While my constituency is primarily known as a former mining area, agriculture has always played an essential role in the local economy of Don Valley and continues to do so. Consequently, as the Government have confirmed that there will be no extension to the transition period, this Bill is more necessary than ever, and its passage today will provide farmers and many other individuals in my constituency with reassurance on several issues.

I appreciate that Members in all parts of the House are concerned about environmental sustainability in food production, as can be seen in the Opposition’s amendment 26. Yet this amendment is wholly unnecessary, as clause 1(4) already outlines that the provision of any financial assistance by the Secretary of State to agricultural businesses would have to take into account whether such assistance would encourage food production in an environmentally sustainable way. I am pleased with the addition of this requirement, as it will ensure that the often wasteful aspects of the common agricultural policy will become a thing of the past.

Furthermore, I am pleased that clause 17 will require the Secretary of State to report to Parliament at least once every five years on food security in the United Kingdom. This is particularly relevant at this moment in time. Like so many of my colleagues across the House, I have had dozens of concerned constituents email me about the lack of food in shops as a result of the panic buying that we unfortunately witnessed last month. Some were even scared that the UK would run out of food. Yet I am concerned that the Opposition’s new clause 4 would add such a large number of requirements to the Secretary of State’s reporting that the original purpose of clause 17 would be lost. I appreciate that the new clause is designed to encourage the consumption of healthy food, but clause 17(2)(e) already states that the data put forward by the Secretary of State will include statistics on

“food safety and consumer confidence in food.”

This would inevitably touch on aspects relating to the nutritional value of food and consumers’ confidence that the food available to them was healthy to consume.

This has been a robust debate and I have appreciated the diverse range of views that have been expressed across the House. I end simply by stating that this Bill has my full support and will ease some of my constituents’ environmental and food security concerns.

This may be an agriculture Bill but it is also one of the most important environmental reforms in decades—a once-in-a-generation opportunity to change the way that land is managed in this country for the better.

Frankly, the dry phrase, “public money for public goods”, does not really convey the importance of what we are seeking to safeguard through clause 1 of this very important Bill: the air we breathe into our lungs every minute of the day; the precious soil that nurtures the crops that feed us; our rivers, streams and waterways; our hedgerows and wildflower meadows; our ancient woodlands and our rolling hills; the stunning country- side that is one of the greatest treasures of this United Kingdom we are lucky enough to call home. Of course, the “public goods” covered in the Bill also include the civilised and compassionate treatment of animals and the struggle to protect our planet from climate change.

To make a success of these reforms, we need, first, to give proper weight to food security. I was pleased to see this added to the Bill during my time as Secretary of State. Secondly, these reforms must be properly funded. I fought to secure a Conservative manifesto commitment that farm support would be maintained at current levels in every year of this Parliament. Bitter experience shows how hard it is to deliver change on this scale in the context of a shrinking budget.

Thirdly, we need sufficient time for a managed and orderly transition to ELM. If the Government want to stick to their seven-year timetable, I am afraid that we will need to see more detail very soon on how ELM will operate. Fourthly, in designing ELM we need to get the right balance between, on the one hand, ensuring that the schemes are widely accessed by farmers, including upland farmers, and can be delivered in practice; and, on the other hand, ensuring that significant, measurable, positive outcomes are delivered in relation to crucial public goods.

In this Bill, we are setting out on a path that has been closed to this Parliament for nearly half a century. Successive Governments have pushed CAP reform, but generally returned empty-handed from the Council tables in Brussels. Replacing the CAP means that we can deliver a better, brighter, greener future for farming in England, but we will not be able to realise that vision if we expose our farmers to unfettered competition from US imports produced to lower standards of animal welfare and environmental protection. We are already asking a great deal of farmers as we phase out basic payments. They will face even greater challenges if the negotiations with the EU do not initially deliver a free trade agreement. If we add in the complete liberalisation of trade with US producers, that would be a hit from which many livestock businesses would not survive. The aftershock would be felt in all four corners of our United Kingdom because of the centrality of livestock farming to communities in Scotland, Wales, Northern Ireland and of course the north of England too.

The Conservatives were elected on a manifesto with commitments on animal welfare and the environment which are more far-reaching than any before in the long history of our party, but allowing unrestricted imports from jurisdictions with far weaker rules would mean offshoring carbon emissions and animal cruelty, not reducing them. If we are to keep our promises on the environment and on the decent treatment of animals, they must be reflected in our trade policy and in the Bill this afternoon.

Madam Deputy Speaker, I would have loved to have been with you this afternoon in the Chamber, but I am not allowed to be with you. I cannot look you in the eye, but I am here speaking up, I hope, for my constituency of Huddersfield, where we do have farms and farming. We are, of course, the centre for the great Syngenta, one of the leading agricultural science companies in the world. It used to be owned by my old employer, Imperial Chemical Industries—ICI. It is now owned by ChemChina, which is an arm of the Chinese Government.

Things are changing. What the Bill is about, and why I support the amendments that have been tabled, is getting the balance right, across parties, between having good-quality food for our constituents and our children to feed the people of this country and our need for a secure supply chain. Nothing has taught us more about supply chains than the recent coronavirus scandal and the terrible deaths that have been caused by it. The fact of the matter is that we have to have secure food supplies.

Only recently, there was a leaked document—I have to say from the Government side—that said, “Why do we need a farming sector any longer? Why don’t we do what we do with everything else and get the cheapest possible deal in the global supermarket?” That is not the answer. We now know that we must have not only a vibrant farming sector but one that is compatible with a highly skilled and well managed industry. It also needs to be compatible with a diverse and bountiful countryside in which species are not being eradicated and where industrial agriculture does not destroy habitat.

I believe that this is Hedgehog Awareness Week. That is no laughing matter. When I was a young person it was very common to see a hedgehog in a garden. They have almost been eliminated in our country, as have many bird species, through an industrialisation of agriculture about which we must all be wary.

It would be wrong in this debate not to say that farming is under threat from the unscrupulous practices of many of our supermarkets. Getting that relationship between farming, the retailer and the supermarkets is extremely important. It is easy to say that our farming is the best. Our farming, where it is good, is very good indeed, but it is not perfect. We have a lot to learn from experience around the world, and not only in terms of high science, good management, good skills training and paying people well who work on the land. The fact of the matter is that we have to get the balance right between all those competing goals.

I am not someone who gets carried away with campaigns, but I hate the fact that we are eliminating the lovely British badger. I believe that that is a wrong-headed, contrary to science campaign, and we should all deplore that.

There must be a right balance between the countryside, the environment and high-quality agriculture, as well as the opportunity for young people who want to become farmers to get hold of some land and get started. Very largely, the push for local authorities to sell off their land during the recent austerity has meant that many young farmers do not have that opportunity. There is much to go at beyond this Bill. Let us all do it together.

The hon. Gentleman is absolutely right that there is a role for the Government. We must take action to set aside any obstacles to making the food supply chain operate in a way that ensures that people have food. On food banks, as I said, we are in discussion with supermarkets. We have also had discussions with them about competition law, and we will take whatever action is necessary to ensure that they can jointly plan their approach to these matters. For the most vulnerable, we are working on proposals that my colleagues in MHCLG will announce shortly.

Getting home deliveries to potentially millions of self-isolating households is a massive logistical exercise. Is it time for the Government to think about further intervention, including, I am afraid, the suspension of competition rules, so retailers and haulage companies can work together to meet this huge national challenge?

My right hon. Friend makes a very important point. That is why earlier this week we had a detailed workshop with both retailers and food processors to identify what they would like to do and what changes to competition law we would need to consider and implement. We are working on that right now.

With your permission, Mr Speaker, I will make a statement about the significant flooding caused by the heavy rain and severe gale force winds brought by Storm Ciara.

First and foremost, I extend my condolences on behalf of the whole House to the family and friends of the individual who lost his life in Hampshire earlier today; our thoughts are with you.

I also express my support and sympathy to all those whose homes or businesses have been flooded over the weekend. Flooding can have appalling consequences for each individual affected, and I want to provide the assurance today that the Environment Agency, local government and the emergency services are working hard to keep people safe in all the areas affected by this devastating storm.

Storm Ciara brought rainfall ranging between 40 and 80 cm in 24 hours across much of northern England. The highest levels were recorded in Cumbria, with 179.8 cm of rain falling over the course of the day. Particularly severe impacts have been felt along the River Calder in Yorkshire, along the River Ribble in Lancashire, along the Irwell in Greater Manchester, and on the Eden in Appleby. Regrettably, four of these communities—the Calder valley, Whalley and Ribchester, the Rossendale valley and Appleby—were flooded in 2015.

The current estimate is that more than 500 properties have been flooded, but this number is expected to increase as further information is collected. The latest number of properties confirmed to have been flooded are 40 in Cumbria, 100 in Lancashire, 150 in Greater Manchester and 260 in Yorkshire. Defences in Carlisle have held. There is local road disruption across the affected areas, and a shipping container is stuck under Elland bridge. One severe flood warning was issued over the weekend to communicate a “risk to life” along the River Nidd at Pateley Bridge. This has now been removed; flood defences were not overtopped and no properties were flooded. Our coastal communities have also been affected, in parts of the south-west and north-east of England, where high tides, large waves and coastal gales have occurred.

