more equally.

We routinely engage with a range of stakeholders in our work across Scottish Government, including work to implement the recommendations and observations of the Committee.

The UK's State Report covers the measures that have been adopted, by Government, relating to the rights described in the Convention, and on the progress made in upholding them. Scottish Government did not engage with these groups for the specific purpose of providing our updates to the UK Government for inclusion in their State Report, due to the nature of the reporting process.