The weather is expected to remain unsettled, and 97 flood warnings are currently still in place. Although river levels in West Yorkshire and Lancashire are now receding, we must expect high river levels further downstream in South Yorkshire over the next few days, so we urge people in at-risk areas to remain vigilant, not to take unnecessary risks and to sign up to receive Environment Agency flood alerts. Some coastal flooding is probable tomorrow, but it is not expected to be in the more serious category.

Extensive work is taking place in the affected areas, including clearing debris that can block up river flow. Environment Agency teams have been deploying temporary flood barriers where necessary. I pay tribute to all the dedicated professionals who are working so hard on the emergency response to the situation—operating flood defences, supporting communities and keeping people safe. That includes the hard-working staff of the Environment Agency, along with local authority teams and, of course, the police and fire services. I also thank all the volunteers who are part of local flood action groups that are helping with the response effort.

Every effort is being made to keep people safe, and I can confirm that the Government are today activating the Bellwin scheme, which will provide significant financial support to the local authorities in the areas affected by Storm Ciara, helping them to fund the cost of recovery. I encourage councils in the areas affected to consider applications to the Bellwin fund.

In a changing climate, we all want our country and our communities to be better protected from flooding, and more resilient when severe weather occurs. In the areas hit by flooding over the weekend, at least 25,000 properties and businesses have been successfully protected by flood defences. But we know that more needs to be done, and we are determined to deliver.

Since the events of Boxing day 2015, we have been taking action on a range of schemes to strengthen defences and improve resilience. We are investing more than ever before in these defences through a £2.6 billion programme up to 2021 to manage flood and coastal erosion risk. This will enable better protection of over 300,000 properties. Early in 2016, we committed an unprecedented £35 million to improve flood protection for homes and businesses in Mytholmroyd, Hebden Bridge and across Calderdale. Construction in Mytholmroyd is progressing and we expect the defences there to be completed in in the summer. We have built 25 new flood defences in Cumbria and Lancashire, protecting 23,100 homes, and 59 new flood defences in Yorkshire, protecting 13,200 homes. In the autumn, I announced an extra £60 million to boost flood schemes in the north, including £19 million for Calder valley. Our manifesto commits us to a further £4 billion of new funding in the five years up to 2026.

In 2016, we introduced the Flood Re scheme to make insurance cover for flooding more affordable and more accessible. Following the flooding in November, I announced an independent review of the data on insurance cover to ensure that that scheme is working as effectively as possible. Since the incidents of 2015, we have strengthened and improved our system of flood warnings, and we have established a flood recovery framework to prepare for and guide flood recovery schemes.

This Government are determined to maintain and enhance our readiness to respond when extreme weather hits our country. Our swift activation of the Bellwin scheme today, and our investment in the biggest ever programme of flood defence improvement, illustrates that determination. We stand ready to help communities to recover from flooding. We are investing in the defences needed in the warmer, wetter, less predictable climate that the scientists tell us we must expect in the years to come. I commend this statement to the House.

I thank the Secretary of State for advance sight of her statement. I join her in sending our condolences to the family of the man who died in Hampshire.

On behalf of the Opposition, I thank the emergency services, the Environment Agency, local councils, volunteers and communities who have worked tirelessly to protect homes and businesses, and to rescue people and animals from rising waters, fallen trees and debris, as well as all those who have worked to reinforce flood defences, not forgetting the RNLI and our coastguard too.

The reality of the climate crisis is that more extreme weather will happen more often and with more severe consequences, especially for those who live and work in areas of high flood risk. As the climate breakdown escalates, we are seeing an increase in the frequency and intensity of deadly weather patterns. Much more needs to be done to prevent flooding, to alleviate carbon emissions through habitat restoration, and to return flood plains to a natural state. Building homes on flood plains must stop.

The Government need to ask themselves: since Parliament declared a climate emergency, what are they doing differently on flooding—on protecting our communities? Austerity has had a devastating impact on our environment. There have been unprecedented cuts to our local authorities across the country, including the councils that have been most affected by the increased flooding and increased risk of flooding. The Environment Agency has seen its staffing levels fall by 20% since the Government came to power. I want Ministers to look afresh at what can be done now that Parliament has declared a climate emergency. A new plan for flooding should recognise the realities of the climate crisis, reverse the cuts to our frontline services, invest in comprehensive flood prevention, promote land use change, encourage habitat restoration, and acknowledge in the funding settlements for councils the higher risk in areas that face flooding so often.

I recognise that some new flood schemes have been delivered, but the list that the Secretary of State gave out is of what she has done, not what she will do, in response to this flooding. Will she accept that a comprehensive plan for flooding is now needed? Is it now time for Ministers to recognise that requiring match funding for some flood schemes means that poorer communities lose out compared with richer areas? The Environment Agency said only last year that it needs £1 billion a year to protect our communities, and a new approach on flooding. When will Ministers listen to their own Government agency and fund flood protection properly?

Does the Secretary of State have a date for the much-trailed flood summit that the Prime Minister promised last year? Will the trials of the new environmental land management scheme be targeted at the areas where flooding has been most severe this time? What action is she taking to ensure that homes and businesses that have been denied insurance and are still outside the current Flood Re scheme get the affordable protection that they so deserve?

Water is incredibly destructive and can destroy homes, businesses and livelihoods. Many of those flooded this time have been flooded before. Can the Secretary of State give them an assurance that the warm words and Government press releases this time will result in more action than they saw the last time they were flooded?

Where those on the two Front Benches completely agree is on the urgent need to tackle the climate crisis, because inevitably our changing climate leads to more extreme weather. This Government have the most ambitious programme in the world to decarbonise our economy. We are decarbonising faster than any other G7 economy, and we were the first major developed economy to make the legal commitment to net zero. I completely agree with the hon. Gentleman that habitat restoration, nature-based solutions, peatland restoration and tree planting are all a crucial part of our programme to tackle climate change, but they can also play a critical role in mitigating the impact of flooding. We are determined to deliver on those programmes, which is demonstrated by the revolutionary Environment Bill we have put forward.

I agree that the planning system must take into account flood risk, and there are important principles in the planning system to ensure that it does so. In relation to council funding, I reiterate that the Bellwin scheme was opened this morning by my right hon. Friend the Secretary of State for Housing, Communities and Local Government, and I encourage local authorities to submit their applications as soon as possible.

With regard to Environment Agency funding, we are absolutely committed to investing in ensuring that our flood defences are as strong as they can be and that we become more resilient to flooding. That is why our manifesto commits a further £4 billion over five years. We do have a comprehensive plan for flooding, and those investments will be made over the coming years.

The shadow Secretary of State is concerned about match funding, but one of the successes of the funding programme is that we have managed to draw in sources of funding for other areas, to maximise the impact we can have on flood defences. He makes a valid point in relation to environmental land management. We certainly would want to involve a range of locations in our tests and trials, and I very much hope that some of the areas affected by flooding today can be part of that.

Finally, Flood Re has significantly improved access to insurance, and it has kept the costs much lower than they would otherwise be. Virtually 100% of people now have the option of quotes from at least two companies when choosing insurance, but we recognise that there was concern in South Yorkshire after the November flooding incident, so we are reviewing the scheme independently to ensure that it is working as effectively as possible to help people insure in these circumstances.

Fast-flowing torrents of water damaged homes and businesses across my constituency over the weekend, with communities such as Milnsbridge, Linthwaite, Marsden, Slaithwaite, New Mill, Brockholes and many more suffering at the hands of Storm Ciara. Does the Secretary of State agree that we must get councils clearing culverts and drains of leaves? Does she also agree that, when it comes to housing developments, we must stop this tarmacking and paving of our green fields, which gives no space or capacity for rain run-off when we have severe storms such as these?

I want to take this opportunity to express my support and sympathy for all my hon. Friend’s constituents who have been affected by the very severe weather at the weekend. I certainly agree that it is important for local authorities to undertake appropriate drain clearance as part of their efforts to mitigate flood risk. I also believe that it is important for our planning system to recognise the value of maintaining gardens and green spaces as part of our overall strategy to prevent flooding and mitigate its impacts.

I thank the Secretary of State for giving us advance sight of her statement. I would like to associate myself and my colleagues with the condolences expressed by the Secretary of State to the family and friends of the gentleman in Hampshire who so sadly lost his life, as well as to those who have seen their properties and businesses affected. I would also like to give our thanks to the volunteers and the many in the public services who have worked so hard over the past 48 hours to keep people safe.

Of course, climate change means that extreme weather events of the kind we have seen in the last 48 hours will become more and more frequent, as will the kinds of statement that the Secretary of State has sadly had to make today in consequence. What steps will her Government take to further improve the resilience of the transport network to cope with events such as we have seen, and will she undertake to be engaged with all the Governments in this island as the aftermath of Storm Ciara is dealt with?

Our £2.6 billion of investment in flood defences up to 2021 has a very strong emphasis on ensuring that our transport networks are more resilient. I would also emphasise that on those matters and many others we are keen to work with the devolved Administrations to the mutual benefit of all our citizens.

Many of my constituents who were flooded last year watch severe weather warnings with dread, expecting to be flooded again every time they see them, and many of them have not been able to apply successfully for Flood Re insurance or for resilience funding. What can the Department do to communicate to councils the importance of working with the people affected—the victims of flooding—to enable them to access this resilience funding?

I cannot begin to convey the sense of absolute devastation across Calderdale that, for so many residents, we are in the same position again, having been flooded in the Boxing day floods in 2015. To update the Secretary of State, we are now looking at 400 residential properties flooded, 400 businesses, eight schools and two care homes, and two bridges have sustained damage. I have written to her today with a number of asks. Will she agree to meet me and representatives from Calderdale Council to go through those in detail so that we can start the recovery? Will she commit to making available the flood grants that came so quickly after those 2015 Boxing day floods, so that we can start that process straight away?

I thank the Secretary of State for her time yesterday, for making herself available and for the support and help she gave. As I have told her, many of my constituents who were flooded over the weekend are exactly the same people who were flooded on Boxing day 2015, which really is completely unacceptable. Can she assure me that the flood defence programme the Government have in place will ensure that my constituents in Shipley will not have to suffer this fate yet again?

I am afraid there can be no absolute guarantees on flooding, but I can assure my hon. Friend that the Government are determined to press on with their major investments in our flood defences to better protect thousands of homes and businesses across the country. Certainly one of the things we will do as a result of what has happened over the weekend is take a fresh look to make sure that everything possible is being done to keep those flood defence projects on track for delivery.

There are two essential railway lines in Dwyfor Meirionnydd: the Conwy valley and the Cambrian coast lines. Neither has trains running today, following river and sea flooding. Given that the rail infrastructure of Wales is reserved to Westminster, what is the Department doing to work alongside the Welsh Government and ensure that essential communication links in Wales are resilient in the face of climate change?

My Department has very extensive contacts with the Welsh Government on a range of issues. Obviously, in circumstances like this, it is essential that there is excellent working between the devolved Administrations in relation to the transport network. That is what is under way, and it will continue.

Will the Secretary of State join me in paying tribute to the hard-working staff of the Environment Agency in West Sussex and nationally, who have been working diligently at antisocial hours, not just over this weekend, to protect life and property, but in many cases since the flooding in mid-December? I also thank her for making the link between the planning system and the incidence of flooding.

May I say to the Secretary of State that three months on from the floods that hit my constituency in November, many people are still suffering and are still out of their homes, and I am afraid Government help for those particularly without insurance, despite promises made, is inadequate? May I direct her to the issue of matched funds, raised by my hon. Friend the Member for Plymouth, Sutton and Devonport (Luke Pollard) on the Front Bench, because what this means in South Yorkshire is that, although the Government have said they are making up to £1 million available—itself a measly sum compared to the need—that money is not being released because £600,000 has been raised from local businesses and people, but it does not reach the £1 million? The recent flooding incidents show very clearly that there is a need for better resilience and better planning for flooding events. Kirkstall in my constituency was devastated by floods on Boxing day 2015, and we were on high alert all day yesterday. In many ways Leeds had a close escape yesterday, but there remains a £23 million gap between what the Government have committed to flood defences in Leeds and what is needed to protect us against the floods we experienced just four years ago. We had a lucky escape yesterday but may not be so lucky next time. When will the Government release that £23 million so that Leeds gets the flood defences we need?

Brigg and Goole and the Isle of Axholme is probably the most flood-prone constituency in the country. We are grateful for the hundreds of miles of flood defences that protect us and for Governments of all parties over the last decade and a half announcing more money for flood projects after events, but the problem at the moment actually is not so much accessing funding for capital projects but ongoing maintenance, which is absolutely vital to ensure our ditches and dykes are free to take the water. I urge the Secretary of State to continue the excellent work on capital funding, but to look at what maintenance funding has been made available to drainage boards, local authorities and the EA?

My hon. Friend makes a very valid point. In many areas, capital spending is not effective unless it is accompanied by resource spending to ensure that appropriate maintenance takes place, and nowhere is that clearer than in relation to floods. That, no doubt, will be considered at the Budget and the spending review.

Promises broken and programmes undelivered: tomorrow morning at five o’clock the River Ouse is likely to rise to the same level as under Storm Desmond, yet we have seen a lack of delivery on issues such as insurance, upper catchment management and even putting in resilience in the city itself. I will be very happy to meet the hon. Lady. The situation in relation to the Ouse is indeed still very serious, but I reassure her that significant numbers of flood defences have been built over recent years. As I said in my opening statement, we fully recognise that there is more to do, particularly as the climate is changing and extreme weather events become more common, but a huge amount of effort has gone into delivering flood defences, and more is on the way.

Recent months have led to a very difficult start of the season for many farmers, particularly arable farmers forced into exceptionally late drilling. I, too, want to pay tribute to the emergency services, who have responded so well. My heart goes out to the families and communities who have yet again been hit by this disaster.

There is no denying that the climate emergency causes such extreme weather events. Planting millions of trees is one part of responding to the climate emergency. Indeed, the right hon. Lady’s party has pledged to plant millions of new trees every year. Do the Government have a plan for where those millions of trees will go, and when will it be published?

The Government are already running a range of schemes to promote the planting of trees, including the urban tree challenge fund, where we announced successful bids at the weekend. We will publish further details in our tree strategy for England, which will come out in a few weeks’ time.

I am sure the Secretary of State and many Members will have seen the dramatic pictures from Hawick in my constituency, where Sonia’s Bistro and the Bridge House bed and breakfast collapsed into the River Teviot. That was devastating for the business, but thankfully nobody was injured. May we pay tribute not only to the emergency services but to the Hawick flood group and all the other volunteers who made sure that that building was evacuated, and kept many other communities and people safe from what could otherwise have been a disaster?

I join the Secretary of State in praising all agencies, including the Environment Agency, local authorities, police and volunteers. Will she also recognise the enormous contribution of our fire and rescue services in dealing with recent flooding? In order that they are properly resourced, equipped and trained for these responsibilities, as a one nation Conservative will she agree to extend a statutory duty on flood response to fire and rescue services in England, in line with the duty that already exists in Scotland, Wales and Northern Ireland?

I want to ask the Secretary of State about Flood Re. What is her advice to those who are not covered under the present scheme—leaseholders, homeowners who live in properties built after 2009 and businesses, particularly microbusinesses or businesses run from home—and are finding it very difficult to get any insurance?

Parts of my constituency have been underwater since yesterday, particularly Redvales and Ramsbottom. Redvales has benefited from the £40 million Radcliffe and Redvales flood defence scheme—the Government provided £7 million—for which we are grateful. It has mitigated some of the problems that we saw yesterday, but Ramsbottom does not have its own flood defence scheme. Will my right hon. Friend meet me and other relevant agencies to ensure that Ramsbottom has a flood defence scheme at the earliest opportunity to protect local residents and businesses?

Along with my hon. Friend the Member for Calder Valley (Craig Whittaker), I was in Brighouse yesterday, where I am a councillor, helping some of the businesses affected by flooding. He is still in Calder Valley helping with the relief efforts and discussing the response with the Under-Secretary. The Government’s response to the devastating floods in 2015 was excellent. Will my right hon. Friend confirm that the same support package will be offered to householders and businesses who have been affected once again?

Will the Secretary of State join me in thanking the contractors for Worcestershire County Council who have been clearing all the fallen trees from our roads? In Worcestershire, we have the River Severn, the River Avon and the River Teme, so we experience frequent river flooding. Six new flood defence schemes have been built in West Worcestershire, but we still need more. How much of the £4 billion—the increase in flood defence funding she has announced—has already been programmed?

My right hon. Friend has twice mentioned the planning system. In my view, too many houses are still being built on floodplains, causing problems not only for them but for houses downstream from them. Will she work with colleagues from the Ministry of Housing, Communities and Local Government so that where the local authority planning decision is overturned on appeal the Planning Inspectorate always encloses a condition that the local authority must approve a satisfactory drainage system?

Flooding in urban areas such as Dudley South is often made worse by overflowing drains, often caused not by blockages in the drains but downstream in the water waste pipes. Will my right hon. I offer my sympathy to all those who have been affected and my praise to all those who have played such a significant role in trying to ensure that everyone is safe. On a visit to North Yorkshire, I saw at first hand the damage that flowing water can do in the small gullies that, under normal circumstances, hold virtually no water, and to the small rural communities whose houses dot the side of the gullies. Huge stones and mud ripped down the hillside, undermining the homes. Who do these people go to in order get that fixed and ensure that in years to come their homes are literally not swept off the hill?

It is crucial that we support rural communities as part of our programme to improve flood defences. We have seen on our television screens in recent days the potentially devastating impacts of severe weather. No system can protect everyone in all circumstances, but flood defences will be an important part of our agenda to level up all parts of the country, including rural areas.

For too many homes, businesses and villages in Rushcliffe, flooding is a recurring issue. Does my right hon. I thank the Secretary of State for her responsiveness to the flooding over the weekend. On this occasion, the issues in my constituency were minor, but I have been told by residents that those affected by flooding from the River Weaver in Nantwich in November have still not had the support they deserve to help them to recover and get their homes and businesses back on track. Will she meet me to see what we can do to make sure that the Environment Agency and Cheshire East Council work together to look after residents affected since November?

My beautiful constituency is not immune to flooding, and neither is it immune to the reckless growth ambitions of the Labour-led council. We must take steps to look after the houses that are already there. Will my right hon. Friend reassure me that the Government remain committed to protecting an extra 300,000 houses from flooding?

I can give my hon. Friend that assurance. Our £2.6 billion programme is designed to protect 300,000 properties and give significant protection to agricultural land and the transport system. It is a record level of investment. We are investing more in flood defences than any previous Government, because we know how important that is in the context of a changing climate.

Flooding is not only caused by heavy rain. Coastal areas in my constituency regularly experience flooding when heavy storms coincide with high spring tides. This can result from storm damage to harbour walls or coastal erosion. Will the Secretary of State make sure that our future plans include funding to build resilience into our coastal regions?

Supporting our coastal areas is an important element of our plan for improving flood defences, so I can give my hon. Friend those assurances. Waste crime blights local communities and our environment and this Government are determined to tackle it. Over the past six years, we have invested £60 million in measures to achieve that. Last month, we launched a joint unit for waste crime, led by the Environment Agency, and including the National Crime Agency, HMRC and the police. This new unit will help us crack down on serious and organised crime in the waste sector.

Fly-tipping in particular is an issue that costs our local councils and landowners hundreds of thousands pounds annually to clear up, with rural communities particularly affected. Just last week, the village of Austrey in my constituency was targeted yet again. What additional resources and powers can we give our local authorities and police to eradicate this scourge once and for all?

I fully appreciate how strongly my hon. Friend’s constituents feel about that issue, as do mine in Barnet. We are giving local authorities additional powers through our Environment Bill to tackle fly-tipping. We have also already enhanced their powers to search and seize vehicles, which may be involved in this menace, and we have granted them power to issue fixed penalty notices, and I encourage them to use those powers.

I welcome the Minister’s answer, but I must tell her that landfill tax fraud is a multi-million pound business. From my experience in the north-east of England, where there is some good co-operation going on between various agencies, the problem is with HMRC, which will not investigate unless a certain threshold is hit. I asked for feedback on prosecutions in one high-profile case that was activated four years ago and found that, to date, nothing has happened.

That is one reason we are bringing together the relevant agencies in this new joint unit. They include HMRC, which is absolutely determined to crack down on tax fraud and evasion of all sorts. The right hon. Gentleman has his point on the record, and I am sure that the issue will be raised in the new joint unit.

Fly-tipping ranges massively from lorry loads of hospital waste to a sofa. Farmers are then expected to dispose of that waste at their own cost. We quite rightly welcome what the Secretary of State says about taking lorries, vans and cars away from people, because we really must stop this crime.

Fly-tipping is a major issue in my area, not least because of changes in policy from North Lanarkshire Council. One way of stopping such crimes is by increasing the recycling rate and targeting particular sectors, such as the construction sector, which has a particularly bad problem with waste pollution. Will the Secretary of State outline potential areas such as training staff in those sectors to ensure that they are aware of how to recycle properly?

Of course, training in this area is very important. The hon. Gentleman will be aware that, as far as England is concerned, our new Environment Bill contains an extensive list of measures to improve rates of recycling, and yes, we hope that that will be part of a wider strategy to cut down on waste crime and ensure that more of our waste is recycled, and that all of it is treated appropriately.

My constituents benefit from the glorious countryside of Northumberland and County Durham—landscapes shaped by small-scale farmers. Those farmers would be devastated by unfair competition from the American agro-industrial machine, with its lower animal welfare, food and environmental standards. The Secretary of State talks a good talk and reads a good brief, but she will not put anything into law, so will she now unequivocally condemn any Government who trade away our high food, environmental and animal welfare standards?

On Monday, the Secretary of State heard from both Opposition MPs and MPs on her own Benches that she had to put our high environmental standards into law to prevent US agriculture from undercutting them in any trade negotiations. Now that a few days have passed since that debate, has she reflected on the fact that there is cross-party support for putting those promises into law and will she do the right thing and put them in the Agriculture Bill?

I reiterate what we said in a debate last week: our high environmental, animal welfare and food safety standards are already in law, including legislating to prevent the importation of chlorinated chicken or hormone-treated beef, and our manifesto commits us to continuing to defend robustly those standards in future trade negotiations.

I am afraid that is not a good enough answer from the Environment Secretary, because unless there is a specific clause in the Agriculture Bill that guarantees that there will be no undercutting of British farmers by imported US agriculture in particular—produce grown to lower animal welfare and environmental standards—no one will believe a word that the Environment Secretary has to say. The Trade Secretary is today publishing a document that will apparently lock those standards into law, so if it is good enough for the Trade Secretary, why is it not good enough for the Environment Secretary to put the same commitment into law?

The Secretary of State will know that many of us are leading on planting plans in our constituencies, working closely with local councils, local wildlife trusts and so on. A good example is the new arboretum at lower Westgate Street in Gloucester, which was planted at the beginning of January. However, does she agree that there is a risk that, however many thousands of trees we plant in our constituencies, somebody will always say that we should have done much more? Is there an opportunity for some independent body to make an objective assessment of how many trees can realistically be planted in urban constituencies such as mine?

My hon. Friend makes a good point about setting appropriate targets. We plan to work closely with local authorities as we drive forward with our commitment to plant more trees. The Environment Bill contains important changes to the planning system—for example, an environmental net gain—that will encourage investment in nature, biodiversity and tree planting.

I welcome my hon. Friend’s ambition for tree planting in his local area. As I have said, changes to the planning system should incentivise investment in tree planting and nature. Programmes such as the urban tree challenge fund could provide a great opportunity for local authorities to play their part in delivering this tree-planting effort.

Will the Secretary of State join me in congratulating the pupils of Good Shepherd Catholic Primary School in my constituency, who recently planted 130 saplings in a new eco-area at the school? Does the Secretary of State accept that the prime purpose of planting trees in the present climate crisis is to provide an effective carbon sink to produce the negative carbon emissions that offset other carbon emissions in a net-zero world? The Committee on Climate Change suggests that that means planting perhaps up to 50,000 hectares of trees per annum up to 2050—perhaps 2.4 billion trees. Does she agree that the present target in the clean growth plan of 11 million trees is tiny—especially as it is currently being missed by 71%—and almost amounts to “greenwash”? When is she going to get real on tree planting and management, and adopt measures that will secure the billions of trees we need and not the millions she is projecting?

Where I would agree with the shadow Minister is that we do need massively to step up our tree planting in this country, and that is what we are determined to do, particularly by working with the devolved authorities as well. I encourage everyone to take the message out to their constituents that they can get involved with these programmes through the countryside stewardship woodland creation grant, the woodland creation planning grant, the woodland carbon fund, the woodland carbon guarantee and the urban tree challenge fund. We will soon be consulting on a tree strategy for England to drive forward further the crucial task of planting more trees in this country.

In recent weeks, DEFRA has been driving forward the biggest programme of legislation in Whitehall. That includes publication of our landmark Environment Bill, to introduce a new legal framework and demanding targets on matters such as nature, recycling and air quality. We have published our Fisheries Bill, to enable this country to take back control of its fishing waters and end the common fisheries policy. The Agriculture Bill has had its Second Reading, to ensure a brighter, greener future for our farmers. And of course, my team and I have played our part in securing the biggest election victory for the Conservatives in 30 years.

Data published in the recent climate change agreements biennial report showed the dairy industry delivering a 21% improvement on its energy efficiency over the last 10 years—the latest in a long line of sustainability wins for the industry. Does my right hon. Friend agree that, far from being a villain in the climate change story, the dairy industry is proving itself a force for good?

I very much agree. I pay tribute to the huge efforts made in the dairy sector to become more efficient and more sustainable. I know that those in the sector have further plans through the pioneering dairy road map, and I wish them well with that. We need to support UK agriculture in the tremendous efforts it is making to be part of the solution on climate change.

This Government have made much of the fact that we are leaving the EU and all its bureaucratic processes, but only to replace it with the catch app, a far more complex system for smaller fishing boats. T6. Putney High Street is one of the most polluted streets in London and the country, although electric buses have helped a lot. Ammonia emissions, predominantly from farming, are rising and are above World Health Organisation safe limits. In London, particulates derived from that ammonia are the largest contribution to imported background or particulate pollution. Will the Secretary of State commit to tackling this issue of ammonia pollution in the Environment Bill?

We have a strong focus on these matters. The measures we will be bringing forward in the Environment Bill will help us to set challenging and demanding targets on those issues. I am sure the Secretary of State is aware that for many years animal rights activists and welfare activists for animal rights have been calling on Government to stop exporting animals on the hoof, and to let them be slaughtered in our slaughterhouses and go on the hook. Now we have left the EU, can the Secretary of State confirm that that sort of practice will cease?

My constituent, Mr Latimer, after exhausting every avenue to halt the flow of sewage on to the beach behind his very popular restaurant, ended up filing a complaint with the European Commission. The ruling from the Court of Justice of the European Union stated that the Government needed to rectify the problem within five years. That was eight years ago. Can he expect any action from this Government?

I beg to move, That the Bill be now read a Second time.

This Bill will introduce the first major reform of agriculture policy in this country for half a century. Now that we have left the European Union, we are determined to do things differently and to pursue the priorities of the people of this great nation. That means strengthening the Union of our United Kingdom by levelling up opportunity, to unlock our country’s potential. As we commence consideration of this landmark Bill, I want to highlight the huge contribution that farmers make to our society by putting food on our plates and conserving the natural landscapes that we all value so much. This Bill will provide our farmers and land managers with a chance to play a fundamental role in tackling the greatest environmental challenges of our time: protecting nature and tackling catastrophic climate change.

Brexit means that we can finally leave the common agricultural policy, to build a brighter, better, greener future for British farming. With its exasperating rigidities, complexities and perversities, the CAP is a bad deal for farmers, a bad deal for landscapes and wildlife, and a poor return on public investment for the taxpayer. We can do so much better.

I hope very much that we will be able to do better. The Secretary of State talks about looking after our farmers and higher standards, but will she guarantee that those higher standards will not be undercut by cheaper imports that do not meet those standards? If they are, we will not be doing our farmers any favours at all and will simply be outsourcing lower standards. Can she guarantee a legal commitment that no imports will undermine those standards that we will have in our country?

This weekend, I was approached by a young farmer who wants to succeed his grandfather as a tenant farmer. His landlord is the Church Commissioners—not so much a Christian organisation as a violently commercial one, which I suppose may be its right. Can my right hon. Friend assure all our good, solid tenant farmers, who are the bedrock of our support in the countryside, that we stand four-square behind them against rapacious landlords?

We welcome in the Bill the powers that the Government will introduce to give a fair deal to farmers and growers. The Bill enables us to provide financial assistance for environmentally friendly farming practices. Providing more space for biodiversity, trees and nature will, I hope, be at the centre of many of the environmental land management schemes that we will be able to take forward under the Bill.

Is the Secretary of State aware that providing modest support for small-scale farmers could be extremely valuable? That is part of my campaign for an Island deal similar to the one enjoyed by the Scottish islands. It could include support for small-scale abattoirs or humane slaughter on farms, which is the most humane way of slaughtering animals for human consumption, as well as milk storage, grain storage and vegetable box erectors on the Island. Those would work for not only my patch but many other parts of the United Kingdom. How will this excellent Bill help? Will she come to the Isle of Wight to talk to my farmers and see that for herself?

I thank the Secretary of State for giving way; she is being incredibly generous with her time. I want to take her back to the fact that the Bill lacks any legal guarantees to protect our food standards from being undermined. The Conservative party’s manifesto may have referenced that, but the Bill does not, so will she give us a cast-iron guarantee that the Bill will protect those standards?

The Secretary of State knows Northern Ireland well, so she will know that the big issue facing agriculture is farm incomes, which have fallen by 23% in the last two years. What assurance can she give to farmers listening in Northern Ireland tonight that the Bill will encourage an increase in both farm productivity and farm incomes?

My hon. Friend will appreciate that agriculture is a devolved matter, but the Government’s manifesto does commit us to maintain the same overall levels of support for our farmers in each year of the current Parliament. We do clearly recognise the importance of ensuring and securing prosperity in the farming community in Northern Ireland, and we will work closely with the Department of Agriculture, Environment and Rural Affairs on these matters in the weeks and months ahead.

We are going to put the broken system of the CAP firmly behind us. We are replacing it with an approach based on the principle of public money for public goods. We have committed in our manifesto to support that new approach with an overall level of funding to match 2019 levels for every year of the current Parliament. The Chancellor has already announced that the Government will provide £2.852 billion of direct payment support for the 2020 scheme year.

The objective of the Bill is a productive, profitable, resilient farming sector, empowered to produce more of the high-quality food that is prized around the world and appreciated so much here at home, all the while meeting the highest standards of food safety and traceability, animal health and welfare, and stewardship of the natural environment. Now more than ever before we need to recognise the vital importance of the work that farmers do because our climate is changing, because our ecosystems are under increasing pressure and because by the end of this decade 9 billion of us will share this planet.

I say to my right hon. Friend that we must not get too misty-eyed about farmers. There is far too much cattle slurry, from dairy farms in particular, going into our rivers and destroying those rivers, and we really do need to make sure that farmers are held accountable for what they do with the slurry their cattle produce.

Through a combination of regulation and farm support payments, we are certainly doing everything we can to ensure that farmers play their part in addressing and reducing pollution, and contribute to cleaner water and cleaner air.

Finding a way sustainably to feed a rapidly growing global population is essential if we are to have any chance of tackling the climate and nature crisis that we face. Getting Brexit done means that we are able forge ahead with the reforms that the United Kingdom has sought for so long from the European Union, but never managed to secure. For 40 years successive UK Governments of all political complexions have vowed to secure reform of the CAP, and for 40 years Ministers returned from Brussels and stood at this Dispatch Box with very little to show for their efforts. This Bill will therefore deliver one of the most important environmental reforms for decades. It shows that we can deliver a green Brexit, where we have a stronger and more effective focus on environmental outcomes than was possible while we were a member of the European Union.

My right hon. Friend is being characteristically generous in giving way. I agree with her entirely about the need to green and be environmentally friendly in farming. Against that backdrop, is she able to indicate her thinking about the support this Bill could provide to those farmers who are really keen to invest in agri-tech as a way of reducing the need for both insecticide and pesticides?

The new scheme of farm support will include support for agri-tech to support productivity enhancement in a sustainable way. My hon. Friend raises an important point, which I will refer to later in my remarks.

If we get right the reform we are contemplating today, we can be a beacon for others to follow. Over $700 billion is spent around the world on agriculture subsidies. If we successfully deliver a new approach to farm support here and that encourages even a fraction of those billions of dollars of farm subsidies to be diverted into environmental improvement schemes, we will have a created a massive boost to efforts to address the climate crisis. As Secretary of State, I want to emphasise that I fully recognise the urgency of that crisis. I have been driving forward this Bill as just one part of the biggest package of legislative reform in Whitehall, but I am determined to go further. In the coming weeks, I will be publishing documents outlining more detail on our proposals for the future of farming.

The Government have always been clear that we will seize the opportunity Brexit presents to deliver reforms that work for our farmers across our Union and that help to secure crucial environmental goals, but I am afraid that that cannot be said of the official Opposition. In all the years Labour Members had to change things, they did nothing. They wanted us stuck in the EU, locked forever into the CAP and anchored to a status quo that has been holding us back for decades. I am shocked that, in tabling a reasoned amendment, they have signified their intention to vote against this Bill.

I speak here as a patriot, and I have quite a farming community in Weaver Vale, and I and Opposition Members certainly want to maintain good British standards. Why does the Secretary of State not be true to the Government’s words in the manifesto and put this into legislation, as the National Farmers Union has called for?

The hon. Member has heard my response on that. It is in the manifesto, and we will deliver on our manifesto commitments.

The first chapter of the Bill provides the framework for funding schemes to support farmers, foresters and land managers. Clauses 1 to 3, which contain the meat of the Bill, will empower the Government to devote public money towards securing the public goods that people value so much, but which the market does not fully recognise or reward.

That includes improving standards of animal health and welfare, managing land in a way that enhances cultural and natural heritage, and improving public access to the countryside. Of course, protecting the environment will be right at the heart of our new approach. The Bill will enable the Government to support farmers to deliver improved water and air quality, increased biodiversity—for example, through enhanced protection for our hedgerows—and measures to address climate change. We all here know that farmers and land managers are already doing a huge amount to meet these environmental goals, but, as in so many parts of our economy and our society, we need to do so much more if we are to have a chance of reaching net zero and preventing disastrous climate change. These changes in farm support will help us to meet our hugely ambitious target for planting trees and safeguarding peatland.

I am very grateful to the Secretary of State for the gracious and generous way in which she has given way. I point out to her that, as she will probably know, livestock farming contributes some 27% of methane production—methane is 85 times worse than CO2 for global warming—and, what is more, slurry contributes about 40% of the secondary PM2.5 in UK cities. Why does the Bill not contain anything about air pollution, despite her saying it is all about climate change and helping the environment?

I am sorry to hear that Labour wants to talk down British farming. The reality is that well-managed livestock production can provide important environmental benefits, including for biodiversity. I think we need a debate on livestock farming that reflects the facts, which include the fact that our livestock farmers are some of the most carbon-friendly in the world in the way they produce their products.

We know how vital it is to protect soil health. Soil is clearly one of our most precious national assets, and we have added it to the list of purposes underlying the schemes that we can pay for under the Bill. This is a direct response to the views expressed in this House about the previous version of the Bill. A further addition is to include in clause 1 the conservation of native breeds and plants, so that the species that sustained our ancestors are kept safe for future generations. Work is already well under way to prepare and implement these crucial reforms. Our environmental land management scheme is the cornerstone of our new agriculture policy. Extensive tests and trials are under way in different parts of the country. We will launch the ELM national pilot in England in late 2021, and the scheme will launch fully in 2024.

ELM will provide a powerful driver towards meeting the goal set out in our 25-year environment plan, which is to leave the environment in a better state than we found it. Getting ELM right is crucial for meeting our commitment to net-zero carbon emissions, and to meet the tough targets set out in our forthcoming Environment Bill. I emphasise that our goal is to design ELM schemes that work for farmers and land managers, and in which a very wide range of farmers and land managers can take part.

I welcome the points that the Secretary of State makes about protecting our environment, because without a good environment we cannot produce the good, tasty, and traceable food for which Britain and the United Kingdom are famous. Does she recognise that the UK currently imports 16% of its milk? Why can we not buy more British milk from British farmers and close that deficit?

I would encourage everyone to do that. We produce some of the finest food and drink in the world, and I encourage everyone to reflect that in their shopping habits.

We fully recognise the particular challenges faced by upland farmers—indeed, I discussed that issue just a few days ago with a group of farmers in Northumberland National Park. We are determined that ELM will also work for upland farmers, and the incredible work they do to safeguard our beautiful natural landscapes will put them in a strong position to take part in our environmental schemes.

Reformed funding support for farmers and land managers will be an important part of our programme to level up the rural economy, and we will provide grants and funding to improve productivity and help farm businesses become more resilient and successful. We believe that farming efficiently and improving the environment can, and indeed must, go hand in hand. We will therefore support investment in green agri-tech, as referred to by my hon. Friend the Member for North Dorset (Simon Hoare), and invest in research and development to help raise sustainable productivity levels.

Clause 4 includes a duty on the Secretary of State to set out a multi-annual plan for financial assistance, while clauses 5 and 6 include provisions that will require the Government to make annual reports on the amount of financial assistance provided in England. Those three clauses are designed to provide greater certainty and stability about assistance in the future, and are in direct response to concerns expressed by right hon. and hon. Members about the earlier version of the Bill. Clauses 7 to 13 provide that during a seven-year transition period basic farm payments will gradually be phased out.

I strongly believe that the changes in the Bill will be positive for farmers and the environment, but change of this magnitude will also have far-reaching impacts, and adjustment to the new approach will not always be easy. As I emphasised in the debate on the Direct Payments to Farmers (Legislative Continuity) Act 2020, a managed seven-year transition period up to 2027 will give farmers time to adapt to the new system, and provide time for the new schemes to be fully tested before they are delivered across the country.

I am extremely grateful to the Secretary of State for giving way. She will appreciate that in that seven-year transition period farmers will be expected to cope with the loss of the basic payment scheme—according to her Department’s figures, 85% of funding for livestock farming comes from that scheme—and for all the likely and theoretical benefits of ELM it will not be functional for everybody until 2028. Does she agree that a wiser and more compassionate way of dealing with this issue would be to not phase out BPS until 2028, rather than starting before that?

I understand the hon. Gentleman’s point. In part, we want our grants for productivity and investment to help plug that gap. But we have to get on with this; we must make progress in transforming the way we support land management in this country. I am afraid the climate crisis is urgent.

Clause 11 contains provisions to introduce delinked payments during the transition, and where we can, and subject to constraints in the withdrawal agreement, we will introduce simplifications to the existing BPS scheme. Our transition to the new schemes opens the door to a fresh approach to the rules that we expect farmers to meet, as provided for in clause 9. We are determined to have a far more rational and proportionate approach to compliance than the inflexible CAP regime that we are leaving. For too long farmers the length and breadth of this country have had to put up with systems of inspection, compliance, and penalties that often seemed to defy logic or common sense. Outside the EU, we can do better.

Clauses 18 to 20 provide that in exceptional circumstances the Government can act to support farmers through significant market disturbances in England. Our farmers want to be competitive, collaborative, and innovative, and to negotiate effectively at the farm gate to get a fairer return. We are using the Bill as an opportunity to take further action, and to improve fairness in the agriculture supply chain.

I am in regular touch with the National Farmers Union—indeed, I spoke to its representatives only today. Throughout the process of negotiating our new relationship with the European Union, and our trade agreements with the rest of the world, there will be strong engagement from the Departments for Environment, Food and Rural Affairs and for International Trade, and from the Government as a whole, with farmers and other stakeholders on those crucial matters.

I have to make progress because I know there is a long speakers’ list.

Clauses 21 to 26 on data will increase transparency and help to manage risk and market volatility more effectively, and clause 27 will help protect UK producers from unfair trading practices. The Bill enables us to make progress on our new multi-species livestock information programme. That addition to the Bill that was debated in the previous Parliament will support a game-changing initiative to strengthen biosecurity through traceability, and help to strengthen consumer confidence in the quality and safety of the food that reaches the supermarket shelf. Parts 4 and 5 include new UK-wide provisions on fertiliser and organic products, and on reform of agriculture tenancies in England and Wales. Many of those provisions will benefit farmers in every corner of our United Kingdom, delivering a fairer and more modern agriculture system.

The Bill includes new powers for the devolved Administrations in Wales and Northern Ireland, which they requested to enable them to bring forward new agriculture policy. We fully respect the fact that agriculture is a devolved matter, and we have worked closely with the devolved Administrations on this Bill. I thank them for the collaborative approach that they adopted. Where clauses cover devolved matters, we will of course seek the appropriate legislative consent motions.

Crucially, this Bill fully recognises the importance of food production and food security. In response to concerns expressed in this House, and beyond, about the previous version of the Bill, clause 17 places a duty on Ministers to report regularly on food security to Parliament. The Government are committed to boosting the best of British, and to championing our iconic produce on the global stage. Our manifesto commits us to maintaining and defending our high standards of food safety, animal welfare, and environmental protection as we embark on our trade negotiations with countries around the world.

We will give our farmers unfailing support as their businesses adapt to the bold and radical programme of change that this Bill ushers in, so that they can maintain and enhance the high standards that are the backbone of their success, play their part in tackling climate change and giving nature the space to recover, and continue their vital work of feeding the nation. I urge the House to back this historic change to agriculture policy in this country. Together we can seize this opportunity to deliver a better future for British farming, and I commend the Bill to the House.

I am pleased to announce that today we will be introducing the Government’s flagship Environment Bill. There is a clear and urgent scientific case and growing public demand for acting decisively to address biodiversity loss and climate change, which this Bill responds to.

We first introduced the Environment Bill on 15 October 2019. It continues to form a central part in the Government delivering a step change in environmental protection and recovery and will help deliver the Government’s manifesto commitment to deliver the most ambitious environmental programme of any country on earth. It will also support recent legislation to reach net zero carbon emissions by 2050 by minimising our waste, cleaning our air and water, and restoring habitats to allow plants and wildlife to thrive.

Taken together the measures in the Bill will help to manage the impact of human activity on the environment, create a more sustainable economy, and enhance wellbeing and quality of life. The Bill will engage and empower citizens, local government, and businesses to deliver environmental outcomes and create a positive legacy for future generations. I set out the measures in the Bill below.

Environmental governance and targets

We will establish a new system of green governance and accountability, creating an environmental watchdog in the office for environmental protection, and embedding environmental values at the heart of Government policy making. To ensure the UK continues to drive forward ambitious action to tackle climate change, we are bringing climate change legislation within the enforcement remit of the Office for Environmental Protection.

The Bill will also implement a new statutory cycle of target setting, monitoring, planning, and reporting to help deliver significant, long-term environmental improvement. This will include environmental improvement plans, the first being the 25 year environment plan, and a framework for setting legally binding targets in four priority areas: air quality, waste and resource efficiency, water, and nature. Together they will drive action by businesses and wider society to deliver environmental improvement alongside sustainable growth.

The Bill will include a UK environmental protections policy which will allow for greater transparency and give Parliament greater scrutiny over new environmental legislation. Ministers will be required to make a statement to Parliament setting out the impact of new primary environmental legislation on existing levels of environmental protection. These statements will be published and open to scrutiny by Parliament, environmental stakeholders and the broader public.

We will also review significant developments in the environmental protection legislation of other countries and prepare a report for Parliament every two years. This will ensure we keep abreast of international developments in driving forward our environmental protection legislation.

Waste and resource efficiency

The Bill will drive a major shift in maximising resource efficiency, minimising waste, and moving towards a more circular economic model. We will introduce measures based on the “polluter pays” principle, create a simplified approach to recycling, and tackle waste crime. Powers to introduce new extended producer responsibility schemes will make producers responsible for the full net costs of managing their products at end of life, encouraging them to design their products with re-use and recycling in mind. New Government powers to set resource-efficiency standards for products will drive market and consumer behaviour towards durable, repairable, and recyclable products. To tackle plastic pollution, the Environment Bill will enable the creation of new charges for other single-use plastic items, similar to the carrier bag charge, which will incentivise a shift towards reusable items. We are taking powers to establish deposit return schemes which will further incentivise consumers to reduce litter and recycle more. The Bill also sets out how Government will mandate weekly collections of food waste for every household, subject to consultation. The Environment Bill also contains powers which will enable the Government to ban the export of polluting plastic waste to non-OECD countries, consulting with industry, NGOs, and local councils on the date by which this should be achieved.

Air quality and environmental recall

We already have a strong track record of tackling air pollution—for example, direct action on nitrogen dioxide has led to emissions falling by almost 29% between 2010 and 2017 and they are now at their lowest level since records began. The Bill will further enable greater local action on air pollution, ensuring responsibility is shared across local government structures and public bodies; better enabling them to tackle emissions from burning coal and wood; and bringing forward powers for Government to mandate recalls of vehicles and machinery when they do not meet relevant legal emission standards. The Environment Bill makes a clear commitment to set a legally binding target for the pollutant with the most significant impact on human health, fine particulate matter.

Water

The Environment Bill will help to secure long-term, resilient water and wastewater services. It will introduce additional requirements for water company planning for future water supply and wastewater and drainage networks, enabling more resilient solutions to drought and flooding. In a changing climate, these measures will ensure the water regulator has the powers it needs to respond to new priorities. The Bill enhances flood and coastal erosion risk management, allowing for the expansion of existing internal drainage boards or the creation of new ones where there is local appetite to do so. We are reforming elements of abstraction licensing to link it more tightly to our goal of restoring water bodies to as close to natural state as possible, and are creating a power to update the lists of substances and their respective standards which are potentially harmful to surface waters and groundwater.

Nature and biodiversity

The Environment Bill supports and enables action to create or restore wildlife-rich habitats to enable wildlife to recover and thrive. The Bill introduces mandatory biodiversity net gain, to ensure that new developments enhance biodiversity and help deliver thriving natural spaces for communities. This will also support certainty in the planning system and therefore the delivery of new housing, while retaining and providing habitats that can enhance biodiversity. Provisions requiring the development of local nature recovery strategies across England will support better spatial planning for nature recovery, by setting out priorities and opportunities for protecting and investing in nature within a local area. The Bill also strengthens a duty within the Natural Environment and Rural Communities Act 2006 to ensure public authorities play their part in conserving and enhancing biodiversity.

Chemicals

The Environment Bill gives the Secretary of State the power to amend two pieces of legislation regulating the use of chemicals in the UK (REACH 2008). This will allow the Secretary of State to take further steps where necessary to ensure a smooth transition to a UK chemicals regime following the UK’s exit from the EU. It will also make it possible to keep the legislation up to date and respond to emerging needs or ambitions for the effective management of chemicals.

The Environment Bill is the result of extensive public consultation. In July 2019 we published six Government responses to consultations on measures in the Bill. And in October 2019 we published the Government response to the consultation on protecting and enhancing England’s trees and woodland, covering measures to increase the transparency and accountability in the process of felling street trees.

Over half of all measures in the Environment Bill are to be extended beyond England and adopted across the devolved Administrations. The positive extent of the join up demonstrates our ambition in working with the devolved Administrations across the UK to better protect the environment and strengthen the Union, while respecting the devolution settlement. This co-ordination is the result of extensive engagement with the devolved Administrations over the past year by both Ministers and officials during which we have discussed all policy areas of the Bill.

This Environment Bill is a landmark commitment to protecting and improving the environment for future generations. It grasps opportunities created from leaving the European Union and I hope that it will deliver a step change in environmental protection and recovery.

I beg to move, That the Bill be now read a Second time.

This is a Government who are backing Britain’s farmers. We will always recognise the importance of the work that they do to care for our countryside and our natural environment and, of course, to put food on our plates. We know that, if we are to level up the rural economy in the way we want to for our whole country, we must support the agriculture that is at the heart of our rural communities.

The Bill is a short technical piece of legislation with a simple purpose: to empower the UK Government and the devolved Administrations to pay basic payments to farmers for the 2020 scheme year. It therefore maintains the status quo for pillar 1 for this final period before we start to leave the common agricultural policy behind completely.

The core purpose of the Bill is enacted by clause 1, which puts direct payment legislation for 2020 on the domestic statute book. That provides a legal basis to make such payments for the 2020 scheme year. As hon. Members will be aware, almost all EU legislation was imported on to the domestic statute book by the European Union (Withdrawal) Act 2018, but funding for the 2020 basic payment scheme will come out of the 2021 EU budget. That would therefore have involved the UK in the next EU multi-annual budget cycle. In the negotiations, the EU and the UK agreed that they did not want that to happen, so the CAP provisions providing the basis to issue basic payments in the UK for 2020 were disapplied by the terms of the withdrawal agreement reached last year.

That policy decision has left a legal gap, which we are now proposing to fill. This legislation will provide clarity to farmers on funding support this year. If Parliament were to reject the Bill, no direct payments could be made by the UK Government or by the Administrations in Scotland, Wales or Northern Ireland. That would have serious consequences for farmers across the nation who have planned their businesses on the basis of continuity of direct payments for this scheme year.

The next European multi-annual financial framework will run from 2021 to 2027, but this Bill will allocate funds for one year only. What is the British Government’s intention: will there be a multi-annual framework for farming support, or will the decision be made annually?

In our manifesto, the Government set out our commitment to retain 2019 levels of support for farmers throughout the current Parliament. The exact basis of the allocation and division of those funds remains to be determined, but we will work closely with the devolved Administrations in taking decisions.

I welcome the certainty given to farmers and food producers for 2020. What advice would the Secretary of State give to an estate agent in my constituency on how it should value a significant estate currently in receipt of quite a lot of common agricultural payments?

It will be important for the estate agent in question to follow developments relating to the transition to a new system of farm support in England. I will outline that later in my remarks, but we view leaving the common agricultural policy as a vital opportunity to create a better system that more effectively supports our farmers and enables them to deliver crucial public goods, including for the environment and animal welfare.

Further to the points raised by other Members, long-term planning is very important for farmers. They might, for example, plan to build a hay shed two years hence. Moreover, any lowering of the value of the pound would have an impact on farmers, because the price of fertiliser would go up and any machinery not made in the UK has to be imported. May I appeal to the Government, therefore, that the value of the pound be calculated into any sums as they are worked out for our farmers?

The hon. Gentleman makes an important point about farmers’ need for certainty and continuity, which is one of the reasons why we have brought forward this Bill today. That is also why we propose a seven-year transition period to move away from the basic payments of the common agricultural policy and towards the new approach of environmental land management for England, which this House will have the chance to debate within the next few weeks.

The Bill is a vital stepping stone to getting us to the transition period in 2021, when we will start to introduce our national pilot for the environmental land management schemes, which will replace the common agricultural policy in the United Kingdom. We have every expectation that those schemes will enable farmers to do even more than they presently do to protect habitat and valuable biodiversity.

I am the former Chairman at the moment. I very much welcome the Secretary of State’s statement. It is great to have continuity. I want to return to the point made by the hon. Member for Caithness, Sutherland and Easter Ross (Jamie Stone) about the value of the payment. At present, the payment is made in euros; the rate used is the average rate in September. Does my right hon. Friend expect this year’s payment to be virtually the same as that for last year? In the past it was based on the value of the euro at the time of the payment, but I imagine that that will not be the case this time.

My hon. Friend is correct to say that taking over domestic responsibility for the payments means that the currency fluctuation, which has had such a significant impact in past years, is not likely to affect payment levels in the same way. None the less, we have yet to decide the exact levels of basic payments, although the Chancellor has set out the overall spending envelope with which to fund such payments.

As we move towards the transition period—more will be appearing in the Agriculture Bill—we obviously welcome the environmental sustainability measures. One thing that is not mentioned here is the fact that many farmers look after places of archaeological interests—scheduled monuments that have access for the public and need to be maintained. Does the Secretary of State envisage that the payment system will recognise that farmers are not just there to enhance agriculture and produce food; they are also stewards of historical and archaeological monuments, for which they need to be compensated?

My hon. Friend will be pleased to hear that clause 1 of the Agriculture Bill, which Parliament will have the chance to consider very soon, does recognise the importance of access to the countryside, and to our culture and heritage, by listing that as one of the public goods that we can potentially support through our new farm support scheme. He makes an important point.

I am pleased to say that the Chancellor confirmed on 30 December that overall levels of funding available for direct payments for 2020 will be the same as those for 2019, so the Government will provide £2.852 billion of support, topping up remaining EU funding. That announcement from the Chancellor, combined with this Bill, provides reassurance to the devolved Administrations in Scotland, Wales and Northern Ireland that they will be able to issue basic payments to their farmers in 2020. All four Administrations have said that these payments will be made, and that is in addition to the £216.6 million of further funding secured in the summer for farmers in Scotland and Wales.

I welcome the £3 billion announcement from the Treasury supporting our farmers, showing again that the Conservative Government support our rural communities. In the transition period from the current system to the new one, could this be done on a multi-annualised basis, so that some of our farmers can invest in some of their infrastructure to prepare themselves for the challenges that lie ahead?

I thank the Secretary of State; she is being very generous. One of the concerns that my constituents will have is around the payments from the Rural Payments Agency, which has received huge cuts since 2010. The civil servants who are working to deliver payments to farmers obviously work very hard, and I have some very positive stories in casework that I could show her. However, a huge proportion of farmers in Lancaster and Fleetwood are concerned about the delays in payments. She talks about maintaining the status quo. Will she change the status quo in terms of reforming and re-staffing the Rural Payments Agency to ensure that farmers can actually receive the money in a timely manner?

I hear what the hon. Lady says. Clearly, there have been difficulties in the past, but I would say that the RPA’s performance in recent months has been better than for many years, with, last year, 93% of farmers receiving payments by the end of December. But there is always scope to improve, and I will certainly follow this matter very closely, not just in terms of the 2020 scheme year but in relation to the role of the RPA as we move forward with the reformed system.

The additional funding that the Government have allocated consists of £160 million for Scottish farmers to correct a perceived historical injustice in relation to past years’ allocations. The remainder was awarded following the recommendations of the Bew report. Neither commitment would have been secured without the strong campaign led by Scottish Conservative MPs to get a fairer share of agricultural support for their farmers. I pay tribute to all of them, including those who sadly did not retain their seats at the election: Colin Clark, Stephen Kerr, Kirstene Hair and Paul Masterton.

Provision for the uplift in funding resulting from the Bew report and the campaign by Scottish Conservatives is made in clause 5. What is more, as I have said, the Government have a manifesto commitment to match the current overall budget for farmers in every year of this Parliament, so the Bill is an essential mechanism to provide continuity and stability for our agriculture sector as the United Kingdom leaves the European Union.

The Bill is narrow in scope in terms of subject matter and duration. Its provisions are consistent with the approach agreed by Parliament in the European Union (Withdrawal) Act 2018. Clause 2 sets out the approach to be taken by the courts regarding the interpretation of EU law. Clause 3 will enable secondary legislation to make operability amendments and to allow us to keep pace with post-exit regulatory change concerning 2020 direct payments, should the UK choose to do so. For England, the Bill bridges the gap between the common agricultural policy and the start of the agricultural transition in 2021. It does not change our policy, nor does it alter our ambitious vision for the future of food and farming in England.

The next steps in our radical reform of farm support in England will be debated in this House on Second Reading of the Agriculture Bill. That legislation will finally enable us to break free from the common agricultural policy. It will ensure that we take back control of our farming policy and our farm support payments. That will enable us to replace the perversities and constraints of the deeply flawed CAP with a new system that pays public money for public goods. We will reward farmers for environmental stewardship and high standards of animal welfare. Our farmers have always played a crucial role in safeguarding our countryside and our environment. As we deliver this far-reaching transformation, that role for farmers will become even more pivotal in delivering goals such as cleaner air and water, healthier soil and better access to the countryside.

This will be one of the most important environmental reforms in this country for decades, and it is a major benefit delivered by Brexit. It needs to play a central role in tackling the two great environmental challenges of our time: reversing the disastrous decline of nature and biodiversity and protecting our climate.

I come from the rural constituency of North Norfolk, where farmers form one of the most important sectors. Does the Secretary of State agree that the Agriculture Bill brings an excellent opportunity to tackle climate change head-on and that, as an industry, the farming community has an important part to play in helping with our environment?

My hon. Friend makes a strong point. We believe that our new system of farm support can work for farmers and our environment. We believe that we can do a thousand times better than has been the case under the CAP.

My right hon. Friend must surely agree that the purpose of subsidy is to ensure that British agriculture can compete with agriculture in the European Union and, indeed, the rest of the world. Will she therefore ensure that her Department does the necessary research, so that when we move from direct payments for acreage to public money for public goods, the money does arrive on the farm? We cannot afford for our farmers to be poorer because of these excellent intentions.

We will be looking carefully at all aspects of the scheme. This is a hugely challenging thing to deliver, which is why we will phase it in over seven years. Of course, it is essential to get the funds to the farmers who are delivering the public goods that we want to secure. Because change always brings its challenges, to ease the introduction of the new system, we will adopt a seven-year transition period, and the Bill is a vital step in smoothing the path towards the start of that period.

This legislation may be less radical than the forthcoming Agriculture Bill, but it is still vital for the livelihood of farmers across our United Kingdom. I hope that Members will give their backing to this short but crucial legislation, so that we can give our farmers continuity, certainty and support as we move towards exit day and our departure from the European Union. The Bill provides a stepping stone to a more profitable, more productive, more resilient and more sustainable future for farming in this country, so that our hard-working farmers can continue to produce high-quality, high-welfare, iconic British food that is prized around the world and appreciated so much by all of us here at home. I commend the Bill to the House.

Today, I am introducing the Government’s landmark Agriculture Bill to the House of Commons. This Bill delivers a new settlement for agriculture and those involved in this vital industry should be in no doubt of this Government’s absolute commitment to them and all those who produce our food and protect our environment.

Agriculture is one of this country’s great industries and nearly three-quarters of land in England is farmed. But despite its scale and importance to our nation, decisions about its future have, for the past half century, largely been decided in Brussels. All the while, our priorities have been overlooked, our productivity stifled, and farmers hindered in their preservation of our environment. These are the legacies of the common agricultural policy (CAP).

The CAP awarded subsidies based on the size of individual land holdings, and not the contribution farmers make to our society. The top 10% of recipients received the lion’s share of payments—almost 50%—while the bottom 20% received just 2%. Meanwhile, our farmers struggled with burdensome and inflexible bureaucracy at the expense of our countryside and their own well-being.

Our Agriculture Bill marks a decisive shift and will remove the constraints and burdens of the CAP and replace it in England with a new and fairer system that rewards farmers properly for the work they do to enhance our environment and safeguard high animal welfare standards. And it will do so gradually allowing farmers and land managers time to adapt to our reforms and transform the agriculture sector for the better. Change takes time and the Government are conscious that farmers will need to plan and adapt. The Bill will enable a seven-year agricultural transition in England as we gradually move away from the CAP.

At the heart of the Government’s proposal is a new system for England that pays public money for the delivery of public goods, such as clean air and water, from which we all benefit but the market alone does not provide. The Bill will allow us to invest public money in enriching wildlife habitats, preventing flooding, improving the quality of air and soil, planting more trees and raising standards of animal welfare. The enhancement of these public goods will help manage and mitigate the effects of climate change which is of profound public concern. The Bill will therefore be instrumental in delivering on the Government’s crucial goal to be the first generation to leave the environment in a better state than we found it.

This Bill champions food producers and makes ground breaking strides to allow for a fairer, more transparent supply chain that will increase productivity and protect producers and consumers from unfair trading practices. It will create opportunities for new entrants who want to farm but have in the past had little prospect to do so. And it will incentivise longer-term thinking and investment while helping farm businesses to become more resilient and productive.

The Bill will also modernise aspects of agricultural regulation and make sure that they are tailored to the domestic market. It will include new UK-wide provisions on organics and fertiliser regulations. It will enable new marketing standards to be set for agricultural products in England and reform agricultural tenancies in England and Wales to reflect a more modern and fair agricultural system.

It has always been the Government’s intention to change our agricultural policy once we had left the EU. The Agriculture Bill introduced on 12 September 2018 fell with the dissolution of Parliament last year, but the principles in that Bill had broad support in this House and with our farmers and land managers across this country. We now have a second chance to pass an Agriculture Bill that will set a bold new course for farming in this country for decades to come.

The Government is clear that future policy will respect the devolved status of farming. By bringing back powers from Brussels to Cardiff, Belfast and Edinburgh, devolved Administrations can design policies that meet the needs of their own farmers, foresters and consumers and the challenges of their unique landscapes. The Welsh Government and Northern Irish Executive have asked the Government to extend certain powers in the Bill to Wales and Northern Ireland. The Scottish Government have chosen not to take any powers in the Bill and have instead introduced the Agriculture (Retained EU Law and Data) (Scotland) Bill in the Scottish Parliament in November 2019.

This is an ambitious Bill which makes the most of the opportunities created from leaving the European Union. It marks the first domestic farming policy in nearly 50 years and the first step towards a brighter, better and greener future for farming and our environment outside the EU.
